431.841 order on the federal register of buildings and dwellings of May 31, 2000 (State October 1, 2012) the Swiss federal Council, view of art. 10, al. 3, of the Federal Act of 9 October 1992 (LSF) Federal statistics, stop: Section 1 provisions general art. 1 Organization and skills the federal Office of statistics (office, FSO) is the federal register of buildings and dwellings (RBD) for statistical, research and planning. He works closely with the statistical services of the Confederation, the cantons and Commons offices cantonal and municipal buildings as well as the Federal, cantonal and municipal of cadastral measurements. After consulting agencies, UNRWA gives them the necessary technical instructions.

Art. 2 the registers of buildings and of the cantons and cities housing the Agency may delegate the RBD holding or part of it to the cantons whose records meet the following conditions: a. they list buildings that meet the definition of art. 3; (b) they cover at least the buildings and housing defined in art. 4, al. 1; c. they understand at least the character building and housing referred to in art. 5, al. 1 and 2; (d) they meet the quality standards set out in art. 8, al. 2 as appropriate, the Agency allocates the cantons an annual contribution to the keeping of the registers. This contribution consists of a basic amount of 10,000 francs by registry and an amount calculated according to the number of buildings and 15 cents by building housing and 1 centime per accommodation.
Registers of buildings and housing in cities with at least 5000 buildings housing or 12,000 homes can also be recognized within the meaning of para. 1 with the agreement of the cantons.

Section 2 content and management art. 3 definition of the term 'building' buildings are durable constructions, well anchored in the ground and used for housing, work, training, culture or sport.
In the case of double houses, row, or group each building having its own access from the outside and separated from the others by a vertical wall adjoining from the ground floor to the roof is considered an independent building.

Art. 4 buildings and registered housing the office registers all buildings inhabited or living space and housing that are part in the RBD.
The Agency can also record in the RBD, if necessary, of the buildings not used to the habitat and objects to the State project or construction.
In the case of the cantons and the cities holding their own register of buildings and dwellings, the office registers in the RBD all buildings as long as the data to be provided in accordance with art. 8. the objects, buildings and military installations subject to the order of 2 May 1990 on the protection of the works cannot be considered and treated in the RBD.

SR 510.518.1 art. 5 characters registered the office registers the following characters for buildings in the RBD: a. building number attributed by the office (EGID); b. the town attributed by the office number and name of the commune; c. number of the land (parcel number) d. number of the canton or commune building; e. the building address, postcode routing and place included; f. benchmark of the building (the building details); g. belonging to statistical areas districts and other territorial units infracommunales; h. status of the building (project/completed/demolished); i. building category (home / without residential tenancies); j. year or period of construction; k. year or period of the last renovation; l. year of demolition of the building; Mr. floor space; n number of floors; o. number of rooms in the building (garrets); p. main heating system; q. energy agents for heating; r. energy agents for water hot; s. directions to the annual statistics of construction and housing in accordance with the annex to the order of 30 June 1993 on the enforcement of the Federal statistics.

The office registers the following characters on housing in the RBD: a. building number attributed by the office (EGID); b. slot number attributed by the office (EWID); c. number of housing the canton or commune; d. floor; e. location of housing (housing physical number and other indications); f. type of use of housing (permanent or temporary use); g. number of rooms of housing; h surface housing; i. fixed kitchen in the housing system.

The Agency can also save the following auxiliary characters in the RBD: a. numbers of building or housing authorities public or private; b. indications concerning a person of reference or responsible stewardship of the building; c. the codes or the additional information necessary for the holding of the RBD.

Art. 6 sources the following sources can be used for data saved in the RBD: a. records of permit for construction and acceptance of the work of the cantons and communes; b. the administrative registers of the Confederation, cantons and municipalities; (c) the basis of the cadastral data; (d) the administrative records of the cantonal property insurance; e. data collected by the post office telecommunications services and industrial services; f. publicly available address lists; g. the annual statistics of the construction and housing h. periodic censuses of businesses of the Switzerland; i. communications made by masters of work, architects, owners and managers; j. communications made by users of the data of the RBD.

Data from registers of the Confederation, cantons and municipalities should be made free of charge at the disposal of the Agency for the update of the RBD.

Art. 7 update the RBD is put to date in principle on a permanent basis, but at least once per quarter by the office, or by a service within the meaning of art. 2. the cantons and communes, provide the Board with information necessary for the holding of the RBD and its quality control, as long as the Agency has not had knowledge by a recognized registry referred to in art. 2 or from other sources.
Data for new construction, renovations and demolitions are identified in coordination with the statistics of construction and housing of the office on the basis of procedures of permit for construction and acceptance of the works in the cantons and communes.
According to the State of the data in the cantons and municipalities, the Agency may declare optional update of the following characters for building and housing: a. number of the canton or commune building; b. belonging to statistical areas, districts and other territorial units infracommunales; c. surface on the ground; d. number of accommodation of the canton or commune; e. location of housing (housing physical number and other information).

The office supports the Commons in their task and sets, together with the cantons, in what form the necessary information must be transmitted.

Art. 8 interfaces in collaboration with the cantons, the Agency regulates the terms and conditions of the electronic exchange of information through data as well as media of implementing the necessary interfaces.
The Agency sets audits and quality standards necessary to the electronic record, in the RBD, data from the registers of buildings and housing recognized in the sense of art. 2, as well as other sources referred to in art. 6 section 3 use and disclosure of data art. 9 principles the use and communication of data in the register are based on the provisions of the RSA and by the law of June 19, 1992, on the protection of the data.
The use and disclosure of recorded in the RBD communal or cantonal data are governed by the provisions of the art. 10-16, regardless of the source of their record in the RBD.

