Ordinance on the Protection of Cultural Property in the Event of Armed Conflict, Disaster or Emergency

(OPBC)

The Swiss Federal Council,

Having regard to art. 3, para. 5, 9, para. 2, 15, para. 4, and 21, para. 1, of the Federal Act of 20 June 2014 on the protection of cultural property in the event of armed conflict, disaster or emergency situation (LPBC) 1 ,

Stops:

Art. 1 Categories of cultural property and criteria

1 Cultural property is classified as follows:

A.
Cultural property of national significance (objects A);
B.
Cultural property of regional importance (objects B);
C.
Cultural property of local importance (objects C).

2 When classifying, the following criteria are taken into account:

A.
Architectural and artistic significance;
B.
Importance from a scientific perspective;
C.
Importance from the perspective of concept and materials;
D.
Historical significance;
E.
Technical significance;
F.
For buildings, in addition to the criteria referred to in the let. A: importance in the local and landscape context and quality of the work in its immediate environment;
G.
For the collections, in addition to the criteria referred to in the let. A to e:
1.
Value of the collection in its context,
2.
Cultural outreach and awareness,
3.
Condition of objects and storage type.
Art. 2 Inventory PBC, C objects and Confederation geportertail

1 The inventory of objects A and B (PBC Inventory) is developed by the Federal Office for the Protection of Population (OFPP) in collaboration with the cantons and the Federal Commission for the Protection of Cultural Property. It is updated regularly.

2 The cantons regulate the designation of objects C.

3 The OFPP provides data on objects A to the Federal Office of Topography. It reproduces them in the geoportail of Confederation.

Art. 3 Information

The OFPP and the cantons ensure that the authorities, specialised services, specialised organisations and the public are informed of the meaning and purpose of measures for the protection of cultural property.

Art. 4 Instruction and staff

1 The training of civil protection officials responsible for the protection of cultural property and cultural property specialists within civil protection focuses in particular on the following themes:

A.
The establishment of inventors;
B.
The development of summary documentation;
C.
Removal planning;
D.
Planning for intervention in collaboration with the sappers;
E.
Disaster response.

2 The training of staff of cultural institutions focuses in particular on the following themes:

A.
Planning for protective measures;
B.
The support and advice of the partner organisations for the protection of the population in the event of a disaster.

3 The OFPP provides the cantons with the necessary training documents.

Art. 5 Security documentation and photographic security reproductions

1 The Federal Department of Defence, Population and Sports Protection (DDPS) defines the requirements for security documentation and the modalities for the preparation, handling, processing and storage of the Photographic security reproductions.

2 The OFPP maintains a centralized repository for security photographic reproductions.

3 It acquires a photographic reproduction of the safety of each film supplied by the cantons, in the form of a positive copy, and preserves it.

Art. 6 1

1 Repealed by c. I of the O of 11 Nov 2015, with effect from 1 Er Jan 2016 ( RO 2015 4751 ).

Art. 7 Signage

1 The OFPP sets out the technical requirements for making and affixating the distinctive sign.

2 It may hand over the distinctive signs to the cantons already in peacetime.

Art. 8 Refuge

The PPO, in close cooperation with the relevant federal departments, applies the treaties referred to in s. 12, para. 2, LBC.

Art. Repeal and modification of other acts

The repeal and amendment of other acts are set out in the Annex.

Art. 10 Entry into force

This order shall enter into force on 1 Er January 2015.

I

The Ordinance of 17 October 1984 on the Protection of Cultural Property 1 Is repealed.
