Section 1 General provisions

Art. 1 Scope of application

1 This order governs the fees collected for decisions and benefits provided by the Federal Office for Civil Aviation (OFAC) on the basis of:

A.
Swiss aviation legislation;
B.
Acts of the European Union taken up by Switzerland in accordance with the Annex to the Agreement of 21 June 1999 between the Swiss Confederation and the European Community on air transport 1 . 2

2 This order does not apply to the levying of emoluments for decisions rendered and benefits provided directly by the European Aviation Safety Agency (EASA) or on its application by the OFAC (Art. 14, para. 1, and 17). 3

3 The emoluments relating to a benefit provided abroad, at the request of the OFAC, by the foreign authority in favour of a Swiss business shall be the full responsibility of the latter.

Art. 2 Applicability of the General Order on Fees

To the extent that this order does not provide for any specific regulation, the provisions of the General Order of 8 September 2004 on emoluments (OGEmol) 1 Are applicable.


Art. 3 Scheme of emoluments

Any person making a decision by the OFAC or seeking a performance from the OFAC is required to pay a fee.

Art. 4 Exemption of emoluments

1 No emolument is levied for granting concessions or for issuing authorisations to foreign airlines, provided that the foreign state concerned gives reciprocity to the Confederation.

2 Where a third State or the United Nations takes Swiss airspace, the specific authorisation issued to them does not give rise to the perception of a fee, provided that the third State grants reciprocity.

Art. 5 Calculation of the emoluments

1 Where the provisions of this order do not provide for a lump sum, the fees shall be calculated on the basis of the time spent, if any, within the limits of a tariff framework.

2 The hourly rate ranges from 100 to 200 francs, depending on the knowledge required by the person in charge of the case.

3 In particular cases, the fee may be given or reduced given the interest and utility of the taxable person, as well as the public interest.

4 The OFAC may exempt from the services of the Confederation of any movement if they themselves are the beneficiaries of the benefit provided. 1

Art. 6 1 Supplement

A supplement of up to 50 % of the ordinary fee, but at least 100 francs, may be levied for a decision or benefit which requires extraordinary administrative work, or is provided on request or due to a fault Subject to a taxable person, either as a matter of urgency or outside normal working hours.

Art. 7 Rejection or withdrawal of application, repetition or cancellation of examination

1 If an application is rejected or withdrawn, a fee based on the time spent is collected for processing.

2 An examination fee is considered even when the examination is to be repeated in whole or in part.

3 If a review cannot take place for reasons attributable to the applicant, the resulting costs shall be borne by the applicant.

4 The emoluments and charges attributable to paras. 1 to 3 shall not in any case be greater than the lump sum or the maximum amount provided for in the tariff framework for the decisions or benefits in question.

Art. 8 Indexing

The Federal Department of the Environment, Transport, Energy and Communication (DETEC) can adapt, for the beginning of the following year, the amount of emoluments to the increase in the Swiss consumer price index when this Increase is at least 5 % since the coming into force of this order or since the last adjustment. The adjusted amounts are rounded down to 5 francs or less.

In addition to the costs referred to in s. 6 OGEmol 1 :

The costs of assessments and positions taken by the municipal, cantonal and federal bodies required in accordance with the provisions of air law;

The extraordinary costs incurred in the training of OFAC inspectors, in particular with a view to registration in the register of specific types of aircraft;
E.
Travel and transport costs in Switzerland, however only if the tax is calculated according to the time spent; the fee in this case is increased by a lump sum of 100 francs;
F.
Travel and transportation costs abroad;
G.
Fees for the use of electronic data processing and infrastructure costs;
H.
Fees for the making and furnishing of reproductions, including photocopies.

Art. 10 Quote

1 Upon request, the taxable person shall be informed of the emoluments and disbursements which he or she will likely have to pay, or obtain a written quotation.

2 It shall be in all cases informed in writing of the emoluments and disbursements which it will most likely have to pay when it solicits an expensive or very high disbursement.

3 This information is free of charge.

Art. 11 Information

1 For the written or oral communication of information that requires significant administrative work, a fee may be levied based on time spent.

2 The applicant must be informed in advance of the perception of an emolument.

Art. 12 Position Prises

1 Where a position of the OFAC is sought by a cantonal or communal authority within the framework of a procedure, a fee calculated on the basis of the time spent shall be collected. If reciprocity is granted to the Confederation, no fee is charged.

2 The applicant authority must be informed in advance of the perception of an emolument.

3 The fee is collected directly from the applicant authority.

Art. 13 Decision on emoluments

1 In principle, as soon as the benefit is provided or the decision is rendered, the OFAC fixes the fee, the disbursements and the method and the time limit for payment.

2 In the case of a benefit which requires a long period or includes several partial benefits, the OFAC may require one or more partial emoluments. If a maximum fee is provided for the benefit, the sum of the partial emoluments shall not exceed it. 1

Section 2 Aircraft and aircraft aircraft

Art. 14 Certificates of type

1 The following are perceived directly by EFSA:

A.
Emoluments relating to type examinations for the granting of type certificates, restricted type certificates or supplementary type certificates;
B.
Emoluments relating to admission of modifications and repairs;
C.
The annual fee for holders of type certificates or restricted type certificates. 1

2 The emoluments relating to type certificates, other certificates and admissions for aircraft which do not fall within the competence of EASA, calculated on the basis of time spent, are collected by the OFAC. They are included under the following tariff framework: 2

3 The fee for examinations of other aircraft or simulators, calculated on the basis of time spent, shall be at least 1000 francs and not more than 150 000 francs.

