0.631.252.934.954.9 exchange of notes of 11/28 September 1989 between the Switzerland and the France regarding the creation, to Basel/St. Louis Highway, an office in national controls juxtaposed entered into force on 1 November 1989 text original Embassy of Switzerland in France Paris, Paris Embassy of Switzerland on September 28, 1989, at the Ministry of Foreign Affairs presents its compliments to the Ministry of Foreign Affairs and has the honor to acknowledge receipt of his note of 11 September 1989 regarding the creation of a Office to national controls juxtaposed in french territory in St. Louis and in Switzerland in Basel between border terminals 8 and 10, n which reads as follows: "the Ministry of Foreign Affairs presents its compliments to the Embassy of Switzerland and, referring to art." 1, by. 3, of the agreement between the France and Switzerland, September 28, 1960, for the establishment of offices to juxtaposed national controls and controls along the way, has the honour to communicate the following: the french government has taken knowledge of the administrative arrangement, signed by the Director-general of French customs and the Director general of Swiss customs , April 5 and June 6, 1989, and relative to the establishment of the office on national controls juxtaposed in french territory, St. Louis and Basel, in Switzerland.

This arrangement has the following content: art. 1-1. An office in juxtaposed national controls is created in territory french in St. Louis and in Switzerland in Basel between border terminals No. 8 and 10.

2. This Office is referred to as: has) of Saint - Louis Basel Highway Customs Office by the French administration.

(b) GZA-Basel-St.-Louis-Autobahn by the Swiss administration.

3. the french and Swiss entry and exit of people and goods controls at this office.

Art. 2-1. The area in french territory includes: has) a sector used in common by the administrations of the two States encompassing the portion of territory bounded:-by the national border of Terminal 8 to Terminal 10.

-by the fence bordering the coast north of the Customs road, since the border Terminal No. 10, up to its junction with the side is of the D Hurst Street Bridge;

-by the line drawn at the base of the side the Street Bridge of the Hurst D, since the fence north of the Customs road, extended by the side is the Hurst Street to its junction with the side North of the connecting track of the urban network in the trading platform; by the northern part of the connecting track of the urban network in the trading platform from its point of junction with the street of Dr. Hurst, extended by the limit of property (materialized by a noise barrier and a fence) up to the border Terminal No. 8;

exclusion - premises for the exclusive use of the French administration;

-technical premises;

-the building of the customs agents as well as parking of their vehicles;

(b) a sector reserved for Swiss consisting of agents:-premises located in commercial building, commercial booths, the store buildings tourism North and South, the tourist booths North and South.

2 zone situated in Swiss territory, used in common by the agents of the two States, includes the part of the Schlachthofstraße from the entrance of the parking lot called "Am Bachgraben" until the junction with the Neudorfstrasse.

Art. 3. a plan of the 12 annexes on which areas:-the area used in common is tinted green.

-excluded the sector used transit right-of-way is tinged in black;

-the premises reserved for the french agents are tinted blue;

-the premises reserved for the Swiss agents are tinted red. is an integral part of the agreement.

This plan is not published to the RO.

Art. 4. it was agreed that for the free use of weighbridges in common area, the two customs administrations agree the means of access to the corresponding technical premises, located in the respective private sectors.

Art. 5. the influence of the premises of ancillary businesses that would come to be applicable within the area would not be covered.

Art. 6-1. The Regional Directorate of customs in Mulhouse and the Direction of District 1 of the customs in Basel set agreed issues of detail, in particular the conduct of traffic after agreement with the other administrations concerned.

2. the officers on duty at the office. at adjacent national control measures agreed winning promptly, especially to ease the difficulties that may arise during inspections.

3. the terms of use and operating of real estate facilities and infrastructure are governed by the provisions of:-the Swiss arrangement to the compensation due for the use of offices of road to juxtaposed national controls on November 9, 1981.

-the Swiss complementary arrangement to the compensation due for the use of offices to juxtaposed national controls (financing road platforms) on November 10, 1981.

Art. 7. this agreement abrogates the arrangement concluded on 20 October 1972, confirmed by the exchange of diplomatic notes of April 9, 1973, on the establishment of an office in national controls juxtaposed to the border Terminal No. 9 at a place called "Am Bachgraben" and the amendment confirmed by the exchange of diplomatic notes of October 17, 1977.

Art. 8. this agreement may be terminated by each of the two Governments with a notice period of six months. The denunciation shall take effect on the first day of the month following the expiration of the notice.

If the foregoing provisions receive approval of the Swiss federal Council, this note and that the Embassy may wish to address in response to the Ministry of Foreign Affairs will be, in accordance with art. 1, by. 4, of the convention on 28 September 1960, the agreement of the two Governments on the establishment of the office on national controls of St. Louis, in french territory, and Basel, in Switzerland.

This exchange of notes replaces and repeals the exchanges of notes of April 9, 1973 and October 17, 1977, relating to the establishment of the office on national controls juxtaposed of Saint-Louis (border Terminal No. 9).

The Department proposes that it is effective the first day of the second month following the date of the response of the Embassy."

The Embassy of Switzerland informed the Department of the approval of the federal Council on the above.
In accordance with art. 1, by. 4, of the agreement on 28 September 1960 between juxtaposed the France and Switzerland for the establishment of offices to national controls and controls along the way, the note of the Ministry from September 11, 1989 and the present reply constitute the agreement of the two Governments on the arrangement of 5 April and 6 June 1989 concerning the establishment of an office to national controls juxtaposed in territory french in St. Louis and in Switzerland in Basel between terminals borders n 8 and 10.
This exchange of notes will be effective the first day of the second month following the date of this response, i.e. on 1 November 1989.
The Embassy of Switzerland takes this opportunity to renew to the Ministry of Foreign Affairs the assurance of his esteem.
