Agreement

Between the Swiss Confederation and the European Community amending the Agreement between the Swiss Confederation and the European Economic Community of 22 July 1972 concerning the provisions applicable to processed agricultural products

The C Swiss onfederation ,

Hereinafter referred to as "Switzerland" on the one hand,

And the C European Community ,

Hereinafter referred to as 'the Community', on the other hand,

Hereinafter referred to as "the Contracting Parties",

Having regard to the Agreement between the European Economic Community and the Swiss Confederation of 22 July 1972 2 And the joint declaration on the continuation of the negotiations annexed to the final acts of the agreements between the European Communities and their Member States and the Swiss Confederation 3 , signed in Luxembourg on 21 June 1999,

Whereas Protocol n O 2 4 The Agreement between the European Economic Community and the Swiss Confederation of 22 July 1972-hereinafter referred to as 'the Agreement' - should be updated in accordance with the results of the Uruguay Round negotiations and adapted for Covers product coverage,

Whereas trade flows between Switzerland and the new Member States should be maintained after the enlargement of the European Union,

Wishing to improve reciprocal access to markets for processed agricultural products,

Having regard to the Agreement in the form of an exchange of letters between the European Community, of the one part, and the Swiss Confederation, of the other part, concerning Protocol No O 2 of the Agreement between the European Economic Community and the Swiss Confederation of 17 March 2000 5 ,

Agreed to the following: :

Art. 1

The Agreement is amended as follows:

1.
Annex I to the Agreement is replaced by the new Annex I, which is attached to this Agreement as Annex 1.
2.
Protocol n O 2 of the agreement is replaced by the new protocol n O 2, which is annexed to this Agreement as Annex 2.
Art. 2

The following agreements shall be repealed with effect from the entry into force of this Agreement:

-
Agreement in the form of an exchange of letters between the European Community, of the one part, and the Swiss Confederation, of the other part, concerning Protocol n O 2 of the Agreement between the European Economic Community and the Swiss Confederation of 17 March 2000 1 ;
-
Exchange of letters from the European Commission and the Swiss Federal Administration concerning provisions to improve transparency in the various price compensation measures applied by the European Community and Switzerland Which affect trade in processed agricultural products covered by Protocol n O 2, 29 November 1988 2 .

Art. 3

Annexes to this Agreement, including tables and Appendices to the Tables and Appendix to Protocol No. O 2, are an integral part of this.

Art. 4

(1) This Agreement shall apply, on the one hand, to the territories in which the Treaty establishing the European Community is applicable and under the conditions laid down by that Treaty and, on the other hand, to the territory of Switzerland.

2. This Agreement shall also apply to the territory of the Principality of Liechtenstein as long as the customs union with Switzerland 1 Is maintained.


Art. 5

This Agreement shall be approved by the Contracting Parties in accordance with their own procedures. It shall enter into force on the day following the day on which the Contracting Parties have notified the completion of their internal procedures necessary for that purpose.

2. Pending completion of the ratification procedures referred to in par. 1, the Contracting Parties shall apply this Agreement as from the first day of the fourth month following the date of signature, provided that the implementing measures referred to in Art. 5, para. 4, of protocol n O 2 are adopted on the same date.

Art. 6

This Agreement shall be drawn up in duplicate in the English, Danish, Danish, Spanish, Estonian, Finnish, French, Greek, Hungarian, Italian, Latvian, Lithuanian, Dutch, Polish, Portuguese, Slovak, Slovenian and Swedish languages. And Czech, each of these texts being equally authentic.

2. The Maltese version of this Agreement shall be authenticated by the Contracting Parties on the basis of an exchange of letters. It shall also be authentic, on the same basis as the languages referred to in subs. 1.

In witness whereof, The Plenipotentiaries have signed at the bottom of this Agreement.
