Fsa Notice (2013:1079) Amending Certain Annuities

The financial supervisory authority has, by virtue of section 2 of the notice

(1967:667) with detailed rules for the application of the law

(1967:663) if added to some traffic annuities and section 2

Regulation (2003:832) if value hedge of certain

compensation annuities, decided on the amendment of certain

annuities as follows.



1. Annuity prompted by an event that occurred prior to

end of 1973:



a) Traffic annuity is reduced by 0.23% (cf. SFS

1967:663).



b) Injury annuity paid for with State funds is lowered

with 0.23% (cf. SFS 1971:14).



c) Other liability annuity than that specified in (a) and

1 (b), on the other hand has been established before 1 January 2004, provided

unchanged (cf. SFS 1973:214). Such annuities that have

established on January 1, 2004 or later are lowered with 0.23

percent.



2. Annuities prompted by an event that has occurred

After the end of the year in 1973, and have established before 1

January 2004:



a) Injury annuity under the Act (1973:213) amending

tort annuities is left unchanged. The same applies to

annuity in accordance with the same law established by dom 1

January 2004 or later, if the judgment at first instance

has been granted before 1 January 2004.



b) those mentioned in 2(a) shall according to section 9 of the traffic damage Act

(1975:1410) also apply in relation to

trafikskade compensation.



3. Annuities prompted by an event that has occurred

After the end of the year in 1973 and have been established on 1 January

2004 or later:



a) Injury annuity under the Act (1973:213) amending

tort annuities are reduced with 0.23%.



b) that referred to in paragraph 3 (a) shall, according to traffic damage Act

(1975:1410) also apply in relation to

trafikskade compensation.
