Transitional provisions



1972:114



This law shall enter into force on 1 May 1972 and is valid as long as

the Convention is in force.



In the case of certain grazing fees for the temporary derogations

from 52 and 57 of the Convention as set out in articles 1, 2, 4

and 14 of the Convention drawn up in the context of conclusion

Protocol for the construction and maintenance of spärrstängsel for

reindeer, though that article 1 of the Protocol shall apply as Swedish

law as rated under the agreement of 3 October 1984 on

Amendment of the Protocol. Protocol amending the agreement, the

Annex 1



Convention

between Sweden and Norway if renbetning



The Swedish and the Norwegian Government has, on the basis of the

report made by the Swedish-Norwegian reindeer Commission of

in 1964, held negotiations about Sami renbetning and agree

Chapter i. Swedish renbetning in Norway



Grazing areas



1 §



A. romsa



In Troms County, Norway, the following areas shall be used for the Swedish renbetning:

Ta-Rust, Devdisfjellet, Havgavuobmi, Anjavassdalen, Sarevoubmi and

Salvasskardet.



The fields have the following limits:



1. Ta-Rust



From riksröse 294 (Treriksröset) at Gåldajavri, this Lake and

Breiddalen to Gåvdajavri, the eastern side of the Gåvdajavri to its

Northern Bay, thence a straight line to the most westerly Langvatnets

Bay, thence a straight line in a westerly direction to Midterdalen, this

Valley and Kitdalen to Storfjorden, this fjord to the outlet of the

River to Övergård, thence a straight line in a southerly direction to the

From 287 Stuorra riksröse in Råstajavri along the southern border of the area

3. Havgavuobmi



From riksöse 285 along southern border of area Devdisfjellet to

Skaktarjåkkas confluence with Divielva, this river to Moarsejavri,

4. Anjavassdalen



From Moarsejavris South end along the västgränsen of areas

Havgavuobmi and Devdisfjellet to the Divielvas confluence with Målselva,

This River to the confluence with the Beinelva, this river and Beinelvdalen,

Guovdelasvaggi and Langedalen to Sandelvvatn, this Lake to its

South end, from there a straight line over point 896 to pond

Hubitdievat, from there a straight line in south-westerly direction to

the confluence between the Creek from the pond at point 829 and Maddajåkka,

from there in a straight line to the pond at paragraph 918, on a straight line

over the eastern end of Måskanjavris to Helvetjavri, this Lake and Brook

to Doarrujavri, this Lake and Doarrujåkka to the link with the

Multujåkka, from there in a straight line to the southern end of the Moarsejavris.



5. Sarevuobmi



From riksröse 283 riksröse in a straight line to 280, from there border

back to riksröse 283.



6. Salvasskardet



From the border at Leinavatn, this Lake, Astuaedno and Altevatn to

the dam at the Lake's western end, from there to the link with the Barduelva

Sördalselva, this river and Sördalen to riksröse 272, from there

border back to Leinavatn.



B. North country and Nord-Trøndelag counties



In the North country and Nord-Trøndelag counties on the Swedish renbetning

use the areas between the border and the following

boundaries:



1. In Ankenes, Ballangens and Tysfjords municipalities



(a)) from the border at Katteratvatnets on the north side, this Lake to

its western extremity, thence a straight line to the railway bridge over the

Dog als eleven, this river to the confluence with the Oallajokka, this river and

Oallavagge to the East end of Saelkajavrre, this Lake and Saelkajokka

to Cunojavrre, this Lake and Cunojokka to the link with the

Sandelva, from there in a straight line to reach the amman flow at point 716 in

Kaliksdalen, thence a straight line over point 1314 to the Lake at point

1111, this Lake and Coarvvejokka to Nordre Coarvvejavrre, this Lake

and pelvis to Söndre Coarvvejavrre, this Lake to its South West

Bay, thence a straight line in Southwest direction to the nearest fold in

Vannaksvatn, this Lake, Gautelisvatn, Brook to Båtsvatn, this Lake,

Nuorjujokka, Kobbvatn, Kobbelva and Sörelva to the link with the

Tverelva, this river to Iptovatn, this Lake to its southern extremity,

thence in a straight line to the border immediately to the North of Rarkajaure.



