861 federal law on financial support for childcare for children of 4 October 2002 (State February 1, 2015) the Federal Assembly of the Swiss Confederation, view of art. 116, al. 1, of the Constitution, saw the report of the Committee on social security and public health of the national Council on 22 February 2002, seen the advice of the federal Council of 27 March 2002, stop: Section 1 principles art. 1 the Confederation grants, within the limits of appropriations, of financial support for the creation of day-care places for children to help parents better balance family and work or training.
Federal financial aid is provided only if the cantons, local authorities of public law, employers or other third parties provide appropriate financial participation.

Section 2 aid financial art. 2 beneficiaries the financial aid may be allocated: a. to collective childcare of day; b. the after-school childcare for children up to the end of compulsory schooling; c. structures coordinating the family day care; d. physical persons, the cantons, Commons and other legal persons for innovative projects in the field of childcare for pre-school children.

Financial aid are intended primarily for new structures. They can be allocated also to existing structures which increase their offer in a meaningful way.

Art. 3 conditions financial aid may be granted to childcare collective day and home after school under the following conditions: a. they are managed by individuals, cantons, municipalities or other persons; b. funding appears assured long term, for a period of six years at least; c. they meet the cantonal quality requirements.

Financial aid may be granted to structures coordinating the family day care, if the conditions in the al. 1, let. a, are met. Financial aid must be assigned: a. either to the coordination and the professionalization of family day care; b. is the promotion of training for the parents of day.

Financial assistance to innovative projects may be granted under the following conditions: a. the project model for the development of childcare for pre-school children and contributes to the creation of places; b. the project has financial support cantons or communes where it will be made; c. the cantons or the communes that are applying for financial aid or support financially the project carried out by a third party provide a total financial participation in childcare for pre-school children at least as high as during the calendar year preceding the beginning of the project.

Art. 4 ways to provision the Federal Assembly vote in the form of a multi-year commitment credit the means necessary for the financing of financial aid.
The staff and the expenses necessary for the implementation of this Act are funded by the means provided in para. 1. 15% of the means made available by the credit commitment are allocated to innovative projects.
If the requested aid exceed the resources available, the federal Department of the Interior enacts prioritize striving to spread them evenly between the regions.

Art. 5Calcul and duration of financial aid financial aid allocated to the collective childcare of day and after-school home cover a third to as much of investment and operating costs. They may not exceed 5000 francs per place per year.
Financial aid allocated to the structures coordinating the family day care cover a third at most of the costs associated with the measure referred to in art. 3, al. 2, let. a or b.
Financial assistance to innovative projects cover a third at most of the costs of the project, including costs related to its evaluation.
The financial aid is granted for three years at the most.

Section 3 Procedure art. 6Demandes of financial aid financial aid applications should be directed to the federal Office of social insurance (OFAS).
Collective childcare of day and after-school home must apply before the opening of the structure or the increase in supply.
The structures coordinating family day care must file their application before the start of the implementation of the measures.
Individuals, the cantons, municipalities and other legal persons must apply before the start of the project to be innovative.

Art. 7Octroi of financial aid the FSIO statue by way of decision on the applications by the structures of collective day-care, after-school childcare facilities and structures coordinating the family day care; He consults in advance the competent cantonal authority.
The FSIO allocates financial assistance to projects in innovative character based on contracts. For projects managed by an individual, a municipality or another legal person, he consults in advance the competent cantonal authority.

Section 4 Evaluation art. 8. the effects of this Act are being a regular assessment.

Section 5 provisions final art. 9 execution the federal Council enacts implementing provisions after hearing the competent specialized organizations.

Art. 10 referendum, validity period and entry into force of this Act is subject to the referendum.
Validity period is eight years.
The federal Council shall determine the date of entry into force.
The validity of this Act is extended for the last time until January 31, 2015.
As an exception to the al. 4, this Act is extended to January 31, 2019.
