Introductory provisions



Article 1 this regulation lays down provisions on State aid for vocational training at upper secondary level in municipal adult education and special education for adults that are planned and conducted in cooperation between several municipalities with the participation of the working life of the interlocking municipalities and as a aims to lead to the skills that are in demand on the labour market (regional vocational).



The regulation also contains provisions on State aid for introductory courses and courses in Swedish, Swedish as a second language, English, mathematics and social studies in municipal adult education at secondary level, combined with regional vocational. The regulation also contains provisions on State aid for apprenticeships in regional vocational.



The regulation is notified pursuant to Chapter 8. section 11 of the Constitution and, in the case of section 40 of Chapter 8. section 7 of the Constitution in respect of the other provisions.

Conditions for State aid



section 3 of the Government subsidies may be provided to cooperative regional municipalities for vocational, introductory courses and courses in the subjects of Swedish, Swedish as a second language, English, math, or social studies in municipal adult education on the secondary level if the terms of 4-10 and 17-23 sections are met. In the case of apprenticeship shall also the conditions in paragraphs 11 and 16.



Regional vocational training



Cohesive vet



4 section in the regional vocational, the interlocking municipalities offer combinations of national courses in vocational subjects relevant to a professional field (unified vocational education).



§ 5 the context of learning should occur in all mainstream vocational training within regional vocational.

The scope shall for each student must be at least 15% of the mainstream professional training or of the part of the training which has not been validated. The extent to which the context of learning should have at an apprenticeship in regional vocational is clear from section 11.



Of the Regulation (2011:1108) on adult education, there are additional provisions on the context of learning, namely



– Chapter 2. section 26 on the definition of the context of learning,



– Chapter 2. section 27 of the principal's responsibility for acquiring sites and for learning meets the requirements for training,



– Chapter 2. section 27 if decisions about which courses will be located at a place of work,



– Chapter 2. section 28 of the supervisor in the workplace, and



— Chapter 4. 20 a section on what information is to be found in a high school special certificate.



Individual courses in vocational subjects



section 6 of The collaborating municipalities in the regional vocational offer individual courses in vocational subjects according to students ' needs.

Other courses



section 7 of the regional Vocational Training should be organized in so students when necessary to combine education with other education in municipal adult education and special education for adults.



Native support and study guide in the mother tongue



paragraph 8 of the Introductory courses as a aims to provide native support or study guide on mother tongue should be offered to students who need it.



Decisions about grades and grading



section 9 provisions on decisions about grades and grading, see Chapter 3. section 16, Chapter 20. paragraphs 35 to 39 and 21 Cape. 18-20 (b) of the Education Act (2010:800) and Chapter 4. 1 – 10 of the Regulation (2011:1108) on adult learning. In addition, regional vocational to score on a course which is wholly or partly carried out at a workplace shall be decided by the teacher in a vocational subject after obtaining feedback from the supervisor.



Selection



section 10 provisions on selection in Chapter 3. section 7 of the Ordinance (2011:1108) on adult education shall not apply in the case of the municipal adult education at secondary level as government subsidies provided for under this regulation. If all eligible applicants cannot be received to the training, instead, preference is given to those who have short previous education and a weak position on the labour market.



Prerequisites for apprenticeship



Purpose and scope



11 § Cohesive regional vocational training may be provided in the form of apprenticeship. Apprenticeship in regional vocational shall aim to give students a basic vocational training, increased work experience and an opportunity for a supervisor's leadership in the workplace get knowledge in a professional field.



An apprenticeship in municipal adult education, 1. at least 400 and not more than 1 600 high school credits in vocational subjects, and 2. at least 70% implemented in the workplace.



An apprenticeship within specific training for adults, 1. at least 400 and not more than 1 600 secondary special education credits in vocational subjects, and 2. for the most part implemented in the workplace.



Commitments section 12 At an apprenticeship in regional vocational to the collaborating municipalities ensure that by agreement with the relevant workplaces regulate municipal and workplace commitments in connection with the arbetsplatsförlagda learning.



Training contract, section 13, the principal shall ensure that, for each pupil undergoing an apprenticeship in regional vocational established a written agreement that is signed by the municipality that is responsible for the education of the student and of representatives of the workplace where any part of the course will be located (educational contract). In the training contract shall specify 1. which parts of the training to be carried out at the place of work and scope of these, and



2. What is the teacher in the training and the workplace supervisor is responsible for the arbetsplatsförlagda part of the training.



Data in an individual study plan



paragraph 14 of the statement that a pupil undergoing an apprenticeship in regional vocational shall be recorded in the student's individual study plan.



Task in a diploma or high school special certificate



15 § in a student's diploma from the municipal adult education or a secondary special evidence from specific training of adults should be indicated if the student has completed an apprenticeship and the extent of it.



