Introductory provisions



section 1 of this Regulation shall apply to aid granted to undertakings in the 1. sector for the production of agricultural products, if the aid concerns activities in primary agricultural production, and 2. the fishery and aquaculture sector, if the aid concerns activities in the production, processing or marketing of fishery and aquaculture products. section 2 of the aid under this Regulation may be submitted with the limitations arising from 1. Commission Regulation (EU) No 1408/2013 of 18 december 2013 on the application of articles 107 and 108 of the Treaty on the functioning of the European Union on de minimis aid in the agriculture sector, and



2. Commission Regulation (EU) 717/2014 of 27 June 2014 on the application of articles 107 and 108 of the Treaty on the functioning of the European Union on de minimis aid in the fisheries and aquaculture sector. Regulation (2015:554).

Total aid



4 § the total aid granted to any one undertaking shall not, during any period of three fiscal years exceed 1. EUR 15 000 of aid to undertakings in the sector for the production of agricultural products, or



2. EUR 30 000 of aid to undertakings in the fisheries and aquaculture sector.



Rules on how to calculate the size of an aid is available in Commission regulations (EC) No 1408/717/2013 and 2014.

§ 5 the total aid granted to companies in the sector for the production of agricultural products may not, during any period of three fiscal years exceed 57 890 000 euros.



The total aid granted to different undertakings in the fisheries and aquaculture sector shall not, during any period of three fiscal years exceed 18 860 000 euros.

Procedure in State aid cases



section 6 Before an aid granted to the company to the body granting the aid, submit a statement about any other de minimis aid received under Commission regulations (EC) No 1408/717/2014, 2013, or other regulations on de minimis aid received during the previous two fiscal years and the current fiscal year. Regulation (2015:554).



paragraph 7 of assistance under this Regulation shall not be granted until the body granting the aid has checked that this will not raise the total amount of de minimis aid received during the relevant period of three years exceeds the amount referred to in paragraphs 4 and 5.



The bodies which grant the aid shall provide the information to the company, as is clear from article 6(1) of Commission regulations (EC) No 1408/717/2013 and 2014.

§ 9 the body granting the aid shall keep the records referred to in article 6(4) of Commission regulations (EC) No 1408/717/2013 and 2014. Regulation (2015:554).
