The regulation's purpose

The provisions of this Regulation shall be communicated to main part

to Sweden to meet its obligations under the agreement on

European economic area (EEA).

Appropriations



2 §/I:2016-04-20 comes into force by Regulation (2016:331)./

Regulations issued pursuant to this regulation

shall be adapted to the EEA directive on units of measurement,

measurements and measuring instruments and to the European Parliament and of the Council

Directive 2004/22/EC of 31 March 2004 on measuring instruments.

If the regulation relating to the protection of the life, personal safety or health,

communications or business activities, as well as



3. requirements for and control of contents and control of

variety of information on prepacked products. Regulation (1995:188).

Swedish Board for accreditation and verification may communicate the regulations relating to the protection of the life, personal safety or health, communications or business and applies



1. requirements for measurements and measurement methods, or 2. requirements for and verification of measuring instruments;



The Board may also provide for 1. requirements for and control of pack size and control of the variety of information on prepacked goods, and



2. requirements for and verification of electricity meters even if the conditions set out in section 2 of the Act (1992:1514) units of measurement, measurements and measuring instruments are not met.

with the support of the law is exercised by the



1. The National Food Administration and the municipal board exercising

official controls with regard to the regulations on

pre-packaged foods, and



2. The Swedish Board for accreditation and technical control, when it

apply rules in General.



Provisions for such supervision is available in 5 and 6 of the Act

(1992:1514) units of measurement, measurements and measuring instruments.

The Swedish Board for accreditation and technical control, acting as market surveillance authority according to European Parliament and Council Regulation (EC) no 765/2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93 exercise market control of non-automatic weighing instruments and measuring instruments that are subject to 1. European Parliament and Council Directive 2004/31/EU of 26 February on the harmonisation of the laws of the Member States relating to the making available on the market of non-automatic weighing instruments, or 2. European Parliament and Council Directive 2004/32/EU of 26 February 2014, on the harmonisation of the laws of the Member States relating to the making available on the market of measuring instruments. Swedish Board for accreditation and verification, as provided for in Regulation (EC) no 765/2008 on the market surveillance responsibilities arising from section 7 (a)



1. establish appropriate procedures under article 18(2),



2. perform the duties arising from articles 20 to 22 and 23(2), and



3. collaborate with others according to article 24(2) and 24.4.

The Swedish Board for accreditation and technical control,

decide if the fees on measuring instruments that are subject to the Board's

supervision under section 7. The fees shall be determined so that they cover

the costs for this oversight. Regulations on such charges

be notified by the Board after consultation with the national financial management authority.

The Swedish Board for accreditation and technical control may determine fees for the inspection of measuring instruments and prepackages covered by the Board's oversight.

The fees shall be set at a level which covers the costs of supervision. Regulations on such charges will be announced by the Board after consultation with the national financial management authority.

Information and consultation in the context of market surveillance



§ 9/entry into force: 04/20/2016

The Swedish Board for accreditation and technical control shall notify the European Commission and the other Member States on non-automatic weighing instruments and measuring instruments which do not comply with the applicable requirements, if the Board considers that non-compliance is not only valid in Sweden. The notification shall contain information on non-conformity, assessment results, decisions made and any comments from the who decision against.



The Board shall notify the European Commission and the other Member States of the measures taken by the Board in respect of the corresponding information from another Member State.



The Board shall also notify the European Commission and the other Member States on non-automatic weighing instruments and measuring instruments that are deemed to pose a risk, although they meet the applicable requirements.

Swedish Board for accreditation and verification, where allowability and for Sweden's objection to a decision that a market surveillance authority in another Member State has taken on non-automatic weighing instruments or measuring instruments.

The Board shall promptly inform the European Commission, other Member States and the Government of the opposition and the reasons for it.



When the European Commission has assessed decisions and objections to the decision, the Management Board shall participate in the consultations that take place between the Commission and the other Member States. The Board shall also participate in consultation between the Commission and the other Member States on account of the non-automatic weighing instruments and measuring instruments that are deemed to pose a risk, although they meet the applicable requirements. Transitional provisions



1993:1066



1. this Regulation shall enter into force on the day on which the Government determines.

(In force on 1 January 1994, 1993:1646).



2. The regulation repeals Regulation (1986:984) if

determination of volume and weight.