(b)) From riksröse 255 to Kjårdavatnets north end, from there a straight

line to Middagsvatnets southern end, this Lake to the brook that flows

out in the Lake North of point 1262, from Brook from the mouth in a straight line to

Vabakkvatn, this Lake and Brook to Forsvatn, this Lake and Brook

to Sidasjavrre, from Brook from the mouth in a straight line in a south-westerly

direction of Baugefjell, Baugevatn and Paurofjell point at 1156 to

Paurovatn, this Lake to the outflow from Naidivatn, this Lake to its

the extreme southwest Cove, thence a straight line in Southwest direction over

item 1150 to Björnvatn, this Lake and Brook to Röysvatn, this

Lake to its eastern end, from there in a straight line to riksöse 251.



2. In Sörfolds and Fauske municipalities



From the border at the southern shore of this Lake Leirvatnets, to

Blåmandsisen, along the eastern edge of Blåmandsisens to Småsorjusvatn in

point 958, this Lake to its southern extremity, thence a straight line to

Lower Duoldagopjavrre, this Lake to its southern extremity, thence a straight

line across point 859 to Låmielva, this river, Låmivatn and Eidevatn

to the border at Låmitjern.



3. In Saltdals and Rana municipalities



(a)) from the border on the southern shore of this Lake Mellomvatnets, to

its western extremity, thence a straight line to the eastern end of the Dorrovatnets,

Kvebilok in Balvatn, this Lake to Skaitidalen, this valley with

From the border at Valdanjaure in a straight line to the link between

A. in Troms County, Norway: from 1 May to 14 september.



B. in the North country and Nord-Trøndelag counties: from 1 July

until 31 August.

4 §



Grazing areas must not be used for Norwegian renbetning in the part of the

Norrkaitum, Justnayz, Sörkaitum, Sirkas, Tuorpon, Luokta-Mavas,

Semisjaur-Njarg, Svaipa, Gran, Ran, Umbyn, Vapsten, Vilhelmina North,

Vilhelmina southern and Northern Bay Frost.

Chapter II. Norwegian renbetning in Sweden



Grazing areas



7 §



A. norrbotten County



In Sweden, the following areas used for Norwegian renbetning:

Maunu, Njuorajaure, Patsajäkel, Älvsbyn and Storsund.



The fields have the following limits:



1. Maunu



Jeitisjoki from Kelottijärvi to forest boundary, from there a straight line

to the eastern end of the Kutsurjärvis, from there in a straight line to the top

pond in Saarijoki Southeast of Kutsuroivi, from Saarijoki to

the confluence with the Ainattijoki, from there in a straight line to Outajärvis

southernmost Cove, thence a straight line to road No. 396 at Ahvenjärvis

Northeastern Beach, this path to Muonioälven in Karesuando, this river

and Könkämäeno to Kelottijärvi, this Lake to Jetisjokis

inflow.



2. Njuorajaure



From riksröse 272 in a straight line to Pålnoluokta, from there the Torneträsk

to Paktajåkas inflow, this stream and Paktajaure to the sea

southernmost Cove, from there the railway line to riksgränsen, this

back to riksröse 272.



3. Patsajäkel



The Torne River from Lake Torneträsk with the Lakes Tarrajaure, Jekejaure, Alajaure,

Vakojaure and Nuorajärvi to Kallojärvi, from there the Lake Alanen

Voulusjärvi, Vuolusjåkka and Vuolusjaure, from Alep in a straight line

to the Lake of Lulep Stalojaure, this Lake, Stalojåkka and Korttojärvi to

Lake Torneträsk, this Lake to the Torne River.