RS 235.1 art. 10 use of data for statistical purposes by the office the RBD serves as a database for statistical surveys of the Agency.
On the basis of the data of the RBD, the Agency may include:

a. perform statistical operations in the field of construction and housing; b. pull samples for surveys in all areas of statistics; c. make extrapolations partial statistical investigations.

The office may also complete statistical information using the data of the RBD, in accordance with art. 4 RSA.

Art. 11 communication of data for statistical purposes, research and planning in order for statistical services and federal government research centres as well as cantonal and municipal statistical offices to carry out statistical work, the office may communicate, in accordance with art. 19 LSF, the data stored in the RBD, with the exception of the auxiliary characters referred to in art. 5, al. 3, let. a and c, of this order, or allow access to these data online.
The office may communicate the data saved in the RBD, with the exception of the auxiliary characters referred to in art. 5, al. 3, let. a and c, to other public services of the Confederation, the cantons and municipalities as well as to individuals for statistical, research and planning, in accordance with art. 19 LSF.
At the end of their work, users are required to restore the data at their disposal in accordance with para. 2 or confirm in writing the destruction to the office.

Art. 12 communication of data for the performance of tasks assigned by law the Agency can help utilities of the cantons and municipalities to carry out the tasks assigned the law by providing the data of the RBD that relate to their territory, with the exception of auxiliary characters referred to in art. 5, al. 3, let. a and c, or allowing them to have access to these data online.
The character building and housing of the E type according to annex can be used to hold records of the inhabitants of the cantons or communes.
Authorized utilities to use the data in the registry take organizational and technical measures specific to ensure that: a. these data will be used to perform the tasks assigned by the law recognised as such; (b) these data will be made accessible to third parties or directly, or on paper, or on data media; c. the General data protection requirements will be met.

The use of the data is governed moreover by the critical provisions of the cantons and communes.

Art. 13 communication of the data to other purposes the office may communicate data on character building and housing utilities of the Confederation, cantons and municipalities as well as to individuals, to harmonize and coordinate records following: a. building number attributed by the office (EGID); b. the town attributed by the office number and name of the municipality; c. address of the building , postcode and included place; d. slot number attributed by the office (EWID); e. floor; f. location of housing (physical number and other indications); g. number of housing the canton or commune; h. number of pieces of the housing.

With the agreement of the cantonal offices or municipal cadastral measurements and the provisions issued by them, the office may communicate data on the following building characters to the public services of the Confederation, cantons and municipalities as well as to individuals, other than those mentioned in art. 11 and 12: a. number of the land (parcel number); b. point of reference of the building (the coordinates of the building).

The only selection criteria allowed for the communication of data on buildings within the meaning of the al. 1 and 2 are the characters referred to in para. 1 and the category of building (housing / without residential tenancies).
The use and disclosure of the other registry data for other purposes than those referred to in art. 11 and 12, including trade addresses or other commercial activities, are prohibited.

Art. 14 communication of schedules and directories the office may communicate, on paper or on data medium, schedules and directories used in the RBD to public services of the Confederation, the cantons and municipalities as well as to individuals.

Art. 15 utilities with access to the data of the RBD in accordance with art. 11, al. 1, the following public services may, for statistical purposes, research and planning, be connected to the RBD and access data to the conditions defined in Annex: a. the Federal charge of the law of the land register and land law: type B; (b) the federal Office of topography: type Bc. the federal Office for territorial development: type A; d. the federal Office of housing : type A; e. the federal Office of energy: type A; f. the federal Office for the environment: type A; g. the federal Office for agriculture: type A; h. the federal Office of food safety and Veterinary Affairs: type A.

In accordance with art. 12, al. 1, the following public services can, to perform tasks that assigned the law, be connected to the RBD and access data to the conditions defined in Annex: a. the cantonal and municipal statistical offices: type F; b. cantonal and municipal offices of the buildings and landscaping: type F; c. cantonal and communal residents control offices : type E; d. offices and municipal of cadastral surveying as well as the competent services for the update mandated by Commons: type C; e. cantonal and municipal land registry offices: type C; f. offices and municipal cadastral estimation: type D; g. cantonal and municipal environmental protection offices : type D; h. cantonal and communal agriculture offices: type D; i. cantonal property insurance: type D.

The scope and modalities of access to the data are determined in detail in the annex.

The name of the administrative unit has been adapted in application of art. 16 al. 3 o from 17 nov. 2004 on official publications (RS 170.512.1).

Art. 16 the office Emoluments collects a fee for the data, subject to art. 13, al. 2, based on the provisions of the order of 30 June 1993 on the emoluments for the statistical services of the federal administrative units.
The communication of data and online access to the system of the RBD are free for: a. Confederation services; b. cantonal or municipal statistical services; c. utilities, which are data for the update of the RBD; d. the other services running tasks of the Confederation; e. execution of tasks assigned by the law in accordance with art. 12. the data referred to in art. 13, al. 1, and art. 14 can be provided free of charge as long as they are used to the harmonisation and coordination of administrative registers.

Data security is governed by the provisions of the Ordinance on 14 June 1993 to the Federal data protection act and by the order of June 10, 1991, for protection applications and computer systems in the Federal Government.
