142.311.23 order of FDJP on the exploitation of the housing of the Confederation in the field of asylum of November 24, 2007 (status September 29, 2015) the federal Department of justice and police (FDJP), having regard to the art. 26, al. 3, and 112 (b), para. 2, of the Act of 26 June 1998 on asylum (LAsi), having regard to art. 12, al. 2, and 18 of order 1 of August 11, 1999 on the procedure (OA 1) asylum, stop: Section 1 provisions general article Application 1Champ this order applies to registration centers, specific centres referred to in art. 26, al. 1, LAsi, the Confederation centres operating in the framework of test phases, to offshore sites managed by the Confederation, as well as the housing units in the international airports of Geneva-Cointrin and Zurich-Kloten (units of the Confederation).

S. 2 access the housing of the Confederation are exclusively reserved to asylum-seekers and people to protect. They are, in principle, not open to the public.

S. 6aProgrammes of occupation asylum-seekers and to protect persons aged 16 years or more can participate in occupation programs that give a structure to the day and thus facilitate cohabitation.
There is no right to participate in the employment programmes. In the event of scarcity of supply, seats are distributed according to the principle of rotation of the participants. No occupation program is available in the transit areas of the international airports of Geneva-Cointrin and Zurich-Kloten.
Occupation programs must meet a local or regional general interest the canton or commune, or promote a better cohabitation with the resident population. They cannot compete with the private sector.
A motivation allowance may be paid to an applicant for asylum or the protected person. People staying in a specific centre receiving the allowance of motivation in the form of benefits in kind.
The participation of the applicant for asylum or the person to protect a program of occupation cannot prevent the completion of a phase of the procedure.
SEM may grant contributions for the implementation of programmes of occupation within the limits of the maximum annual amount provided for this purpose and fixed by the budgetary.

S. 6bConvention on an occupation the SEM programme concludes with the canton or commune housing a centre, or a third party mandated, a benefits agreement which provides, inter alia: a. the concrete goal of the occupation programme and its duration; b. the content of the benefits of the canton or commune housing a centre, or of the third mandated, and their total or partial financing by the Confederation; c. the maximum number of participants; d. the amount of the possible allocation of motivation and by day or hour by participant.

The company that is responsible for the maintenance of a registration centre, a specific Centre, Confederation Centre operated under phases test or delocalized site is responsible for implementing the employment programmes agreed by the SEM. It is under the direction of the SEM.

S. 7 contacts the housing of the Confederation are equipped with telephones, at the disposal of applicants for asylum and the persons to be protected. They may also use fax machines, if this mode of communication is necessary to contact a legal counsel or a legal representative.
Lists of solicitors and legal representatives with their coordinates are available in the housing of the Confederation.
Communications from the legal advisers or legal representatives, as well as postal mail are forwarded to asylum-seekers and people to protect.

Section 2 Centres record, specific centres and offshore sites art. 8 hours centres registration and offshore sites welcome asylum-seekers and persons to protect from Monday to Friday from 0800 hours to 17 hours without interruption.
Outside the opening hours, applicants for asylum and the persons to be protected are admitted in the presence of circumstances, including when they filed their application at the border and were allowed to enter Switzerland.
The night rest period extends from 22 hours to 6 hours.

S. 9 regulation of access for third parties representatives of churches can access to registration centres and sites relocated during the hours on presentation of accreditation.
Legal counsel and legal representatives can meet with their constituents during visiting hours.

S. 10 visits asylum-seekers and people to protect may, with the agreement of staff, visits. Visitors are admitted only if they manage to make plausible the existence of links with the asylum seeker or the protected person.
Visits are allowed daily from 2 p.m. to 4: 30 pm. The SEM can change schedules for reasons of organization.
Visitors come to the lodge to their arrival and their departure and assume their identity. Security staff is empowered to search them and to seize dangerous objects, and drinks for the duration of their visit. Prohibited, are immediately handed over to the police.
Visits are allowed only in rooms provided for this purpose.

S. 11 leave after found fingerprints and taking photographs of the applicant for asylum or the person to be protected, staff may issue a written leave.
The asylum seeker or the protected person holds one such authorization may, in principle, leave the registration centre or the relocated site: a. from Monday to Friday from 9: 00 to 17: 00; b. this weekend, Friday-9: 00 to 19: 00 Sunday.

The applicant for asylum or the protected person staying in a specific centre may leave, leave the centre from Monday to Sunday from 9: 00 to 17: 00.
The provisions of this weekend also apply to holidays, from 9: 00 the day before.

S. 12 refusing the discharge exit authorisation may be refused to the applicant for asylum or the person to be protected when: a. his presence is required on that day in the context of the examination of its application or the execution of his removal; b. he or she is light (e), pursuant to art. 6 of this order, to participate in the maintenance of premises; OUC. The refusal of discharge can be matched to the prohibition from entering certain premises of the recording or the relocated site open in normal times to all of the applicants for asylum and the persons to be protected.
The refusal of discharge is not a formal decision.
If discharge is refused for more than a day or several times on, an appealable decision is made at the request of the person concerned.

S. 13 exclusion of sites and registration centres relocated asylum seekers and protect persons who, by their conduct, endanger other people in offshore locations and registration centres, disturb the peace or refuse to obey the orders of staff can be excluded centres recording and the sites relocated for a maximum of 24 hours.

S. 16 regulation of access to third-party representatives of the churches can access housing on presentation of accreditation. They announce their arrival and their departure with the coaching staff.
Contact with a legal representative are possible. The latter informs staff responsible for the framing of the date of the interview of the asylum seeker.

S. 18 entry into force and duration this order comes into force on January 1, 2008.
