0.431.026.81 original text agreement between the Swiss Confederation and the Community European on cooperation in the field of statistics, concluded on 26 October 2004, approved by the Federal Assembly on 17 December 2004, entered into force by Exchange of notes on 1 January 2007 (report on June 12, 2013) the Confederation Swiss, hereinafter referred to as 'Switzerland', and the Community European, hereinafter referred to as 'the Community' hereinafter jointly referred to as the 'Contracting Parties', eager to improve cooperation between the Switzerland and the community in the field of statistics and to define for this purpose, by this agreement, the principles and conditions that should govern such cooperation;
Judging that there is place to take appropriate measures to achieve a gradual harmonization and ensure the coherent evolution of the legal framework for data collection, nomenclatures, definitions and statistical methodologies;
Whereas common rules for the production of statistics on the territory covered by the Switzerland and the community;
agreeing it should be to base those rules on the legislation which is in force in the community, have agreed on the following: art. 1 purpose of the agreement 1. This agreement applies to the cooperation between the Contracting Parties in the field of statistics to ensure the production and dissemination of coherent and comparable statistical information, to describe and follow all economic, social and environmental policies relevant to bilateral cooperation.
2A this effect, Contracting Parties develop and apply methods, definitions and nomenclatures of harmonized, as well as programs and common procedures organizing statistical to administrative levels work appropriate and in accordance with the provisions of this agreement.
3. the production of statistics by the Contracting Parties to respect the principles of impartiality, reliability, objectivity, scientific independence, in search of the best cost-effectiveness and statistical confidentiality; She does not excessive burdens on economic operators.

Art. 2 legal acts in the field of statistics the acts referred to in Annex A, such as adapted in this agreement, are binding on the Contracting Parties.

Art. 3 Joint Committee 1. There is established a Committee composed of representatives of the Contracting Parties, called ' community/Switzerland Statistical Committee' (hereinafter 'Joint Committee').
The Joint Committee is responsible for the management of this agreement and ensuring the correct implementation. For this purpose, it makes recommendations and stop decisions in the cases provided for in this agreement. The Joint Committee shall act by mutual agreement. Its decisions are binding on the Contracting Parties.
2. the Joint Committee and the Committee of the statistics programme (SPC), established by decision 89/382/EEC, Euratom of the Council of 19 June 1989, organize their work for the purpose of this agreement as part of joint meetings.
3. the Joint Committee adopts its rules of procedure, which contains, among other provisions, procedures for convening meetings, designation of the Presidency and of definition of the mandate of the latter by decision.
4. the Joint Committee shall meet as needed. Each Contracting Party may request the convening of a meeting. The Joint Committee may decide to create subcommittees or working groups to assist it in the performance of its tasks.
5. a Contracting Party may at any time make an issue at the level of the Joint Committee.
6. each decision indicates the date of its application. If necessary, decisions are subject to ratification or approval by the Contracting Parties, in accordance with procedures which are their own, and are implemented by the Contracting Parties in accordance with the rules that are their own.

Art. 4 new legislation 1. This agreement shall apply without prejudice to the right of each Contracting Party, subject to compliance with the provisions of this agreement, to amend unilaterally its legislation on a point regulated by this agreement.
2. in the course of the period preceding the formal adoption of new legislation, the Contracting Parties inform each other and consult each other as closely as possible. At the request of one of the Contracting Parties, a preliminary exchange of views may take place within the Joint Committee.
3. as soon as a Contracting Party has adopted an amendment of its legislation, it shall inform the other Contracting Party.
4. the Joint Committee:-adopt a decision revising annex A or Annex B or, if necessary, proposes a revision of the provisions of this agreement to incorporate, if necessary on a basis of reciprocity, the amendments to the legislative text in question;- or adopt a decision whereby changes to the legislative text in question are considered as compatible with the proper functioning of this agreement;- or decide any other measure to ensure the good functioning of this agreement.

Art. 5 statistical co-operation 1. The Community statistical programme referred to in chapter II of Regulation (EC) n 322/97 of 17 February 1997 on Community statistics Council, adopted by decision of the European Parliament and the Council regularly forms the framework for the statistical actions to be implemented by Switzerland during the periods covered by each program. All main fields and statistical themes of the Community statistical programme are considered important for statistical co-operation between the community and the Switzerland, and can participate fully.
2. a specific annual statistical programme Community/Switzerland is produced each year, in parallel with the annual work programme defined by the Commission in accordance with the decision of the European Parliament and of the Council establishing the specific Community statistical programme which will have to be done, and is a subset of the said work programme. Each community/Switzerland annual statistical programme is submitted for review and approval to the Joint Committee. It indicates in particular the actions of the themes of the program that are important and which are a priority for the statistical co-operation between the community and Switzerland during the period covered by the programme.
3. the statistical information provided by the Switzerland are transmitted to Eurostat for their storage, processing and dissemination. For this purpose, the federal Office of Swiss statistics works in close cooperation with Eurostat in order to ensure that data from the Switzerland are transmitted properly and disseminated to the various user groups through the normal channels, as part of the community/Switzerland statistics.
The treatment of statistics from the Switzerland is governed by Regulation (EC) n 322/97 of the Council of 17 February 1997 on Community statistics.
4. the Joint Committee examines the progress made in the context of the community/Switzerland statistical actions. In particular, it determines whether the objectives, priorities and actions planned during the first three years of application of this agreement have been achieved. It also examines whether the content of Appendix A is sufficiently in line with the concept of relevance, referred to in art. 1, by. 1 art. 6 participation 1. Entities established in Switzerland shall be entitled to participate in specific Community programmes managed by Eurostat, with the same contractual rights and obligations as entities established in the community. However, entities established in Switzerland may claim any financial contribution from Eurostat.
2. Swiss national experts can be seconded to Eurostat. The costs associated with the secondment of national experts from Eurostat Swiss, including salaries, social security contributions, contributions to the pension system, daily allowances and travel allowances, are entirely the responsibility of the Switzerland.
3. the entities established in the community have the right to participate in specific programs managed by the federal Office of the Swiss statistics, with the same contractual rights and obligations as entities established in Switzerland.

