§ 1 If there are funds, State aid in the form of grants
provided pursuant to this regulation to companies in order to
promote efficient and environmentally friendly energy supply,
energy efficiency and to encourage procurement of
more efficient energy technologies.
Support may only be provided in accordance with the conditions laid down in
1. Commission Regulation (EC) No 651/2014 of 17 June
2014 declaring certain categories of aid
compatible with the common market under articles 107 and
108 of the Treaty, or
2. Commission Regulation (EC) No 1407/2013 of 18
December 2013 on the application of articles 107 and 108 of the
the Treaty on the functioning of the European Union on the basis of
less importance. Regulation (2014:1529).
Definitions
section 2 of the terms and expressions used in this regulation were
the same meaning as in the Commission Regulation (EU) no
651/2014.
With technology procurement referred to in this regulation cover a procurement
of products or systems for which the development of new technologies
or of a production process in which the technology being developed is
essential to the client's requirements must be met.

Conditions for refunds and eligible measures
2 a of the Contributions may not be given for an action initiated
before the application for assistance submitted to Government

Technology procurement
section 7 of the contribution to the technology procurement in accordance with the Commission's
Regulation (EC) No 1407/2013 may be provided with not more than 50 per cent
of the extra costs compared with traditional procurement
1. development of requirements specification,
2. testing of the product or system that is procured,
3. evaluation of new product or system solutions
identified in technology procurement, and
4. to examine the technical prerequisites for
meet identified customer requirements. Regulation (2014:1529).
Procedure
section 8 A the grant application must be in writing and submitted to the
The Swedish Energy Agency. The application shall contain
1. information about the company's name, number of employees,
annual turnover and balance sheet total,
2. a description of the project,
3. indication of the project's location and its start and end dates,
4. a list of project costs,
5. indication of the amount of funding needed
the project, and
6. information on whether the applicant has sought or received other
public aid or support from the European Union for the same
eligible costs.
In case of an application for aid under Commission Regulation (EU)
No 1407/2013, it shall also contain a statement of all
other de minimis aid received during the two
previous fiscal years and the current

§ 9 a decision on funding must be reconciled with the conditions
necessary with regard to the grant purposes. As a condition of
contributions shall apply to the beneficiary after the call to
submit a written report for the activities

9 a of the aid under this Regulation may not be paid
to an undertaking which is subject to payment requirements because
by a decision of the European Commission which declares a
the aid illegal and incompatible with the internal market.

section 10 of the Swedish Energy Agency may only pay out grants if
the beneficiary can demonstrate the eligible cost with
detailed documentary evidence.
The Swedish Energy Agency may decide that an aid
shall not be paid if the
1. the applicant for aid by misrepresentation or
otherwise have caused that it supplied incorrectly, or with
for high amounts,
2. the aid for any other reason have been given incorrectly, or
with the high amount and the recipient should have realised it, or
3. the conditions for the aid have not been respected.

Refunds and chargebacks
10 a of the Recipient of assistance under this regulation are
repayment required if any of the grounds listed in section 10
exists.
If a beneficiary is required to repay pursuant to the first
subparagraph, the Swedish Energy Agency decide to fully or
partial claim back the aid. If there are special reasons,
the Swedish Energy Agency may waive the requirement for a refund
in whole or in part. Regulation (2013:28).

section 11 of the 22 a of the Administrative Procedure Act (1986:223) contains provisions

than a decision under section 9 and section 10 shall not, however, be appealed.

Authorization
section 12 of the Swedish Energy Agency may provide for
the information to be provided in the application for assistance and on which
way the data must be submitted as well as the other regulations
necessary for the application of this regulation.

Records and information
12 a of the Swedish Energy Agency shall keep the records referred to
in
1. Article 12 of Commission Regulation (EC) No 651/2014;
and
2. Article 6(4) of Commission Regulation (EU) no
1407/2013.
In case of an application for aid under the Commission's
Regulation (EC) No 1407/2013, the authority shall supply the
information to the company, as is clear from article 6(1) of

Transitional provisions
2002:564
1. This Regulation shall enter into force on 1 October 2003, when
Ordinance (1998:22) on State subsidies to some
investments in the energy sector and the Regulation (1999:344) if
State grants for technology procurement of energy-efficient technologies
and new energy technologies are repealed.
2. The repealed regulations still apply, however, for
applications for grants submitted to the Swedish Energy Agency
before 1 January 2003 in respect of contributions decided by the

2007:153
This Regulation shall enter into force on 1 May 2007. The new
provisions shall be applied for the period from 1
January 2007.

1. this Regulation shall enter into force on 1 January 2013.
2. Older rules still apply for grants
adopted before the entry into force.
