0.632.401.2 original Protocol No. 2 concerning certain processed agricultural products signed in Brussels on 22 July 1972 approved by the Federal Assembly on October 3, 1972 Swiss Ratification communicated on December 21, 1972, entered into force for the Switzerland on 1 January 1973 (status 1 April 2015) art. 1 General principles 1. The provisions of the agreement apply to the products listed in tables I and II unless otherwise stated in the present Protocol.
2. in particular, for these products, the Contracting Parties must not levy tariffs on imports or loads of equivalent effect, including agricultural components, nor provide refunds to export, any refund, any discount or any waiver of payment, partial or complete, of customs or effect loads rights equivalent.
3. the provisions of this Protocol apply by analogy to the Principality of Liechtenstein until the application of Protocol No 3 of the agreement on the European economic area for the Principality of Liechtenstein.

RS 0.632.401 FF 1992 IV 1 art. 2 the 1 price compensation measures. To account for differences in the cost of agricultural raw materials used in the manufacture of products specified in table I, the agreement does not exclude the application of these products price compensation measures; namely the removal of agricultural import components and the granting of export refunds or the granting of refunds, rebates or exemptions of payment, partial or total rights of customs or loads of an effect equivalent.
2. If a contracting party apply internal measures, which reduce the price of the raw material for processing industries, these measures are taken into account in the calculation of the amounts of compensation of price.

SR 0.632.401 art. 3 compensation measures of prices to import 1. The basic amounts of the Switzerland for agricultural raw materials taken into account in the calculation of the agricultural components to import exceed either the difference between the Swiss domestic reference price and the reference price internal Community for the agricultural raw material concerned nor the Swiss import duty applied for agricultural raw material when it is imported as such.
2. the Swiss plan import for products specified in table I is established in table IV.
3. If the Swiss domestic reference price is lower than the price of Community internal reference, the community can introduce the price compensation measures established in art. 2, namely the perception of agricultural items to import, in accordance with the Regulation (EC) 1460/96 and subsequent modifications.

Art. 4 compensation measures of prices to export 1. Swiss export or refunds refunds, rebates or gave them credit, partial or total, customs or rights charges of equivalent effect to export to the community for the products listed in table I do not exceed the difference between the Swiss domestic reference price and the reference price internal Community for agricultural raw materials used in the manufacture of these products multiplied by the quantities actually used. If the Swiss domestic reference price is equal to or lower than the Community internal reference price, the Swiss return to export or refund, delivery or the relief payment, partial or complete, of customs duties or charges of equivalent effect is zero.
2. If the Swiss domestic reference price is lower than the price of Community internal reference, the community can introduce the price compensation measures established in art. 2, namely the granting of refunds, in accordance with the Regulation (EC) 1520/2000 and in its subsequent amendments, or the granting of refunds, discounts or exemptions from payment, partial or total, tariffs or charges of equivalent effect rights.
3. for sugar (1701, 1702 and 1703 of the harmonized system codes) used in the manufacture of products listed in table I and table II, the Contracting Parties must not grant of export refunds or rebate, discount or payment, partial or total exemption, tariffs or charges of an effect rights equivalent.

Art. 5 reference price 1. The community and Swiss domestic reference prices for agricultural raw materials referred to in art. 3 and 4 are listed in table III.
2 the Contracting Parties provide periodically, at least once a year, the Joint Committee the domestic reference prices of all raw materials for which price compensation measures are applied. Domestic reference prices provided to reflect the actual price situation on the territory of the Contracting Party. This is normally paid prices wholesale or at the stage of production by the manufacturing industries. If an agricultural raw material is available to processing industry, or of a part of this industry, at a price lower than the price otherwise prevailing in the domestic market, provided domestic reference prices are adjusted accordingly.
3. the Joint Committee sets the domestic reference prices and the differences in prices for agricultural raw materials listed in table III on the basis of the information provided by the services of the European Commission and the Swiss Federal Administration. If this is necessary for the preservation of related preferential margins, the basic amounts of agricultural raw materials in table IV are suitable.
4. the Joint Committee reviewing the domestic prices of agricultural raw materials referred to in art. 3 and 4 as set out in table III before applying this Protocol.

Art. 6 special provisions on administrative cooperation of special provisions on administrative cooperation are set out in the appendix to the present Protocol.

Art. 7 changes the Joint Committee may decide to amend the tables, appendices of tables and the appendix to the present Protocol.

The Contracting Parties agree that administrative cooperation is essential for the implementation and control of the preferential treatment granted under this Protocol and underline their commitment to combat irregularities and fraud in customs and related affairs.
2. where a Contracting Party has found, on the basis of objective information, a lack of administrative co-operation and/or of irregularities or fraud in respect of this Protocol, the Contracting Party concerned may temporarily suspend the relevant preferential treatment of the product (s) (s) concerned in accordance with this annex.
3. for the purposes of this appendix, we hear, among other things, by default of administrative cooperation: a) a breach repeatedly the obligations of verification of the origin of the product (s) (s); b) repeated refusal or the undue delay about the institution and/or the communication of the results of the verification of the proof of origin; c) the repeated refusal or the undue delay in obtaining authorisation to conduct administrative cooperation missions to verify the authenticity of documents or the accuracy of information relevant for granting the preferential treatment in question.

For the purposes of the application of this appendix, irregularities or fraud may be observed especially when information objective y related show a rapid increase, without satisfactory explanation, for the entry of goods exceeding the usual level of capacity of production and export of the other Contracting Party.
4. the application of a temporary suspension is subject to the following conditions: a) the Contracting Party which has found, on the basis of objective information, a lack of administrative co-operation and/or of irregularities or fraud in customs and related affairs, shall notify without delay to the Board its findings and information objective and open consultations in the Joint Committee on the basis of all relevant information and the objective findings, to find a solution acceptable to the two Parties contractantes.b) when the Contracting Parties have opened consultations within the Joint Committee in accordance with the foregoing and found no acceptable solution within 3 months following the notification, the Contracting Party concerned may temporarily suspend the preferential treatment relevant to the product (s) (s) concerned. A temporary suspension shall be notified without delay to the Committee mixte.c) temporary suspensions under this appendix may not go beyond what is necessary to protect the financial interests of the Contracting Party concerned. They cannot exceed a period of six months, which may be renewed. Temporary suspensions shall be notified immediately after their adoption to the Joint Committee. They are the subject of periodic consultations within the Joint Committee, in particular to terminate as soon as the conditions for their application cease to exist.

5. at the same time as the notification to the Joint Committee referred to in point 4, point a), of this appendix, the Contracting Party concerned should publish a notice to importers in its official journal. The notice to importers should indicate that, for the product concerned, it was found, on the basis of objective information, a lack of administrative cooperation and/or irregularities or a fraud.