4. Älvsbyn



From Holmsel along the way to the southeastern part of the Åträskets, from there a straight

line to the westernmost Bay in Lake Manjärv, thence a straight line

to the village Manjärv, then along the road from Manjärv over Avaträsk to

Road No. 90, this road to the bridge over the river Pite, this river to

Holmsel.



5. Storsund



From Storsund along the railway line to the highway Great swamp liden-

Koler, this road to the River, with the Lakes this Lillpite River

Swamp Of Fortune (Lukoträsket), Häbbersträsket, Pärlträsket,

Klockarträsket and Åträsket to Råbäcken, from there in a straight line to

the branch Northwest of Lillpite, from there the road to Söravan in the Interior

Arvid's swamp, from the South side of Lake Suwa and Inner swamp

Little Musti swamp, from there in a straight line to Teugerliden, from there

the road to Storsund.



B. Sweden



In Sweden, the following areas used for Norwegian

renbetning: Ramsele, Kuusisaari and Meselefors.



The fields have the following limits:



1. Ramsele



From the road bridge on the ume River at Ottonträsk, along this river to

Brook outflow at the village of Kvarntorp, this Brook to road No. 93, this road

to the branch at Gullbäck, from there the road Gullbäck-Västerbäck-

Sarsjöliden-Harrselsfors-Rochester, thence a straight line in a westerly

direction to the branch North of Sauna swamp, from there the road past

Skivsjö and Sundö to the ume River at Ottonträsk.



2. Granö



From the hydroelectric dam at the stake the rapids in the ume River, along this river to

landsvägsborn at Ottonträsk, from there towards Skivsjö to

Satmyrsjön, this Lake and Korbebäcken to Great Korbesjön, this Lake

and a line drawn from the north end of the road at Byssträsk, this

Grazing areas may be used for Norwegian renbetning during the following times:



A. in norrbotten County: from 1 October to 30

April with the following exceptions:



1. Area Patsajäkel from 1 december to 30

April. Uppföres fence between Saarivuoma and Talma Sami villages, sheep

Storsund



From the border North of Nasa scale past the Värdejaure, along the mountain range

Abraur-Moskosel, from Moskosel past Lomträsk and Njallejaur, along the

B. Sweden




Ramsele



From riksgränsen in the Umbukta over Brantsfjället, Norra Storfjället and

the mountain Väretje to Danasjön, from there to Abborberg, Fjällbosjön,

Lakes Gunnarn and Lower Gunnarn to Blåviken, then along

UME River North side past the Lycksele and Kuusisaari to Ottonträsk.

side of the river.



Granö



Either from riksgränsen in Judgment Krutvatn along the Southern Storfjällets

North and östsluttningar to the Löfjället or from the border at

Arevattnet, by Arevattnets and Abelvattnets Valley to the Löfjället,

from there past the Gimjafjället, North of Gard mountain to Holm swamp,

from there to Bastansjön and along the South side of the Lake at Storuman

UME river ice or along the South side of the Gardiken and the ume River to

Meselefors



From the border at Ranseren past Evelynlabayani, along the Burgfjället,

Gitsfjallet which and Blaikfjallet, past Klinkhöjden and Stadsås to

Meselberget.

32 §



Agricultural Board/reindriftsinspektören can provide for the collection and

separation to take place when the



1. supervisor in violation of the Convention fails to arrange collection

or separation,



2. supervisors by virtue of paragraph 27 agreed to defer

or refuse collection or separation but that according to the Agency's

judgment should be enforced without delay;



3. There are grounds assume that confusion has occurred or



4. otherwise there are special reasons.



Agricultural Board/reindriftsinspektören determines the time and place of

collection and skiljningen.



Prior regulation referred to in the first subparagraph shall be communicated to the appropriate foreman

33 §

paragraph 48.

Chapter V Special provisions

64 §



Authorities of the two countries shall be individually and in collaboration

the national Sámi carries on in the other country takes place in

accordance with the Convention and shall provide each other assistance in the

effective application of the Convention.



