235.22 Ordinance administration in network of the Swiss abroad (O-VERA) of 7 June 2004 (status February 1, 2012) the federal Council Swiss, view of art. 6 of the Federal law of March 24, 2000, on the treatment of the personal data to the federal Department of Foreign Affairs, stop: Section 1 provisions general art. 1 purpose this order regulates the exploitation and utilization of information system VERA (Government network of the Swiss abroad) of the federal Department of Foreign Affairs (Department); This system is operated by the management resources and the external network, consular duties, for Swiss abroad (performances) performances.
Are dealt with in the VERA data system: a. the Swiss abroad, their spouses and their children; b. the Swiss staying temporarily abroad, their spouses and their children, for the protection of Swiss private interests; c. people and their loved ones for which the Switzerland served as protection or for which it provides protection of foreign interests; d. foreign nationals who have joined pension insurance survivors and disability optional in accordance with art. 2 of the Federal Act of 20 December 1946 on old-age insurance and survivors (LAVS) and art. 3 of the order of 26 May 1961 concerning the insurance old-age, survivors and disability optional (OAF).

RS 831.10 RS 831.111 art. 2 purpose and content of the information system the VERA system is used to carry out consular tasks performances as part of the strengthening of the links between the Swiss abroad among themselves and with the homeland. Representations are responsible, in particular, of tasks in connection with: a. held the role of registration; b. the fulfilment of military obligations devolving on the Swiss abroad; c. support for the Swiss abroad; (d) the exercise of the political rights of Swiss from abroad; (e) the provision of assistance to the Swiss private freedom abroad; f. the issuance of documents of identity for the Swiss abroad; g. the update of the register of the State civilian.

It is used also basic to the collection of personal data in connection with the tasks the representations have to pay under the AVS / HAVE optional according to art. 2 LAVS and art. 3, al. 1, let. b, OFA.

RS 831.10 RS 831.111 Section 2 data and data art. 3 personal data are processed in the VERA the following personal data: a. name; b. names; c. names and surnames of parents; d. sex; e. date and place of birth; f. vital g. City cantonal and municipal rights; h. civil rights; i. date of naturalization; j. registration to the directory of reports; k. profession; l. data address and means of communication (phone (, fax, e-mail address); Mr. data relating to the passport and identity card for identification having been established prior to January 1, 2003; n. data concerning the right to vote; o. data concerning civil status, p. language q. data relating to the arrival and departure; r. data concerning the obligation for members to advertise (date of the leave abroad, address of the employer for the border, military record); s. deposits; t. data concerning social assistance; u. indications on membership in the cooperative society "Fund of solidarity of the Swiss abroad" (Soliswiss), in the case of written consent of the person registered; v. number of insured within the meaning of art. 50 c of the Federal Act of 20 December 1946 on old-age insurance and survivors (AHV insurance number).

Are addressed, with a view to the fulfilment of the tasks related to the optional AVS, the following personal data: a. name; b. names; c. names and surnames of parents; d. sex; (e) date and place of birth; f. marital status; (g) place of origin; h. nationalities; i. data concerning the address and means of communication (telephone, fax, e-mail address); j. data concerning civil status; k. language; l. data on arrival and departure.

RS 831.10 art. current 3aSaisie of the insurance number AVS if Swiss nationals but does not yet have insurance number are saved in VERA, the service responsible for the register VERA request to the central clearing of old-age insurance and survivors (CdC) communication of the AVS of these people insurance number. The procedure is governed by art. 134 of the rules of 31 October 1947 on old-age insurance and survivors.

SR 831.101 art. 4 treatment of personal data representations shall collect and process data relating to the persons referred to in art. 1 art. 5 communication personal data, other than those referred to in art. 3, al. 1, let. j and t, are provided by appeal, as a right to reading, to the following services so that they can fulfil their legal tasks: a. political leadership, Division VI, of the Swiss Service from abroad and Consular Protection; (b) the Secretariat-general, financial and consular Inspectorate; c. management of resources and the outside network, consular duties and personnel Administration Backoffice Pass.

The personal data referred to in art. 3, al. 2, are put at the disposal of the Swiss Fund for compensation per call in a server operated separately from the VERA system by the management of resources and the external network, consular duties.
In any case, personal data may be disclosed to authorities if they needed to carry out the legal tasks.

Art. 5aTransmission of data annex lists electronic systems with an interface with VERA, enumerates the data transferred from VERA in the other system and specify the frequency of such transfers.

Art. 6 data access access to the data of the VERA system is granted to authorized services and their collaborators, to the extent where they need to perform their legal duties.
Management of resources and external network of the Department, consular duties, controls each year if the conditions for access are fulfilled.

Section 3 Protection and security of data art. 7 right to access any person whose data are entered into the VERA system under art. 1 may, in writing and in proving his identity, ask management resources and outdoor network, consular tasks, information on the data.
The information is provided in writing and free of charge.
The communication of the information requested may be refused, limited or delayed, according to art. 9 of the Federal Act of 19 June 1992 on data protection.

RS 235.1 art. 8 right to rectify any person may request that incorrect data be corrected.

Art. 9 duties of diligence representations ensure that personal data are treated according to the requirements.
They ensure that the personal data that they enter into the VERA system or they communicate is accurate, complete and updated.

Art. 10 data security management of resources and the external network, consular duties, shall draw up regulations of treatment which defines organizational, technical and security requirements and contains the necessary provisions on the control of the processing of the data. It takes technical and organizational measures required in accordance with the provisions on the protection of data.
Any data processing must be protected through profiles of individual users and passwords. The data is encrypted before it is sent.

Art. 11 logging changes made to the VERA system are logged continuously. Minutes of logging are kept for three years.

Art. 12 monitoring and coordination management of resources and the external network, consular duties, supervises on the treatment of personal data in the VERA system within the meaning of this order and directives arising therefrom.
It coordinates its activities with other authorities participating in the VERA system.
It ensures respect for privacy and data security.

Section 4 Conservation, archiving and destruction of data art. 13 shelf life and destruction of the data are destroyed after five years: a. data on people having to registration status 'departure', insofar as they have not re-registered in the meantime; b. data relating to persons for registration status "death."

Reserved remains art. 12 instructions from September 28, 1999, concerning the obligation to offer and the transfer of documents to the Federal Archives, in connection with the holding of parallel archives.

Art. 14 check-in before you destroy the data, management of resources and the external network, consular duties, offers them to the Federal Archives.

Section 5Dispositions final art. 14a transitional provisions respecting the amendment of November 21, 2007 the number of insured AVS of the people already registered in VERA at the time of the first global allocation and communication of the AHV insurance number is entered. The procedure is governed by art. 133 and 134 of the rules of 31 October 1947 on old-age insurance and survivors.
