the "regulation of the Parliament European and the Council concerning the establishment of Eurodac for the comparison of fingerprints for the purposes of the effective application of the Regulation (EU) no 604/2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a country national third or a stateless and related to the requests for comparison with the presented Eurodac data by the law enforcement authorities. "Member States and Europol for purposes amending and repressive Regulation (EU) no 1077/2011 on the establishment of a European Agency for the operational management of information systems on a large scale within the area of freedom, security and justice (recast)" [Eurodac Regulation] ' this regulation has been notified to the Switzerland through the mail of July 3, 2013 bearing reference Ares (2013) 2567970.
Pursuant to art. 4, by. 2 and 3, of the agreement of association and subject to the fulfilment of the Switzerland constitutional requirements, the Mission of the Switzerland to the European Union informed the Secretariat general of the European Commission that the Switzerland accepts the content of the Act annexed to the notification of the Commission, Act which is part of this note's response, and transpose it into its domestic legal order.
Pursuant to art. 4, by. 3 of the association agreement, the Switzerland shall inform without delay the general Secretariat of the European Commission of the fulfilment of its constitutional requirements.
Pursuant to art. 4, by. 5 of the association agreement, the notification of the Commission of 3 July 2013 and this response note create rights and obligations between the Switzerland and the European Union and thus constitute an agreement between the Switzerland and the European Union.
This agreement shall enter into force on the date of the notification by the Switzerland of the fulfillment of its constitutional requirements. It may be denounced the conditions set out in arts. 4 and 16 of the association agreement.
A copy of this note is sent to the general Secretariat of the Council of the European Union, Directorate D, Justice and Home Affairs, Brussels.
The Mission of the Switzerland to the European Union takes this opportunity to renew to the Secretariat of the European Commission the assurance of its highest consideration.
