General provisions
1 §/expires U: 2016-01-01/this regulation contains emission standards for
1. engines installed in non-road mobile machinery
intended to be used for the carriage of goods by road,
2. auxiliary engines mounted in vehicles intended for passenger
or the transport of goods by road,
3. engines intended for locomotives and railcars,
4. replacement engines for engines referred to in 1 and 3, as well as
5. engines intended to power tractors.
The regulation does not apply to engines that power the motor vehicles,
ships, aircraft and recreational vehicles such as snowmobiles,
off-road motorcycles and all-terrain vehicles. The regulation is

The regulation does not apply to engines that power the motor vehicles, ships, aircraft and recreational vehicles such as snowmobiles, off-road motorcycles and all-terrain vehicles. However, there is a provision in the regulation on the type-approval of engines intended for inland waterway vessels.
The regulation also includes provisions supplementing Regulation (EU) No 167/2013 of 5 February 2013 on approval and market control of agricultural and forestry vehicles. Regulation (2015:930).
1 a of the regulation is notified
1. pursuant to section 1 of the Act (1998:1707) on measures against noise
and emissions from non-road mobile machinery with regard to paragraph 5,
2. pursuant to paragraph 4 of the law on measures against noise and exhaust fumes
from non-road mobile machinery with regard to paragraphs 3 and 3 (a), paragraph 4 of the second
subparagraph (a), 5, 6, 11 and 12 sections,
3. by virtue of section 12 of the law on measures against noise and exhaust fumes
from non-road mobile machinery in respect of section 9, and
4. Moreover, pursuant to Chapter 8. section 7 of the Constitution.

Expression of the regulation
2 §/expires U: 2016-01-01/for the purposes of this regulation,
auxiliary engine: engine installed in or on a motor vehicle, but
that doesn't have to do with the propulsion of the vehicle;
locomotive: self-propelled rail vehicles designed to move or
push carts designed to transport cargo and passengers
or other equipment,
mobile machine which is not intended to be used for transport
on the road: a mobile machine, transportable industrial
equipment or a mobile vehicle with or without body work
operated by means of an internal combustion engine as specified in section
1.1 of annex 1 to this regulation,
railcar: self-propelled rail vehicles especially intended for
the carriage of passengers or goods,
Tractor: tractor, as defined in the directive of the European Parliament and of
Council Directive 2003/37/EC of 26 May 2003 on the
type-approval of wheeled agricultural or forestry tractors, of
trailers and interchangeable towed machinery to such
tractors, and of systems, components and separate technical
devices to these vehicles and repealing Directive
74/150/EEC, in wording as laid down in Commission directive
2014/44/EU, and
replacement engines: a newly built engine to replace an engine in a
machine, supplied for this purpose only, and that
comply with the limit values that the engine it replaces would
meet when originally placed on the market.

Tractor: tractor, as defined in Directive 2003/37/EC of 26 May 2003 on type-approval of wheeled agricultural or forestry tractors, their trailers and interchangeable towed machinery, and of systems, components and separate technical units of such vehicles and repealing Directive 74/150/EEC, in the wording in the Commission's Directive 44/EU, or, as defined in Regulation (EC) No 167/2013 , and
replacement engines: a newly built engine to replace an engine in a machine, supplied for this purpose only, and which comply with the limit values that the engine it replaces would meet when originally placed on the market.

