Scope of application



section 1 of this regulation contains rules which complement

The Hague, 19 October 1996 of the Convention on dagtecknade

jurisdiction, applicable law, recognition, enforcement and

cooperation in respect of parental responsibility and measures for the protection

of children (the 1996 Hague Convention).



Central Authority



section 2 of the Cabinet Office (the Foreign Ministry) is

Central Authority under the 1996 Hague Convention in Sweden.



paragraph 3 of the Central Authority shall assist in the implementation of the 1996

Convention and has the information required for

central authorities of the Convention.



Competent court



section 4 an application referred to in section 6 of the Act (2012:318) of 1996

Convention and which is wholly or in part to a child's

person is made to the District Court, as set out in chapter 21. 1 §

parental code. Regulation (2014:1521).



§ 5 in other cases than those referred to in paragraph 4, an application referred to

in section 6 of the Act (2012:318) on the 1996 Hague Convention to the

District Court in the following list, within whose jurisdiction

the defendant has his domicile. If the defendant is not domiciled

in Sweden, made the application to the Nacka District Court.

Documents



section 6 of the Petitions and messages to the Swedish

the central authority or other authorities shall, if they are not

written in Swedish, be accompanied by a translation in Swedish

or, if it is difficult to achieve such a

translation, a translation into English.

Procedure



section 8 Central Authority shall ensure that requests and

notices under the 1996 Hague Convention, if possible, broadcast

directly to a competent authority without the mediation of

the central authority. Regulation (2014:1521).



section 9 If the central authority receives a request or a

notice under the 1996 Hague Convention concerning a question

to be or can be dealt with by another authority, shall

the central authority shall immediately forward the request or

the message to the authority. The central authority should

notify the sender to what authority port forwarding

have been made. Regulation (2014:1521).
