Protocol

For the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, supplementary to the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done in Montreal on 23 September 1971

The States Parties to this Protocol,

Whereas unlawful acts of violence which compromise or are likely to endanger the safety of persons in airports serving international civil aviation or which endanger the safety of the operation of those Airports, undermine the confidence of the people of the world in the security of these airports and disrupt the safety and proper functioning of civil aviation for all states,

Whereas such acts are of grave concern to the international community and, with the aim of preventing such acts, there is an urgent need to provide for appropriate measures for the punishment of their perpetrators,

Whereas it is necessary to adopt additional provisions to those of the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on 23 September 1971 2 With a view to dealing with such unlawful acts of violence at airports serving international civil aviation,

Agreed to the following provisions:

Art. I

This Protocol supplements the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on 23 September 1971 (hereinafter referred to as "the Convention"), and, between the Parties to this Protocol, the Convention and protocol will be considered and interpreted as a single instrument.

Art. IV

This Protocol shall be open on 24 February 1988 in Montreal for the signature of the States participating in the International Conference on Air Law, held in Montréal from 9 to 24 February 1988. After 1 Er March 1988, it will be open for signature by all states in London, Moscow, Washington and Montreal until its entry into force in accordance with Article VI.

Art. V

This Protocol shall be subject to ratification by the signatory States.

2. Any State which is not a Contracting State to the Convention may ratify this Protocol if at the same time it ratifies the Convention, or accedes to the Convention, in accordance with Article 15 thereof.

3. Instruments of ratification shall be deposited with the Governments of the United States of America, the United Kingdom of Great Britain and Northern Ireland and the Union of Soviet Socialist Republics, or of the Civil Aviation Organization Which are hereby designated as depositary.

Art. VI

1. When this Protocol has brought the ratifications of ten signatory States together, it shall enter into force between those States on the thirtieth day after the deposit of the tenth instrument of ratification. In respect of each State which subsequently ratifies it, it shall enter into force on the thirtieth day after the deposit of its instrument of ratification.

2. Upon entry into force, this Protocol shall be registered by the depositary in accordance with the provisions of Article 102 of the Charter of the United Nations 1 And article 83 of the Convention on the International Civil Aviation (Chicago, 1944) 2


Art. VII

1. After its entry into force, this Protocol shall be open for accession by any non-signatory State.

(2) Any State which is not a Contracting State to the Convention may accede to this Protocol if at the same time it ratifies the Convention, or accedes to the Convention, in accordance with Article 15 thereof.

The instruments of accession shall be deposited with the depositaries and the accession shall have effect on the thirtieth day after that deposit.

Art. VIII

1. Any Party to this Protocol may denounce it by means of a written notification addressed to the depositaries.

2. The denunciation shall have effect six months after the date on which the notification has been received by the depositary.

3. The denunciation of this Protocol shall not have the effect of a denunciation of the Convention itself.

The denunciation of the Convention by a Contracting State to the Convention supplemented by this Protocol shall also have the effect of denunciation of this Protocol.

Art. IX

Custodians shall promptly inform all States which have signed or acceded to this Protocol, as well as all States which have signed or acceded to the Convention:

(a)
The date of each signature and the date of the deposit of each instrument of ratification of or accession to this Protocol;
(b)
The receipt of any notification of denunciation of this Protocol and of the date of such receipt.

Custodians shall also notify the States referred to in paragraph 1 Er The date on which this Protocol entered into force in accordance with Article VI.

In witness whereof, The undersigned Plenipotentiaries, duly authorised, have signed this Protocol.

Done at Montréal, the twenty-fourth day of February of the year thousand nine hundred eighty-eight, in four originals, each in four authentic texts written in the French, English, Spanish and Russian languages.
