Introductory provisions



section 1 of this regulation contains provisions relating to state aid for the costs of additional staffing in the student health services within



1. kindergarten class,



2. primary school,



3. basis for pupils,



4. special school,



5. the Sami school,



6. upper secondary school, and



7. upper secondary school pupils.



section 2 of the Regulation also contains provisions on State aid for the costs of personal enrichment in the case of special needs activities in



1. kindergarten class,



2. primary school,



3. basis for pupils,



4. special school,



5. the Sami school,



6. upper secondary school, and



7. upper secondary school pupils.



paragraph 3 of the Regulation also contains provisions on State aid for the training of teachers and pre-school teachers in



1. kindergarten class,



2. primary school,



3. basis for pupils,



4. special school, and



5. the Sami school.



The training should aim at the teachers and preschool teachers will make a speciallärarexamen or specialpedagogexamen according to annex 2 to the higher education Ordinance (1993:100).



4 § State aid provided to the extent that the availability of funds and for not more than one year at a time.



5 § State aid may be given for an action pursuant to this regulation, even if the contribution is provided for the same bet according to the Regulation (2016:329) on State contribution to school authorities for efforts within the framework of collaboration for best school and to strengthen the quality of education for new arrivals. State aid should not be provided for interventions that State aid provided for by other means.



Conditions for State aid



Additional staffing in student health



section 6 of the State aid provided to a principal for such a school form referred to in paragraph 1 for the cost of additional staffing in student health in school form. The reinforcement should relate to employment or assignment with certain duration full time or part time.

The reinforcement will mean that the average staffing levels in student health services at the principal actually increases compared with staffing levels during the two calendar years preceding the period to which has the principal applying for grants, in terms of full-time equivalents.



Contributions may also be made for the cost of maintaining the expanded number of annual work units (AWU) as the principal received grants as referred to in the first subparagraph if the number of pupils have not fallen significantly since then.



Grants are not for personal enrichment achieved through redeployment of existing staff or reorganization of the business.



section 7 of the State aid may be granted for the cost of additional staffing in the student health services relating to



1. school doctor,



2. the school nurse,



3. school welfare officer, or



4. school psychologist.



If State aid is sought for employment or Commission referred to in the first subparagraph 1, 2 and 4 left only provided that the employed or given assignments have identification and entry requirements for the profession that the employment or assignment is made.



If State aid is sought for employment or Commission referred to in the first subparagraph 3, provided subsidies only on condition that the person is employed or given missions have sufficient training for employment or assignment.



8 § State aid within the meaning of section 6 may be made by an amount equal to half the cost of a full-time employment or Commission equal to full time for any of the categories of personnel referred to in section 7. A principal may be supported for several full-time jobs or assignments that correspond to full time.



If a principal is applying for grants for employment or assignment which does not involve or equivalent to full time, should the amount of the grant will be reduced accordingly.



Additional staffing in the case of special needs activities



9 § State aid provided to a principal for such a school form referred to in section 2 of the cost of additional staffing as regards special education efforts in school form.

The reinforcement should relate to employment or assignment with certain duration full time or part time. The reinforcement will mean that the average staffing levels when it comes to special needs efforts of the principal actually increases compared with staffing levels during the two calendar years preceding the period to which has the principal applying for grants, in terms of full-time equivalents.



Contributions may also be made for the cost of maintaining the expanded number of annual work units (AWU) as the principal received grants as referred to in the first subparagraph if the number of pupils have not fallen significantly since then.

section 10 State aid may be granted for the cost of additional staffing in the case of special needs activities relating to



1. special education teacher, or



2. teachers with specialpedagogisk skills.



Contributions may only be provided to those who are employed or are given missions have identification and entry requirements for the profession that the employment or assignment is made.



11 § State aid within the meaning of section 9 may be presented by an amount equal to half the cost of a full-time employment or Commission equal to full time for any of the categories of personnel listed in section 10. A principal may be supported for several full-time jobs or assignments that correspond to full time.



If a principal is applying for grants for employment or assignment which does not involve or equivalent to full time, should the amount of the grant will be reduced accordingly.



Training regarding the special needs activities



12 § State aid provided to a principal for such a school form referred to in paragraph 3 of governing the payment of salaries to teachers or preschool teacher in school shape



1. are employed by the principal,



2. participate in training with the objective set out in section 3, and



3. have a grundlärarexamen, teacher qualification, yrkeslärarexamen, preschool teacher degree or the equivalent older exam.



