122 federal law prohibiting groups 'Al-Qaeda' and 'Islamic State' and related organizations from December 12, 2014 (State on January 1, 2015) the Federal Assembly of the Swiss Confederation, the art. 54, al. 1, and 173, al. 2, of the Constitution (Cst), given the message of the federal Council of November 12, 2014, stop: art. 1 ban the following organizations and groups are prohibited: a. the group 'Al-Qaeda'; b. the 'Islamic State' group; c. groups cover, those who from the group 'Al-Qaeda' or the 'Islamic State' group and the organizations and groups whose leaders, goals and means are identical to those the group 'Al-Qaeda' or the 'Islamic State' group or who act on its agenda.
S. 2 penal provisions anyone who joins on Swiss territory to a group or organization referred to in art. 1, puts at its disposal of human or material resources, organizes actions of propaganda in its favour or in favour of its objectives, recruiting followers or encourages its activities in any other manner is punishable by a custodial sentence of not more than five years or a fine.
Anyone who commits an offence abroad is also punishable if he is arrested in Switzerland and is not extradited. Art. 7, al. 4 and 5, penal code is applicable.
The prosecution and judgment of the acts cited in paras. 1 and 2 are subject to federal jurisdiction.
RS 311.0 s. 3 confiscation of the General provisions of the penal code relating to the confiscation of assets, especially the art. 70, al. 5, and 72, are applicable.
RS 311.0 s. 4 referendum, entry into force and duration of validity this Act is declared urgent (article 165, para. 1, Cst.). It is subject to the referendum (art. 141, para. 1, let. b, Cst.).
It shall enter into force on January 1, 2015 and has effect until December 31, 2018.