About the arbetsplatsförlagda part is interrupted



section 16 if a student cancels the arbetsplatsförlagda part of the apprenticeship, the principal issue a certificate if the student requests. the certificate shall contain 1. how much of the education that the student has undergone, and 2. the content of the completed portion of the training.



Professional boards were



section 17 of regional vocational, there shall be one or more


vocational boards for consultation between representatives of the education and working life. A vocational boards may be common to several courses. It may also be shared with the corresponding function in upper secondary general school.



section 18 of the Professional Council shall help to develop synergies between education and working life and contribute to learning in working life with high quality. Professional Council shall assist municipalities with highlighting the needs of working life and to arrange places for the context of learning in education.

Professional Council shall also participate in the monitoring and evaluation of the arbetsplatsförlagda part of the training.



Annex to the excerpt from examination directory



section 19 of the regulations on excerpts from the rate and if an annex to the statement of the person who has undergone a coherent training can be found in Chapter 4. section 12 of the Regulation (2011:1108) on adult learning. Of such annex shall also state whether training has been implemented as an apprenticeship.



Additional terms and conditions



section 20 of additional conditions which must be fulfilled in order to obtain State aid under this regulation are the following: 1. at least three municipalities to cooperate on the planning and execution of the programme in order to improve educational services for individual and meeting the needs of the whole of the labour market in the collaborating municipalities, 2. the collaborating municipalities will finance education equivalent to training under this regulation by at least the same extent in the annual study sites that the education grant be provided for ,



3. the composition of the training should be scheduled after consultation with representatives of employers, organizations or associations which are active in the sectors represented in the collaborating municipalities, 4. the range should be scheduled after consultation with



(a)) the operator that has a regional utvecklingsansvar in the county or counties according to law (2010:630) on regional utvecklingsansvar in some counties, the law (2002:34) of co-operating units in counties or Ordinance (2007:825) with länsstyrelse instruction, and (b)), the employment service, 5. the collaborating municipalities



a) demonstrate a need for the training,



b) offer an opportunity for validation, and



c) offer guidance and counselling as well as in the planning and implementation of the training of student's previously acquired knowledge and skills.



Exemption from the condition of cooperation between at least three municipalities in the first subparagraph of paragraph 1 may be granted if there are serious reasons.



The condition set out in item 2 of the first paragraph does not apply to an apprenticeship or a coherent training of professional drivers for the carriage of passengers or freight.



For the calculation of the years of study in the first paragraph 2 concerns the 28, 29, 30 or 31 § instead of that specified in Chapter 2. the third subparagraph of paragraph 2 of the Regulation (2011:1108) on adult learning.



Limitations when it comes to orienteering courses and courses in some subjects



21 § state aid under this Regulation may only be given for introductory courses for pupils who also participates in regional vocational in any of the collaborating municipalities. Government subsidies may be provided for a maximum of 200 operational points for one and the same person, even if the person is involved in several introductory courses.

For a person who participates in education in accordance with this regulation, combined with training in Swedish as a second language at a basic level or education in Swedish for immigrants may be government subsidies provided for introductory courses of no more than 400 operating points. Up to 200 of these 400 business points may relate to introductory courses as a aims to provide native support or study guide on mother tongue and a maximum of 200 may relate to other introductory courses.



22 § state aid under this Regulation may only be given for courses in Swedish, Swedish as a second language, English, math, or social studies in municipal adult education at the secondary level for students who also participates in regional vocational in any of the collaborating municipalities. Such courses may constitute up to 25% of a student's education as government subsidies provided for under this regulation.



Other limitations



23 § State aid under this Regulation shall not be granted for 1. individual courses, 2. high school work or secondary special work,



3. training as a pupil has the right to participate in the under 20.

section 19 of the Education Act (2010:800),



4. education or training as government subsidies provided for by other means, or



5. training activities carried out under the Regulation (1992:395) for continuing professional development of the school system.



The size of the State aid with regard to apprenticeships



section 24 of the State grant for apprenticeships in regional vocational will be allocated on the basis of the number of students admitted to the programme during the period covered by the decision on the contribution relates. The grant is provided with 50 000 SEK per year study site during the eligibility period.



section 25 If Government subsidies provided for apprenticeships in regional vocational State grants may be submitted to the interlocking municipalities also for compensation to the workplace. Such State aid shall be allocated on the basis of the number of students who received at workplaces for the context of learning during the period covered by the decision on the contribution relates. Each such pupil qualifies the interlocking municipalities to the State grant for compensation to the workplace with a maximum of 40 000 kroons per year of the study site during the eligibility period.



section 26 If Government subsidies provided for apprenticeships in regional vocational State grants may also be made to the interlocking municipalities for supervisor training. Such Government subsidies may be provided with not more than 3 500 SEK per premium period for each supervisor at a workplace that has received such a student referred to in section 24, if the supervisor has attained a supervisor training school as a State judge satisfies the requirements of the Agency set out for such training. Grants may not be submitted for a supervisor as State aid under this regulation has been provided in the past.