Art. 7. other forms of cooperation 1. The federal Swiss Statistical Office and Eurostat can proceed by mutual agreement for a transfer of technology in the field of statistics.
2. the Contracting Parties may exchange information in the field of statistics.
3. the statistical services of the Contracting Parties may exchange official agents. The statistical services of the Member States of the community may also exchange with the Switzerland official agents. These trade conditions are agreed directly between the statistical services concerned.

Art. 8 financial provisions 1. In order to cover all the costs of its participation, the Switzerland brings on an annual basis, a Community financial contribution to the statistical programme from the date of entry into force of this agreement.
2. the provisions governing the Switzerland's financial contribution are set out in Annex B.

Art. 9 the nondiscrimination


In the area of application of this agreement, and without prejudice to any special provisions contained therein, any discrimination based on nationality is prohibited.

Art. 10 compliance the Parties contracting to take all measures, General or particular, to ensure the performance of the obligations resulting from this agreement and refrain from taking any measure likely to jeopardize the achievement of the objectives of it.

Art. 11 annexes the annexes are an integral part of this agreement.

Art. 12 scope territorial this agreement applies, on the one hand, to the territories where the Treaty establishing the European Community is application and under the conditions laid down by that Treaty and, on the other hand, to the territory of the Switzerland.

Art. 13 entry into force and duration 1. This agreement is ratified or approved by the Contracting Parties in accordance with the procedures which are their own. It comes into force on 1 January of the year following the date on which the Contracting Parties inform each other that the procedures necessary to this end have been completed.
2. this agreement is concluded for an initial period of five years. Except denunciation written six months before the end of this period, the agreement is considered as being renewed for an indefinite period.
3. each Contracting Party may denounce this agreement by written notification to the other Contracting Party. In this case, this agreement comes to expire six months after the date of the notification.

Art. 14 languages 1. This agreement is drafted in duplicate in the languages German, English, Danish, Spanish, Estonian, Finnish, French, Greek, Hungarian, Italian, Latvian, Lithuanian, Dutch, Polish, Portuguese, Slovak, Slovenian, Swedish and Czech, each of these texts being equally authentic.
2. the Maltese version of this agreement will be authenticated by the Contracting Parties on the basis of an exchange of letters. She will also be faith, in the same way as the languages referred to the by. 1. in faith, the undersigned Plenipotentiaries have affixed their signatures at the bottom of this agreement.

Annex A legal acts in the field of statistics referred to in art. 2 sectoral adjustment 1. Under the Treaty of Lisbon entered into force on 1 December 2009, the European Union replaces and succeeds the European Community.
2 off the States referred to in the relevant acts of the European Union, the expression '(s) Member State (s)' contained in the acts referred to in this annex shall cover also the Switzerland.
3. the Committee of the statistics programme (SPC) referred to in art. 3, by. 2, of the present agreement is replaced by the Committee of the European statistical system (ESS Committee) established by art. 7, by. 1, of Regulation (EC) n 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics and repealing Regulation (EC, Euratom) n 1101/2008 of the European Parliament and of the Council on the transmission to the Statistical Office of the European communities of statistics covered by secrecy, the Regulation (EC) n 322/97 to the Council on Community statistics, and decision 89/382/EEC Euratom of the Council establishing a Committee on the statistical programme of the European communities.
4. the Community statistical programme referred to in art. 5, by. 1 and 2, and art. 8, by. 1, of the present agreement was replaced by the European statistical programme provided in art. 13 of the Regulation (EC) n 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics.
5. the Joint Committee notes that the rules governing the treatment of statistics from the Switzerland referred to in art. 5, by. 3, of the present agreement are now in the Regulation (EC) n 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics, without prejudice to more specific rules in this annex.
6. unless otherwise provided, references to «nomenclature of economic activities in the European Communities (NACE Rev.» (1)"shall be understood as references to the 'nomenclature of economic activities in the European Communities (NACE Rev.» (2)", within the meaning of Regulation (EC) n 1893/2006 of the European Parliament and of the Council of 20 December 2006 establishing the statistical nomenclature of economic activities NACE Rev. 2 and amending Regulation (EEC) No 3037/90 as well as certain regulations (EC) relating to specific statistical areas. Code numbers to which reference is made shall be read as the corresponding code numbers of the NACE Rev. 2 7. The provisions on management of costs to carry out investigations and similar costs shall not apply for the purposes of this agreement.

