0.142.36 translation agreement between the Swiss Confederation and the Republic of Austria concerning the establishment and operation of the international Centre for the development of migration policies (ICMPD) to Vienna determined in Vienna on June 1, 1993, approved by the Federal Assembly on 18 June 2004, entered into force for Switzerland with retroactive effect may 1, 1993 (State on February 8, 2005) art. 1 objectives of the agreement in recent years, the irregular South-North migration and asylum has intensified and new East-West migrations is observed for some time. This agreement aims to promote international cooperation and research in the field of migration management.

Art. 2International Centre for Migration Policy Development (1) the contracting parties recognize the International Centre for Migration Policy Development (ICMPD), which is headquartered in Vienna, the status of international organization. The task of the ICMPD will be to analyze real and potential migratory flows in the direction of the country in Europe, to observe the evolution of the situation in the countries of origin of migrants, as well as to develop measures designed to improve the identification and control migratory movements.
(2) the above-mentioned international organization is a legal person.
(3) the legal personality, the privileges and immunities of the ICMPD in Republic of Austria will be subject to the law in force in the Republic said.

Art. 3 Steering Group representatives of the contracting parties constitute a steering group. Each Contracting Party has a seat.
Of the Steering Group is chaired successively by each party.
Representatives of the Steering Group meet as often as necessary, but at least three times per year.

Art. 4 tasks of the Steering Group the Steering Group - oversees the activities and the functioning of the ICMPD, - appoints the Director of the ICMPD - approves the annual report of the Director of the ICMPD - approve and finance the regular annual budget of the ICMPD, - approves the annual accounts of the ICMPD - approved the programme of work of the ICMPD, - approved the programme of conferences of the ICMPD - approve agreements concluded by the ICMPD , - approves projects submitted by or to the ICMPD, - supports the ICMPD under its political contacts, - takes note of the reports on the progress of the ICMPD, - advises the Director of the ICMPD on important issues - appoints the members of the Advisory Committee, - offers and decides on the admission of new members.

Art. 5 Director of ICMPD Director of ICMPD work closely with international and national institutions and organizations active in the field of migration management. It is, as appropriate, in accordance with the request of international organizations, conferences, devices and action plans - such as those of Vienna, Berlin or Budapest - or other related forums. It informs policies and migration practices in industrialized countries and other countries concerned as well as research carried out in the field. It manages and maintains documentation on the subject. In addition, it analyzes the policies and migration trends, and he develops appropriate strategies to solve problems related to the phenomenon of migration.
The strategic platform created in "Informal Consultations" is an important basis for the work of the Director. With this in mind, the latter examines particularly the question of the availability of the Contracting Parties on the demographic, economic, social, political, cultural and ecological plans. In addition, he oversees and intensifies the efforts to date in the fight against the causes of migration, and with a view to a better control of migratory movements. Finally, it makes proposals for the harmonization of policies and migration practices at the international level.
The ICMPD Director reports directly to the Steering Group. He recruits and supervises the staff which funds have been allocated. Its tasks are regulated in a separate document and defined in detail.

Art. 6 use of the services offered by the ICMPD contracting parties are allowed to make use of an unlimited all results arising from the activities of the ICMPD insofar as they contribute to the development of their migration policies as well as to the efforts made at the international level in terms of migration management.
If they consider it appropriate, contracting parties may make these results available to institutions concerned with the phenomenon of migration.
Within the limits of their availability, the ICMPD services are at the disposal of the contracting parties.

Art. The ICMPD 7Financement the contracting parties support they only all of the regular costs of the ICMPD.
Each year, the ICMPD Director transmits a draft budget for the following year covering the costs among other staff in the orientation group, travel, premises, administration and representation of the Center. The orientation Group approves the budget and allocates costs - in equal parts wherever possible - between the contracting parties.
The ICMPD will accept, as appropriate, grants to projects, voluntary contributions and other donations made in his favour.
Any modification to the budget, including any increase in contributions to be submitted, the contracting parties must be approved by the Steering Group.

Art. 8 accession of new parties and organizations the International Steering Group may invite new States and international to become organizations parts of this agreement.
Mutual trust and common interest are prerequisites for accession of new parties to this agreement.

Art. 9 Committee the Advisory, Director of the ICMPD is assisted by an Advisory Committee made up of politicians and scientists, and in which are represented different countries and international organizations. The Advisory Committee cannot give orders to the Director of the ICMPD. On the other hand, it can propose projects and participate in research funds for the implementation of the latter.

Art. 10siege and administration of the ICMPD the Republic of Austria is committed to facilitate, in as much as possible, the operation and activities of the ICMPD and his staff in the execution of this agreement.

Art. 11resiliation of the agreement each Contracting Party may terminate the agreement with a notice period of three months.