Basis for calculating government contributions in terms of other education



Basics



section 27 of government subsidies for training provided for in this regulation are left with an amount per year study site.



When it comes to non-training apprenticeships apply 28, 29, 30 or 31 section instead of the one specified on the one-year study in Chapter 2. the third subparagraph of paragraph 2 of the Regulation (2011:1108) on adult learning.



Professional topics



section 28 For training in subjects such as vocational subjects in high school is in child-and recreation, business and administration programme as well as health and omsorgsprogrammet


provided government grants for a year study space equal to at least 1 100 activity score.



section 29 of the education in subjects such as vocational subjects in high school is in the construction program, electricity and energy application, automotive and transport programme, handicraft, hotels and tourism programme, the industri technical program, natural resources management program, restaurant and food programme, as well as plumbing and building program provided government grants for a year of study equivalent to at least 800 operating points.



section 30 For courses in vocational subjects in special education for adults, provided government grants for a year of study place at full-time study includes 800 operational points.



Other education



section 31 For introductory courses and for courses in Swedish, Swedish as a second language, English, math, or social studies in municipal adult education on the secondary level provided government grants for a year's study site that corresponds to 1 300 activity points.



Applications and decisions on State aid



section 32 application for Government grants made to the State's school that examines issues and pays the premium.



In a decision to grant a contribution will be the last day for recognition under paragraph 36 stated. The decision may be subject to conditions. The conditions shall be set out in the decision.



33 § application must be made jointly by the collaborating municipalities. The application should indicate



1. what types of work to which it relates,



2. how many years of study areas and business scores education altogether will cover, 3. that municipalities will finance education equivalent to training under this regulation by at least the same extent in the annual study areas to which it relates, 4. that training includes an opportunity for validation if there are students who need it, 5. an analysis of skills needs in the private and public labour market within the collaborating municipalities



6. how training is planned and the planned education responds to the skill needs of the labour market within the collaborating municipalities, 7. the reasons that local authorities have given priority to the occupations to which it relates, and



8. other functions required by the regulations issued pursuant to section 40.



Of the application should also indicate how the working world in the interlocking municipalities have participated in the planning of training and how the regional development department operator in the County that the municipalities and the public employment service has participated in the planning of educational services.



34 § State school, in its allocation of State aid to take into account the needs for skills in the labour market and the extent of unemployment in the interlocking municipalities.



The first subparagraph shall not apply to mainstream vocational training for professional drivers for the carriage of passengers or freight.

For such training relates instead to the National Agency for education in their allocation of State aid should take account of the need for geographical distribution of training places.



Monitoring and reporting



35 § State school to follow up the training courses the State contribution has been used for and how the contribution has been used by gender, age, previous educational level, share foreign and home births and, for foreign born, length of stay in Sweden. Of the follow-up, it should also indicate the extent to which students who successfully completed the regional vocational engaged in work.



Municipalities that have received State aid under this Regulation shall participate in the follow-up of the training activities that are determined by the National Agency for education and provide the information as fact.



36 § State school, in connection with its annual report to government offices account for how the grant has been used.



Municipalities that have received State aid under this Regulation shall provide such financial and other reporting to the State's school as work requests.



Refunds, chargebacks and redistribution



§ 37 municipalities that have received State aid under this regulation are repayable if



1. one of the conditions for the grant materially breach



2. the premium has been provided on improper grounds or with excessive amounts,



3. the refund entirely or partially unused or has not been used for the purpose for which it has been provided for, or



4. the municipality does not provide the information referred to in section 35.



Statens skolverk should decide to fully or partially recover a State aid if any is the repayment obligation referred to in the first subparagraph.



If there are special reasons for it, the National Agency for education to waive recovery in whole or in part.



38 section On Government subsidies required back, interest will be charged from the day that is one month after the recovery decision has been taken after an interest rate at any time exceeds government lending rate by two percentage points.



If there are special reasons for it, the State's school to waive requirements on interest in whole or in part.



39 § State school may decide to allocate the funds that have been refunded under section 37 to other collaborative communities that have applied for State grants under this regulation if the municipalities



1. do not have a State grant or have not received government subsidies for so many years of study areas as municipalities have applied for, and



2. has given or is deemed to have the ability to provide training in regional vocational beyond what local authorities have previously received funding under this regulation.



Authorization



section 40 of the State's school must notify the regulations necessary for enforcement of this regulation.



Appeal



41 § Decisions pursuant to this Regulation may not be appealed.



Transitional provisions



2016:937



1. this Regulation shall enter into force on January 1, 2017.



2. The regulation repeals a) Decree (2009:43) if the State grants for vocational and adult education at secondary level to some theoretical, and (b)) Regulation (2010:2016) if State funding for apprenticeships for adults.



3. The repealed regulations still apply to state aid granted before its entry into force.