The Committee shall consist of three members from each country. By

Members from each country shall be an expert in

Chapter VI. Transitional provisions



67 §



For a period of five years from the entry into force of the Convention may area

before May 1, 1997, shall, if one of the parties to the agreement calling for it, a

mixed Norwegian-Swedish Commission be set up to investigate the issue of


one of the country's reindeer-herding Sámi from the end of the Convention

the period of validity of the need of continued renbetning in the second country in the

grazing areas covered by this Convention or parts thereof.

The two Governments agree on the composition of the

the Commission's secretariat, on jurisdiction of the President

appointed in accordance with section 66 and from the authorities and individuals.



The common costs of the work of the Commission shall be divided equally

between the two countries.



72 section



The Commission shall deliver its report no later than three years after the

In connection with the conclusion of the Convention between Sweden and Norway on

renbetning, the Swedish and the Norwegian Government, citing

to 42 and 43 of the Convention only if the following rules concerning the

the construction and maintenance of spärrstängsel for reindeer:



Ariktel 1



Spärrstängsel shall, as soon as possible, before 1 May 1975 appear on the

distances referred to in this article.



A. romsa



1. Ta-Rust



Along the limit laid down in paragraph 1 (A) 1 the Convention from riksröse 294

(Treriksröset) to the appropriate location in the Kitdalen (about 35 km).



2. Anjavassdalen and Havgavuobmi



Along the limit laid down in paragraph 1 (A) 4 Convention from South end of

Sandelvvatn to the southern end of Moarsejavri, from there along the border

referred to in article 1 (A) 3 Convention to riksröse 283 (about 50 km).



3. Sarevuobmi



Along the limit laid down in paragraph 1 (A) 5 Convention from riksröse 283

to 280 riksröse, from there along the border to Leinavatn (about 29

B. North country Shire

Article 3



Spärrstängsel shall, before 1 May 1979 appear on the routes to

set out in this article.



(A) the Troms County



Anjavassdalen



Along the limit laid down in paragraph 1 (A) 4 Convention from the appropriate place in

Beinelvdalen to Sandelvvatns the South end (about 30 km).



B. norrbotten County



In Jokkmokk municipality



From Lake Slapejaure to the border at Lake Numirjaures West end

(about 7 km).



C. North country, 1. In Hamaröys municipality



From the endpoint of the last fence along the border to the national

Cairn 244 A (about 5 km).



2. In Sörfolds municipality



(a)) From Sorjasjavrre at point 770 to Langvatn about 2 km west of

border at riksröse 243 (about 2 km).



(b)) On certain routes between Trolldalen and riksröse 242 (c. 7

km).



Article 4



When the grazing area specified in § Maunu 7 A 1 Convention tages in use

renbetning of Norway, shall as far as may be necessary fence erected along the

the area's border from Kelottijärvi to Muonioälven.



Article 5



Sprärrstängsel may appear in the grazing area Havgavuobmi in Troms County, Norway

along one of the following routes:



1. From the point where the Swedish fencing as uppföres between

Lainiovouma and Saarivuoma Sami villages connects to border between

National (A) 284 284 Cairns and, through Julusvaggi, along the Julusjåkka and

Divielva to the appropriate point in this river (about 22 km).



2. From the point where the Swedish fencing as uppföres between

Lainiovouma and Saarivouma Sami villages connects to border between

riksösen 284 and 284 (A), on the north side of Råggastatjaeggi and pond

at paragraph 625, thence in a westerly direction to Havgajåkka, along

This Brook to the influx of Divielva (about 12 km).



Norwegian authorities decide which of these options may be carried out

and notifies the Department of agriculture in Sweden of its decision no later than two

months after the entry into force of the Protocol.



Spärrstängsel referred to in this article may appear only as

continuation of the Swedish fencing as uppföres between Lainiovuoma

and Saarivuoma Sami villages.



Article 6



The deadlines for the construction of the spärrstängsel referred to in articles 1-3

can be extended if obstacles arise due to adverse väderleksför

3. Sweden up and maintain the fence referred to in article 4.

Swedish or Norwegian authority or be granted for construction.



