741.013.1 order of FEDRO for the Ordinance on the control of road traffic (OOCCR-FEDRO) of May 22, 2008 (State August 25, 2015) the federal roads authority (FEDRO) Office, in agreement with the Directorate General of customs, the federal Institute of metrology and the federal Office of transport, having regard to the art. 4, al. 5, 9, al. 2 and 3, 11, al. 3, 13, al. 3, 15, al. 1, 18, 24, al. 4, 26, al. 5, 44, al. 2-45, al. 3, of the Ordinance of 28 March 2007 on the control of road traffic (OCCR), stop: Chapter 1 provisions general article 1 purpose this order contains the OCCR implementing provisions.

S. 2 controls and staff evaluation competence for carrying out checks of road traffic is governed by arts. 3 and 4 OCCR.
Measuring systems intended for the official statement of material facts in the context of road traffic controls may not be set up, installed, operated and maintained only by trained personnel.
The controls and the evaluation staff must: a. have the specialized knowledge and skills relating to the type of measurement to the measurement system, the implementation of the measures as well as the evaluation of the measurements; b. be authorized by the competent authority to perform inspections and assessments.

S. 4 infringements by measurement systems any infringement found by a measurement system must be entered so that the measured values can be assigned without any doubt to a vehicle or to a specific driver.

d. in the case of measures by mobile radar within the meaning of art. 6, let. c, c. 1 ("moving radar"): 1. 7 km/h for a measured value less than or equal to 100 km/h, 2. 8 km/h for a measured value of 101 to 150 km/h, 3. 9 km/h for a measured value from 151 km/h;

e. in case of action by immobile threshold detectors such as induction, optical sensors piezometric, threshold detectors loops: 1. 5 km/h for a measured value less than or equal to 100 km/h, 2. 6 km/h for a measured value of 101 to 150 km/h, 3. 7 km/h for a measured value from 151 km/h;

f. in the event of speed by section controls: 1. 5 km/h for a measured value less than or equal to 100 km/h, 2. 6 km/h for a measured value of 101 to 150 km/h, 3. 7 km/h for a measured value from 151 km/h;

g. in case of controls by vehicle-follower with a video speedometer authorized therefor and automatic evaluation of the measurement by means of approved software: margin of safety automatic, not influenced by the controls and staff assessment, in accordance with the certificate of approval of the federal Institute of metrology; h. in case of controls by vehicle-follower, other than those defined in the let. g: values indicated in the table in annex 1, i. in the case of speed measurements by means of a vehicle-follower without calibrated system, the following safety margins: 1-15 km/h for a measured value less than or equal to 100 km/h, 2 15% for a value measured from 101 km/h, or 3. a margin set by the federal Institute of metrology in particular cases;

j. in the case of calculations of speed on the basis of a method approved measures of distance between vehicles: 1. 5 km/h for a measured value less than or equal to 100 km/h, 2. 6 km/h for a measured value of 101 to 150 km/h, 3. 7 km/h for a value measured from 151 km/h.

For records of tachographs and recorders of course as well as data recorders, should be deducted from the speed recorded: a. 10 km/h, if it is analog tachograph (art. 100, al. 1 let. b, W of 19 June 1995 concerning technical requirements for road vehicles, OETV) and end of course analog recorders; b. 6 km/h If it comes to digital tachographs (art. 100, al. 1 let. a, OETV) and recorders digital course; c. 14 km/h, whether data recorders (art. 102 OETV).

If the calculation of the speed that a surveillance system at red lights in combination with induction loop detectors not approved, should be deducted from the measured velocity: a. 5 km/h for a measured value less than or equal to 50 km/h; b. 10% for a value measured from 51 km/h.

RS 941.210.4 Section 2 analyzes blood and urine s. 22 mandate the competent authority shall assign the mandate authorizing analysis of blood and urine using for this purpose the report set out in annex 2.
The mandate of analysis to detect the presence of narcotics or drugs also contains a mandate to measure the blood alcohol level when the individual is suspected of having consumed not only narcotics or drugs, but also alcohol.
The authority shall transmit to the lab all the data and information required, including the report of any medical examination carried out in accordance with annex 3.
The laboratory shall inform without delay the principal authority if it finds discrepancies in relation to the samples and the documents received or that it is unable to fulfil the mandate.

S. 23 obligation of documentation to the laboratory shall document the results of the examinations and prepare a written analysis report or written for the principal authority expertise.

S. 24 second opinion if the competent authority ordered a second opinion analysis, it is required to report to the authorized analytical laboratory that it must carry out a second opinion.
The laboratory which conducted the first analysis will be available to the expert responsible for carrying out the second inspection the sample in question and, if need be, minutes of measurement of the corresponding series.
The expert should comment on the result of the second inspection.
If the result of the second inspection confirms that of the first analysis, the result of the first analysis is valid to see drunkenness or the influence of narcotics or drugs.

S. 25 conservation of samples and records the laboratory shall: a. maintain, for at least one year or on the order of the investigative authority until the end of the procedure, samples of blood and urine that remain after analyses, in their original container, in a freezer at a temperature below 18 degrees Celsius or less; b. maintain for at least five years all documents and records required for traceability.

