0.362.33 translation agreement between the Swiss Confederation and the Kingdom of Denmark on the implementation, application and development of parts of the Schengen acquis based on the provisions of title IV of the Treaty establishing the Community European concluded 28 April 2005 entered into force by Exchange of notes March 1, 2008 (status March 1, 2008) the Swiss Confederation and the Kingdom of the Denmark hereinafter referred to as "the Contracting Parties", considering that the European Union, the European Community and the Confederation of Switzerland signed an agreement on the association of the Swiss Confederation to the implementation, application and development of the Schengen acquis;
whereas in accordance with the Protocol on the position of the Denmark annexed by the Treaty of Amsterdam to the Treaty on European Union and to the Treaty establishing the European Community, no provision in an international agreement concluded by the Community pursuant to title IV of the Treaty establishing the European Community bind the Denmark or is applicable in respect, and that the decisions of the Denmark to transpose into its national law of decisions expanding Schengen acquis under the provisions of Title IV of the Treaty establishing the European Community do not create obligations of international law between the Denmark and the other Member States of the EU, but not between the Denmark and third States;
Whereas it is desirable that between the Switzerland and the Denmark, the same rights and obligations apply in the areas covered by the acquis Schengen, that between the Switzerland and the other Member States of the EU Treaty mentioned above, as well as between the Denmark and the other Member States of the EU, under implementation by Denmark of provisions of the Schengen acquis under Title IV of the Treaty establishing the European , have agreed upon the following provisions: art. 1. the rights and obligations of the Kingdom of Denmark from the implementation in national law of the provisions of the Schengen acquis and of its developments based on one of the provisions of title IV of the Treaty establishing the European, and the rights and obligations of the Swiss Confederation resulting from its acceptance of the content of the provisions of the Schengen acquis and its developments under the agreement of October 26, 2004, between the Union of European, the European Community and the Swiss Confederation on the association of the Swiss Confederation to the implementation, application and development of the Schengen acquis, apply in relations between the Kingdom of the Denmark and Switzerland insofar as these States are bound by the same rights and obligations.

S. 2. this Agreement shall cease to apply the day where the rights and obligations of the Kingdom of the Denmark or the Swiss Confederation to which refers art. 1 shall cease to apply.

S. 3 1. This agreement is ratified or approved by the Contracting Parties according to their own procedures. He entered into force the first day of the second month following the date of the last notification expressing the consent of the Contracting Parties to be bound by the agreement.
2. the present agreement is implemented the day where the agreement between the European Union, the European Community and the Switzerland Confederation on the association of the Swiss Confederation to the implementation, application and development of the Schengen acquis is implemented.
