Introductory provision



section 1 of this regulation provides for State subsidies for cultural activities in some residential areas.



Government subsidies provided to the extent that the availability of funds.



The purpose of the State's contribution



2 § the purpose of Government grant is to promote



– greater participation in and increased supply of cultural activities for all ages in residential areas with low voter turnout or socio-economic challenges – cultural activities based on the residents ' needs and wants, based on collaboration between multiple players, at least one of which is active in the residential area, – diversity, accessibility and equality in the cultural activities, and the Exchange and dissemination of knowledge.



Conditions for State aid



paragraph 3 of the State aid may be given in the form of project grants to new or existing cultural activities. The project will



1. conducted in a residential area of low turnout or socio-economic challenges,



2. based on the involvement and participation of those who live in the area where cultural activities will be carried out, and



3. be carried out in collaboration between multiple players, at least one of which is an organization within civil society with local presence in the area where the operation is to be carried out.



A partnership within the meaning of the first subparagraph 3 may include private, State or municipal bodies.



4 § State aid can be given to a legal person who is the head of the project and that respects democratic ideas, including equality and non-discrimination. A State or local government actor may not be the main man for the job.



5 § State aid must not be granted for a project initiated before the application for aid has been submitted to the Swedish National Council for Cultural Affairs in accordance with section 9.



section 6 of the State aid should not be provided to an applicant who has debts of Swedish taxation of the Swedish enforcement authority or are in liquidation or bankruptcy.



7 § State aid may only be provided in accordance with chapter I and article 53 of Commission Regulation (EU) No 651/2014 of 17 June 2014 by which certain categories of aid declared compatible with the common market within the meaning of articles 107 and 108 of the Treaty.



Distribution of State aid

The management and decision on State aid



9 § the Swedish Arts Council examines questions of State aid under this regulation.



section 10 of the application for State aid must be in writing and be filed with the Swedish National Council for Cultural Affairs.



11 § Before the Swedish Arts Council hears an application to the Swedish Arts Council hear national public art Council Sweden and Swedish authorities to the extent necessary.



12 § a requirement for co-financing should be made as a condition of State aid when it is deemed appropriate with regard to the economic conditions of the actors in a collaboration.

A decision on State aid may also be combined with other criteria.

Conditions should be clear from the decision. The decision will also last day for recognition under section 13 specified.

Barriers to payment



15 § State aid under this Regulation shall not be paid to a company that is the subject of recovery because of a decision by the European Commission which declares an aid illegal and incompatible with the common market.



Refunds and chargebacks



16 § the recipient of a financial contribution under this regulation are payback-guilty of 1. receiver by providing incorrect information or has otherwise caused to refund is made improperly or with excessive amount, 2. the contribution of other reasons have been provided improperly or with excessive amount and the recipient should have known this, 3. the grant has not been used wholly or in part, or has not been used for the purpose for which it has been granted, 4. the receiver does not leave such accounts referred to in section 13, or 5. conditions of the order have not been respected.



section 17 if the beneficiary is obliged to refund under section 16, the Swedish Arts Council decide to fully or partially recover the premium. On the amount of the refund received is liable to pay back to interest rate with interest Act (1975:635) is paid.



If there are special reasons for it, the Swedish Arts Council decide to refrain, in whole or in part from chargebacks and claims to interest.



Authorization



section 18 of the Swedish Arts Council may provide for the enforcement of this regulation.



Appeal



section 19 of the Decision pursuant to this Regulation may not be appealed.



Other provisions



section 20 of the Swedish National Council for Cultural Affairs shall keep the records referred to in article 12 of Commission Regulation (EU) No 651/2014.



Transitional provisions



2016:406



1. This Regulation shall enter into force on 1 June 2016.



2. Regulation expires at the end of 2018.



3. The repealed Regulation shall continue to apply to state aid which has been decided by the end of 2018.
