[946.206.1] order the confiscation of the frozen assets and Iraqi economic resources and their transfer to the Development Fund for Iraq from May 18, 2004 (status on 1 July 2013) the Swiss federal Council, having regard to art. 184, al. 3, of the Constitution, in fulfilment of resolutions 1483 (2003) and 1956 (2010) UN Security Council United, stop: art. 1subject this rule order: a. the confiscation of assets and economic resources that are frozen under art. 2, al. 1 by order of 7 August 1990 establishing economic measures against the Republic of Iraq; ETB. the transfer of assets and economic resources or of the proceeds of the sale of economic resources to the Development Fund for Iraq under resolution 1483 (2003) or its successor under the 1956 (2010) resolution mechanism.

RS 946.206 s. 2 confiscation procedure the federal Department of economy, formation and research (RFLDS) is allowed to confiscate, by way of decision, assets and economic resources according to art. 1. prior to the notification of the decision on confiscation it transmits to the parties in writing a draft of the decision. The parties may decide within a period of 30 days.

The designation of the administrative unit has been adapted to 1 Jan. 2013 pursuant to art. 16 al. 3 o of 17 nov. 2004 on official publications (RS 170.512.1). It was taken into account this mod. throughout the text.

S. (3) exceptions the Davis may, after consultation with the competent offices of the federal Department of Foreign Affairs and the federal Department of finance authorize exceptions to prevent cases of hardship. Applications y related are to attend the Davis within the time limit provided for in art. 2, al. 2 s. 4Recours decisions of confiscation of the Davis may be appealed to the federal administrative court.

S. 5Transfert as soon as the decision on confiscation has acquired authority of res judicata, the Davis conducts the transfer of assets and economic resources confiscated or the proceeds from the sale of economic resources confiscated to the Iraq Development Fund or its successor mechanism.

S. 6 entry into force and duration of validity this order comes into force on July 1, 2004 and has effect until June 30, 2007.
The period of validity of this order is extended until June 30, 2010.
The period of validity of this order is extended until June 30, 2013.
The period of validity of this order is extended to June 30, 2016.