For the purposes of this agreement, the provisions of the regulation are adapted as follows: a) the Switzerland transmits the data listed in annex I, sections 1 and 2, category A, on the type of accommodation NACE 55.2 from 2016 (reference year); b) the Switzerland transmits the data listed in annex I, section 2, section B, concerning the type of accommodation NACE 55.2 for all periods of reference within a period of 4 months from the end of the year from 2016 (reference year); c) the Switzerland transmits the data listed in annex I, section 2, section B, concerning the type of accommodation NACE 55.3 for all periods of reference within a period of 4 months from the end of the reference year; d) the Switzerland transmits the data listed in annex II within a period of 12 months from the end of the reference period together with a report on the quality of the data.

For the purposes of this agreement, the provisions of the regulation are adapted as follows: a) all the provisions on centralised customs clearance the customs do not apply; b) art. 2. 'definitions': the statistical territory comprises the customs territory excluding customs warehouses and duty-free warehouses. The Switzerland is not required to compile statistics on trade between the Switzerland and the Liechtenstein;
(c) art. 5, by. 1,-'Statistical data': the statistical data referred to in art. 5, by. 1, point e), are collected for the first time on January 1, 2016.Les provisions of art. 5, by. (1, points f) and k), are not applicable.
The classification referred to in art. 5, by. 1, point h), is applied, at least at the level of the first six digits.
For Switzerland, the provisions of art. 5, by. 1 m points) ii) and (iii), shall not apply;
(d) art. 6. "establishment of external trade statistics": the provisions of art. 6 shall not apply to statistical data that the Switzerland is provided to collect the title of art. 5 of the regulation concerned; e) art. 7. "data exchange": the provisions of art. 7, by. 2, shall not apply.

In accordance with the provisions of art. 6, by. 2, the costs associated with the secondment of Swiss national officials from Eurostat are fully supported by the Suisse.Sous reserve of an agreement between Eurostat and the federal Office of the Swiss statistics, the Switzerland may deduct the cost of seconded national experts to its financial contribution. The amount to be deducted for each official shall not exceed the maximum deducted for officials from EEA-EFTA countries who are seconded to Eurostat on the basis of the EEA Agreement. This amount is agreed on an annual basis by the Joint Committee.

2.5 payments made by the Switzerland are credited as budgetary revenue allocated to the corresponding budget line of the statement of revenue of the general budget of the European Union. The financial regulation applicable to the general budget of the European communities applies to the management of the credits.3. Conditions of oeuvre3.1 the financial contribution of the Switzerland referred to in art. 8 rest normally unchanged for the year to cause.3.2 at the closing of the accounts for each financial year (n), performed to the order of the account of revenues and expenditures, the Commission proceeds to the regularisation of the accounts relating to the participation of the Switzerland, taking account of the changes resulting from transfers, cancellations, deferrals, or supplementary and amending budgets adopted this year. This regularization is operated as part of the budget for the fiscal year (n + 2) and must be reflected in the call to fonds.4. Information4.1 no later than 31 May of each financial year (n + 1), the State of the appropriations for the operational and administrative of Eurostat financial obligations, relating to the previous financial year (n), is prepared and communicated to Switzerland for information, according to the format of the account of revenues and expenditures of the Commission.4.2 the Commission communicates to the Switzerland all other general financial data relating to Eurostat which are available to the members of the EEA EFTA States.

Final act the Plenipotentiaries of the Swiss Confederation and the European Community, meeting on 26 October 2004 in Luxembourg of the year two-thousand-four for the signature of the agreement between the European Community and the Swiss Confederation on cooperation in the field of statistics, took note of the following joint statement, which is annexed to this final act : Joint declaration by the Contracting Parties on the revision of annexes A and B by the Joint Committee.

State on 12 June 2013 Joint Declaration by the Contracting Parties on the revision of annexes A and B by the Joint Committee, the Joint Committee shall meet as soon as possible after the entry into force of this agreement to prepare the review of Schedule A in order to update the list of legislative acts contained therein and to incorporate the Community statistical programme in force. In addition, the Joint Committee updates and review annexes A and B at the time of the entry into force of each new multiannual statistical programme referred to in art. 5, by. 1, so as to add a reference to this program and to take into account its specificities, including arrangements for the Switzerland's financial contribution.

Statement by the Council on the participation of Switzerland in the committees of the Council should be representatives of the Switzerland to participate, from the start of cooperation in the context of the programmes and actions referred to in art. 5, by. 2, of this agreement, and for the points which concern them, fully without the right to vote in committees and other bodies to assist the Commission of the European communities in the management and development of such programmes and actions.
In what concerns the other committees dealing with areas covered by this agreement and in which the Switzerland took over the Community acquis or applied by equivalence, the Commission will consult with experts from the Switzerland according to art. 100 of the EEA Agreement.