Art. 15 Airworthiness reviews

1 The emoluments relating to entry examinations, periodic or extraordinary examinations, examinations for the export of an aircraft, reproductive examinations and partial reproduction examinations, calculated on the basis of the Time, are included under the following tariff framework:

2 A supplement of up to 20 % of the maximum fee may be charged if the examination results in an extraordinary workload, particularly in view of the complexity of the aircraft systems (avionics).

3 If an examination provided for in the current technical supervision cannot be carried out or cannot be carried out for reasons primarily attributable to the operator of the aircraft, an emolument, calculated on the basis of time And reimbursement of the costs incurred may be required.

Art. 16 Service Register

1 The following fees shall be collected for registration in the service register and for the establishment of certificates:

2 Half of the fee fixed in para. 1, let. B, is collected for cancellation and for the recording of a change in ownership or operator.

3 No fee is charged in the case of an ex officio radiation of an aircraft in the service register.

4 The fee for an authorization to enter an aircraft in the service registry within the meaning of s. 3, para. 2, of the order of 14 November 1973 on aviation (OSAv) 1 Is 600 francs.

5 The operator shall pay a fee of 60 francs per aircraft or 120 francs for an entire fleet when taking back the flight papers that had been deposited at the OFAC.

6 The fee for the examination and approval of a maintenance programme, calculated on the basis of the time spent, shall be at least 90 francs and not more than 7,000 francs. 2

7 A fee is charged each year for routine surveillance of an aircraft recorded in the service registry. This annual fee, due at the beginning of the calendar year, is as follows:

8 Half of the fee fixed in para. 7 shall be collected in the case of the filing of the flight papers for a full calendar year and in the event of the cancellation of an aircraft during the first six months of the calendar year. 3

9 Half of the fee fixed in para. 7 is collected in the event of an aircraft being entered in the first six months of the calendar year. There is no fee for registration after the first six months of the calendar year. 4

Art. 17 1 Aircraft design organization and demonstration of design capability

1 The EASA directly collects the fees for the approval and supervision of an aircraft design body and the certification of design capacity by means of alternative procedures.

2 A fee based on time is charged for the recognition and routine monitoring of design agencies that design aircraft, engines, propellers and equipment that do not fit into the Competence of EASA.

Art. 18 Aircraft Production Agency

1 The fees for the approval of an aircraft production body, calculated on the basis of the time spent, shall be included under the following tariff framework: 1

Section 3 Aircraft Register

Art. Registration

1 The fee charged for the registration of an aircraft in the aircraft register depends on the maximum permissible take-off weight. It is 9 francs per 100 kg.

2 The applicable tariff framework ranges from 195 francs to 10 320 francs.

Art. Ownership Transfer

The fee charged for the registration of a transfer of property is one-half of the registration fee.

Art. Radiation

The fee charged for the cancellation of an aircraft is 20 % of the enrolment fee.

Art. 24 Constitution and increase of security rights

The fee charged to register a lien or increase the amount depends on its value. It is 2 % up to 2 million francs and 1 % for the surplus, but at least 385 francs and at most 17,200 francs.

Art. 25 Extension of security rights

For the extension of a lien to other aircraft or to a spare parts warehouse, the fee is 20 % of the fee charged for the pledging.

Art. 26 Deregistration and reduction of security rights

The fee levied for the cancellation of a lien or for a reduction in the amount of a pledge shall be 10 % of the fee charged to constitute or increase the amount of the pledge.

Art. 27 Other registrations

For any other entry in the aircraft register, a fee of up to 1200 francs is charged according to the time spent.

Art. 28 Excerpts and attestations

1 The fee levied for the preparation of a complete and legalised extract of a general ledger is 85 francs.

2 The fee charged for the establishment of a certificate of fact in the aircraft register is 50 francs.

Art. A 1 Expert examiner's authorization

1 The fee for processing an application for the grant of an examiner's authorisation or for the procedure for withdrawing such authorisation, calculated on the basis of the time spent, shall be between 100 and 5000 francs.

2 The fee for the ordinary appraisal and supervision of an examiner, calculated on the basis of the time spent, shall be between 100 and 40 000 francs per year per expert.

Art. B 1 Enterprise with its own review organization

1 The fee for examinations organised by a company having its own review organisation approved by the OFAC (Company-Examiner), collected from the company as an oversight for the organisation of examinations, calculated on the basis of the Time spent, is between 200 and 40,000 francs per year.

2 The examination fees provided for in Art. 29 are not due if the undertaking itself pays for the compensation of the experts.

Art. C 1 Aeromedical Reviewers and Aeromedical Centres

1 A fee of 5000 francs is charged for the appointment and initiation of an aeromedical examiner (Aero Medical Examiner, AME).

2 The fee for the certification and supervision of an aeromedical centre (Aero Medical Center, AeMC), calculated on the basis of time spent, is between 100 and 40,000 francs per benefit.

3 OFAC may waive all or part of the collection of the emoluments referred to in para. 1 and 2, to the extent that the appointment or initiation of an AME or the certification of an AeMC is in the interest of the OFAC or results in a reduced workload for the OFAC.

Art. 50 Screening

1 Any preliminary examination of a file relating to an aeronautical infrastructure installation that requires significant administrative work is subject to a fee based on the time spent.

2 The applicant must be informed in advance of the perception of an emolument.

Art. Monitoring

The emoluments relating to other decisions and benefits under the supervision of aeronautical infrastructure installations and any other landing terrain shall be levied on the basis of the time spent.

Section 10 Final provisions

Art. Repeal of the law in force

The order of 25 September 1989 on fees collected by the Federal Office of Civil Aviation 1 Is repealed.
