0.191.012 original text Protocol of signature optional to the Vienna Convention on diplomatic relations concerning acquisition of nationality concluded at Vienna on 18 April 1961, approved by the Federal Assembly on 23 March 1990, Instrument of accession deposited by the Switzerland on June 12, 1992, entered into force for the Switzerland on 12 July 1992 (State on May 26, 2009) the States parties to the present Protocol and the Vienna Convention on the diplomatic relations hereinafter referred to as "the Convention", which was adopted by the United Nations Conference held in Vienna from March 2 to April 14, 1961, expressing their desire to establish between them standards related to the acquisition of nationality by members of their diplomatic missions and members of the families forming part of their household, have agreed to the following provisions : Art. I for the purposes of this Protocol, the term "members of the mission" has the meaning given to it in the al. (b) of article 1 of the Convention, i.e. that it means "of the head of mission and the members of the staff of the mission.

Art. II the members of the mission who do not have the nationality of the receiving State, and members of their families forming part of their household do not acquire the nationality of that State by operation of law.

Art. III the present Protocol will be open for signature by all States which become Parties to the Convention, in the following way: until October 31, 1961, to the federal Ministry of Foreign Affairs of Austria, and then, until March 31, 1962, at the headquarters of the Organization of the United Nations in New York.

Art. IV this Protocol will be ratified. The instruments of ratification shall be deposited with the Secretary-General of the United Nations.

Art. V this Protocol will remain open to accession by all States which become Parties to the Convention. The instruments of accession shall be deposited with the Secretary-General of the United Nations.

Art. VI 1. This Protocol shall enter into force the same day as the Convention, or if the second date is further away, the thirtieth day following the date of deposit of the second instrument of ratification of the Protocol or of accession to this Protocol with the Secretary-General of the Organization of the United Nations.
2. for each State which ratifies this Protocol or adhere it after its entry into force in accordance with the by. 1 of this article, the Protocol will take effect on the thirtieth day after the deposit by that State of its instrument of ratification or accession.

Art. VII. the Secretary-General of the Organization of the United Nations shall notify all the States which may become Parties to the Convention: a) signatures affixed to this Protocol and the deposit of the instruments of ratification or accession, in accordance with the art. III, IV and V, b) the date on which this Protocol comes into force, in accordance with art. VI. art. VIII scope of application on May 26, 2009 statements the original of this Protocol, of which the English, Chinese, Spanish, french and Russian texts are equally authentic, shall be deposited with the Secretary-General of the Organization of the United Nations, which to send certified copies to all the States referred to in art. III. in faith whereof the undersigned plenipotentiaries, duly authorized by their respective Governments, have signed this Protocol.

The Convention does not apply to the Tokelau Islands.

Netherlands the Kingdom of the Netherlands performer statements the words "do not acquire the nationality of that State by operation of law", contained in article he of the Protocol, as meaning that the acquisition of citizenship by descent is not assimilated to the acquisition of nationality by operation of the law of the receiving State.
The Protocol applies to the Kingdom in Europe, the Netherlands Antilles, and from 1 January 1986, Aruba.