13 § State aid is provided for training under section 12 (2) if the teacher or pre-school teacher



1. participate in training during working hours,



2. is on leave during the training, or



3. trainee during the time when he or she does not work due to the employment of less than full time.



The first paragraph (2) and (3) apply only where the operator pays compensation equal to at least 80% of the teacher's or preschool teacher's salary for the time he or she takes part in the training.



14 § State aid within the meaning of section 12 shall be equal to 70% of the cost of the principal for reimbursement under section 13.



If the principal pay higher compensation than 80 per cent of the teachers or preschool teacher's salary for the time he or she takes part in the training, are not contributions for the exceeding part.



Applications and decisions on State aid

A principal applying for grants to the National Agency for education to provide the information necessary for the application of this regulation.



In a decision to award grants to last day for recognition under section 21 are listed. The decision may be subject to conditions. Conditions should be clear from the decision.



16 § If it comes in more applications for government subsidies for additional staffing in the student health services in accordance with section 6, than there are funds, decides on the selection of the State skolverk. In the selection to applications relating to employment or assignment as school psychologist take priority over applications relating to school doctor, school nurse or school.



The National Agency for education is also in the selection



1. give priority to requests from the principals that have the greatest need for enhanced student health,



2. give due consideration to geographical distribution, and



3. take into account the fact that the subsidy is provided to both public and independent principals.



section 17 If it comes in more applications for Government grants for personal enrichment in the case of special needs activities under section 9, than there are funds, decides on the selection of the State skolverk. In the selection to the National Agency for education, in the order specified below, to give priority to



1. kindergarten class, grades 1-3 of primary school, pupils and school because Sami as well as grades 1 – 4 of the special school, or



2. other grades in the school forms as well as upper secondary school and upper secondary school pupils.



The National Agency for education is also in the selection priority to applications from principals who have particularly difficult conditions.



section 18 If it comes in more applications for State aid for training when it comes to special needs activities under section 12 than there are funds, decides on the selection of the State skolverk. In the selection to the National Agency for education, in the order specified below, to give priority to



1. kindergarten class, grades 1-3 of primary school, pupils and school because Sami as well as grades 1 – 4 of the special school, or



2. other grades in the school forms.



The National Agency for education is also in the selection priority to applications from principals who have particularly difficult conditions.



If a person who has started training under section 12 2 cancels the, the National Agency for education if possible decide that educational site will be taken over by another person reported to the training but did not receive a training place.



19 § State aid for personal enrichment in the student health services and in the case of special education efforts should be paid at one point during each benefit period.



State aid for training when it comes to special education efforts should be paid once per semester for the training referred to in section 12 2 referred to be carried out during the semester in which the contribution is made. The contribution shall be paid as soon as it has been determined which teachers or preschool teacher trainee.



Monitoring and reporting



section 20 of the State to track the State skolverk grant has been used.



section 21 Recipients of State aid is required to provide such financial and other reporting to the State's request that agency skolverk.



Refunds and chargebacks




section 22 of the recipient of State aid under this regulation is liable to repay, if



1. the refund has been granted on false pretense or with excessive amounts,



2. the refund has not been used wholly or in part, or has not been used for the purpose for which it has been provided,



3. the report referred to in section 21 has not been provided, or



4. the receiver has failed to comply with conditions as set out in the decision on the contribution.



The recipient of State aid, however, is not the repayment obligation referred to in the first subparagraph 2 of the contribution, which has been provided for a particular purpose pursuant to this regulation, have been used for another purpose in accordance with the regulation.



An indication of the provisions of this paragraph shall be included in the decision on the contribution.



section 23 of the State should decide to skolverk fully or partially recover a State aid if any is required to refund under section 22.



If there are special reasons for it, the National Agency for education decide to fully or partially waive recovery.



section 24 of The Government subsidies needed to back interest, starting on the day that is one month after the recovery decisions have been taken and after an interest rate at any time exceeds the State lending rate by two percentage points.



If there are special reasons for it, the State may decide to fully or partly skolverk renounce claims to interest.



Authorization



paragraph 25 of the State's skolverk may provide for



1. the allocation of State aid in accordance with §§ 16-18,



2. calculation and redistribution of the contribution, and



3. the implementation of this regulation.



Appeal



section 26 of the Decision pursuant to this Regulation may not be appealed.



Transitional provisions



2016:400



1. This Regulation shall enter into force on 1 June 2016.



2. This regulation repeals Regulation (2011:1597) of State aid for personal enrichment in student health.



3. The repealed regulation remains in force for State aid granted before its entry into force.