Article 13



Work in connection with the construction or maintenance of fencing

effected through the Swedish Government or the Swedish Agency of entrepreneurship

on Norwegian soil or by the Norwegian Government and Norwegian entrepreneur

provision on Swedish ground, shall, in respect of arbetsmarknadsför

3. the provisions set out under 1 and 2 shall apply non



a) if substantially the same reindeer again illegally exceeding grazing the border

in essentially the same place within 14 days after the reindeer carried

back to allowed transhumance,



(b)) of the reindeer is illegally resident in the other country and

residence non either would have been permitted under the 1919 year

the reindeer herding Convention as amended since 1949.



Article 15



This Protocol shall be ratified and the instrument of ratification shall

are exchanged in the........... by...........



The Protocol shall enter into force on 1 May 1972 and is valid until

april 30, 2002.



The Protocol presented in two copies, in the Swedish and Norwegian languages,

Annex 3



Agreement amending the Convention on 9 February 1972 between Sweden and

Norway if renbetning



The Swedish and the Norwegian Government after negotiations become

agreed on the following amendments to the Convention on 9 February 1972

renbetning.



section 1 (A), second subparagraph, point 4 shall read as follows:



"4. Anjavassdalen



From Moarsejavris South end along her western borders for areas

Havgavuobmi and Devdisfjellet to the Divielvas confluence with Målselva,

This River to the confluence with the Kirkeselva, this river and Kirkesdalen

to Kirkestinden, from there in a straight line to the southern end of the Lake at

section 922, then along the Gaskasvagge to the Altevatn, this Lake to

Avzzejokkas westernmost outflow, this river to level with point 1012,

"In Sweden, the following areas used for Norwegian

renbetning: Maunu, Jalkis Vuoskåive, Njuorajaure, Patsajäkel, Älvsbyn

and Storsund. "




Furthermore, in section 7 (A), the program will insert a new paragraph, 2, by the following

amended, while current paragraphs 2 to 5 shall be known as the "3-6:



"2. Jalkis Vuoskåive



From riksröse 280 in a straight line to Voumajåkka mainly after

Agreement amending the Protocol on 9 February 1972 between Sweden and

Norway for the construction and maintenance of spärrstängsel for reindeer



In the context of the negotiations between the Swedish and the Norwegian

Government amendments to the Convention on 9 February 1972

renbetning Governments have been agreed on the following changes in

Protocol on the same day for the construction and maintenance of spärrstängsel for

reindeer.



Article 1, first subparagraph is hereby amended to read as follows:



"Spärrstängsel shall, to the extent that subject to paragraph (A) 2,

as soon as possible before 1 May 1975 erected on the routes to be set

in this article. "



Article 1, point (A) 2 shall read as follows:



"2. Anjavassdalen and Havgavuobmi



Along the limit laid down in paragraph 1 (A) 4 Convention of Avzzejokkas

most Western output of Altevatn to the southern end of Moarsejavri,

from there along the limit laid down in paragraph 1 (A) 3 Convention for the

riksröse 283 (about 45 km). This fence shall be erected before 1 may

1986.



Furthermore, as far as may be necessary fence erected along the boundary

specified in section 1 (A) 4 Convention from Kirkestinden to Altevatn. "

Agreement between the Government of the Kingdom of Sweden and the Government of

spärrstängsel for reindeer



Convention on 9 February 1972 between Sweden and Norway on

renbetning (Convention) together with the Protocol on the day of

the construction and maintenance of spärrstängsel for reindeer

(stängselprotokollet) will expire on 30 april 2002.



The Swedish-Norwegian reindeer Commission of 1997 introduced

in april 2001 a report as the basis for a new

the reindeer herding Convention. Negotiations between the parties on a new

Convention head and because it can be foreseen that a

agreement to this effect will not be available before the

the current Convention is due to expire, the parties have agreed