The laboratory shall specify minimum retention periods in the analysis report or in expertise.
In punctual cases, the donor may claim longer retention periods.

Critical section 3 report, subsequent to the event alcohol article 26. the conduct of the control through the breath, the harvest of the urine, the findings of the supervisory authority, the recognition of the result of said control as well as the mandate of a sampling of blood and harvesting of urine, or the confirmation of the mandate (art. 13, para. 3, OCCR) must be recorded in the report referred to in annex 2.
If the controlled person submits that she consumed alcohol after the critical event, it must be questioned in detail on the nature of beverages, the quantity and the time of consumption. The possible means of proof must be in safety.
The report of medical examination according to art. 15, al. 1, OCCR is established in accordance with annex 3.

Section 4 recognition of laboratories art. 27 filing of the application the application for recognition, accompanied of a complete file, must be filed in accordance with the instructions in the FEDRO.
The request for recognition of the status of laboratory Director, Deputy Director or expert shall be filed by the laboratory or by the competent authority.

S. 28 provisional recognition of laboratories recognition as a laboratory is granted at first on an interim basis.
FEDRO issued provisional recognition for a period of one year when the application complies with the formal requirements and the laboratory passed a qualifying examination.
FEDRO may withdraw the provisional recognition if the laboratory no longer fulfils the requisite conditions.

S. 29 final recognition of the FEDRO laboratories delivers the definitive recognition when the laboratory has passed examinations organized by FEDRO and an audit during the period of provisional recognition.
If the laboratory does not fulfil these conditions but that it is about to do, FEDRO may decide to extend the provisional recognition.
FEDRO maintains a list of accredited laboratories.

S. 30 withdrawal of the recognition of laboratories the FEDRO may withdraw the final recognition, including when the laboratory: a. does not participate in a review of fitness, without justification; b. fails not a qualifying examination and does not meet later requirements within the deadlines v. refuses an audit; d. does not, within the time limits , the requirements after an audit; e. does not meet the requirements of this order or instructions from FEDRO.

S. 31 recognition of the direction of a laboratory


FEDRO recognizes as the Director of a laboratory or as alternate for the Director who possess high school comprehensive training attested by a diploma, preferably in chemistry, biochemistry or pharmacy, and solid experience in their area of specialization (blood analysis, forensic toxicology).
The application for recognition shall be accompanied by a curriculum vitae and references on the career of the person concerned.
FEDRO may authorise derogations from the requirements of para. 1. new content according to the c. of o. FEDRO from nov 7. 2011, in force since 1 Jan. 2012 (2011 5645 RO).

Section 5 Quality Assurance of laboratories art. 32 external quality control laboratories should participate in proficiency examinations regularly organized by FEDRO (external quality controls). FEDRO may appeal to experts for this purpose.
The results of examinations are confidential. They are sent to all participating laboratories. The anonymity of the laboratories is preserved.

S. 33 audits laboratories must submit to audits regularly conducted by FEDRO.
Each laboratory is the subject of an audit at least every five years. In the case of evidence of irregularities, an audit can be performed at any time.
Laboratories must provide audits one officials free access premises, devices, folders and logs and provide them with information about methods, equipment and internal measures taken to ensure quality.
If a laboratory is accredited by the Swiss accreditation service provided for in art. 5 of 17 June 1996 on the accreditation and designation order, it did not carry out the audits within the meaning of para. 1. the laboratory shall however file after each audit checklist comply with instructions from FEDRO. Audits conducted by FEDRO if evidence of irregularities remain reserved.

A certificate proving that the control has been completed (proof of control) may be given in place of an inspection report. It must contain at least the information requested in points 1 to 5, 9 and 13 of the inspection report (annex 4) and possible disputes.

S. 36 control of dangerous goods: report of inspection and Certification Checklist filled (inspection report) referred to in art. 26, al. 3, OCCR is governed by instructions of Schedule 5.
The control attestation must contain at least the information requested in points 1 to 5, 7 and 40 of the inspection report (annex 5) and possible disputes.

Chapter 8 Communications of the cantons art. 37 transmittal of communications to the FEDRO cantons shall transmit to the data bank centrally FEDRO (art. 47, al. 1 OCCR): a. the communications referred to in art. 44, al. 1, let. a to c and e, OCCR from here to January 31 of the following year; b. the communications referred to art 44, al. 1, let. d, OCCR from here to June 30 of the following year.

Are reserved time limits which do not conform to the al. 1 and which are based on an agreement on benefits with FEDRO.

S. 38 form of communications addressed to the federal Office of transport in the event of infringement of the provisions concerning the carriage of passengers and the licence for transport companies, communications must be submitted using the form made available by the federal Office of transport. In other cases, should furnish to that office a copy of the termination report to the investigative authority.

Chapter 9Dispositions final s. transient 38aDisposition of the change of November 7, 2011 breath which can be placed on the market according to the old law until December 31, 2012, in accordance with the OIAA shall comply with the requirements of art. 17, al. 2 and 3, of the old law.