§ 2 d/entry into force: 01/01/2016 With the approval referred to in this regulation
1. a procedure whereby a Member State certifies that an internal combustion engine type or engine family meets the relevant requirements laid down in European Parliament and Council Directive 97/68/EC of 16 december 1997 on the approximation of the laws of the Member States relating to measures against the emission of gaseous and particulate pollutants from internal combustion engines to be installed in non-road mobile machinery are intended to be used for the carriage of goods by road , in the wording in the Commission's Directive 46/EU,
2. an act whereby a Member State certifies that an engine type or engine family as a separate technical unit or a tractor type satisfies the technical requirements set out in European Parliament and Council Directive 2000/25/EC of 22 May 2000 on measures to be taken against the emission of gaseous and particulate pollutants by engines intended to power agricultural or forestry tractors and amending Council Directive 74/150/EEC , in the wording in the Commission's Directive 2004/43/EU, or
3. a procedure whereby an approval authority officially certifies that a type of vehicle, system, component or separate technical unit satisfies the relevant administrative provisions and technical requirements of the Regulation (EU) No 167/2013. Regulation (2015:930).
2 e §/expires U: 2016-01-01/for the purposes of this regulation,
approval authority "means a competent authority of a Member State
responsible for all aspects of the procedure for
the type-approval of an engine or an engine family, which has
authority to issue and revoke certificates of approval
and to manage both the contacts with the approval authorities of
the other Member States, on the one hand, the control of the manufacturer's
measures to ensure the conformity of production;
and
technical service "means an organisation or body that has
appointed to the test laboratory to carry out tests and
inspection for approval authority.

approval authority: a competent authority of a Member State which is responsible for all aspects of the procedure for
the type-approval of an engine or of an engine family, which has the authority to issue and revoke certificates of approval and to manage both the contacts with the approval authorities of the other Member States and the control of the manufacturer's measures to ensure the conformity of production, and
technical service "means an organisation or body that has been appointed to the test laboratory to carry out tests, or as a conformity assessment body to carry out the initial assessment and other tests or inspections, on behalf of the approval authority. Regulation (2015:930).
section 2 (f) for the purposes of this regulation,
"manufacturer" means the natural or legal person who before the
approval authority is responsible for all aspects of
the type-approval process and for the control of
conformity of production, even if that person is not
directly involved in all stages of the engine or
tractor type design,
equipment manufacturers: manufacturer of a type of mobile
machines that are not intended for use on the road, and
small engine manufacturers: manufacturers of engines with
spark-ignition engines whose total annual production amounts to
less than 25 000 engines. Regulation (2013:501).
section 2 (g) for the purposes of this regulation,
placing on the market: that in return for payment or free of charge

distribution or use in the European economic

Emission control requirements
3 §/expires U: 2016-01-01/to a mobile machine which is not intended to be used for

3 section/entry into force: 01/01/2016/A motor in or to a mobile machine which is not intended to be used for transport or a booster in or to a vehicle that is intended to be used for transport, may be placed on the market only if the engine meets the requirements of annex 1 to this regulation and are covered by a valid approval that allows the use of the machine or vehicle.
The first paragraph does not apply to 1. replacement engines, 2. engines that will be used for military purposes, or 3. engines intended for launching or fixation of rescue boats or boats launched from the beach.

3 a §/expires U: 2016-01-01/to a tractor or engine of a tractor shall

4 §/expires U: 2016-01-01/Transportation Board shall fulfil the tasks
approval authority according to Directive 97/68/EC and directive

If the Transport Agency uses a technical service to perform testing and assessment, the technical service shall be appointed and notified under the provisions of the notified bodies in the law (2011:791) on accreditation and technical control.

§ 5/expires U: 2016-01-01/examination of a case of an EC type-approval,

1. the requirements of annex 1 to this regulation,
or
2. the requirements laid down in Directive 97/68/EC for approval of such

Labelling
6 §/expires U: 2016-01-01/the manufacturer shall mark each device manufactured in
compliance with the EC type-approval in accordance with the
procedure laid down in European Parliament and Council directive
97/68/EC of the European Parliament and Council Directive 2000/25/EC.

6 §/entry into force: 01/01/2016 on manufacturers of engines that comply with the requirements of Directive 97/68/EC and are type-approved in accordance with that directive, shall mark any such engine in a way that meets the requirements of article 6 of Directive 97/68/EC.

Fees
§ 9/expires U: 2016-01-01/Transportation Board may provide for fees for the
testing for EC type-approval and the application for exemption and
supervision under section 12 of the Act (1998:1707) on measures against noise
and emissions from non-road mobile machinery and according to regulations

§ 9/entry into force: 01/01/2016/Transportation Board may provide for fees for the
1. test for type approval,
2. the application for exemption, and
