0.916.225.14 exchange of notes of 6 may 2015 between the Switzerland and the Liechtenstein relating to the authorisation of placing on the market of plant protection products containing new active substances entered into force on 1 June 2015 (status on June 1, 2015) translation Embassy of the Principality of Liechtenstein Bern, 6 may 2015 federal Department of Foreign Affairs Bern the Embassy of the Principality of Liechtenstein presents its compliments to the federal Department of Foreign Affairs and has the honor to acknowledge receipt its note of 6 may 2015, which has the following content: "the federal Department of Foreign Affairs presents its compliments to the Embassy of the Principality of Liechtenstein and has the honour to submit the following case: for the decision of the Court of justice of the European communities on 21 April 2005, made in the joint cases C-207/03 and C-252/03 and the consequences that would result for the Switzerland-Liechtenstein economic area." , the federal Council is proposing - according to the interviews conducted in this context and the experience gained on the basis of the exchange of notes of April 22, 2005, renewed on 23 May 2006, may 25, 2009 to May 21, 2012, between the Switzerland and the Liechtenstein relating to the authorisation of placing on the market of plant protection products containing new active substances - to the Government of the Principality of Liechtenstein on the basis of legislation on plant protection products applicable under the Treaty of 29 March 1923 between the Switzerland and the Principality of Liechtenstein concerning the meeting of the Principality of Liechtenstein in the Swiss customs territory (Customs Treaty), an emergency regulations relating to the authorisation of placing on the market of plant protection products containing new active substances : Permissions for placing on the market of plant protection products containing new active substances (New Chemical Entities, NCE or New Active Substances, NAS) issued by the federal Office of agriculture based on the order of Swiss of 12 May 2010 on the release of plant protection products (Ordinance on plant protection products) are not recognized automatically to the Liechtenstein.
The federal Office of agriculture immediately informs the Office of the environment of Liechtenstein on all new product plant with NCE or NAS allowed in Switzerland. The environment of the Liechtenstein Office establishes a list in which plant protection products whose authorisation for placing on the market is not recognised to the Liechtenstein are included. The list is updated regularly and published by the Office for the environment of the Liechtenstein. For phytosanitary products on this list, market authorization is recognized to the Liechtenstein after twelve months. A prior recognition or also, in exceptional cases, rear is possible.
The validity of this agreement is limited to five years from its entry into force. Before the expiry of the time limit, the contracting parties examine all the necessary changes to be made to this regulation with a view to a subsequent application. They undertake for this purpose of the negotiations in due time on the basis of this agreement.
In case the Government of the Principality of Liechtenstein accept the foregoing, this note and the note-answer of the Liechtenstein create an agreement between the two Governments, which comes into effect on 1 June 2015.
The federal Department of Foreign Affairs takes this opportunity to renew to the Embassy of the Principality of Liechtenstein the insurance of its high consideration."

The Embassy of the Principality of Liechtenstein has the honour to communicate to the federal Department of Foreign Affairs the approval by the Government of Liechtenstein from the foregoing. The note of the Department and the Embassy response form an agreement between the two Governments. It takes effect on 1 June 2015.
