Regulation (2016:320) On The Protection Of Geographic Information

section 1 of this regulation contains additional rules for the application of the law (2016:319) on the protection of geographic information. The terms used in this regulation have the same meaning as in the Act.



Hydrographic survey



section 2 of the armed forces, the Swedish Maritime Administration and the geological survey may carry out hydrographic survey pursuant to section 3 of the Act (2016:319) on the protection of geographic information. Questions about permission to survey vessel under paragraph 3 and for the cancellation or amendment of a licence pursuant to paragraph 5 of the same law shall be adjudicated by the armed forces. The maritime administration shall provide the armed forces with the information that the armed forces need to be able to assess whether the survey is likely to cause injury to national defence.



section 3 of an authorisation decision to survey or amending such authorisation shall specify who may carry out sjömätningen, the period referred to, the geographical area covered and for which purpose the sjömätningen may be carried out.



Photography or similar registration



section 4 of the Swedish armed forces, Coast Guard, national land survey of Sweden, the Swedish Maritime Administration, the geological survey of Sweden, the Swedish Meteorological and Hydrological Institute, law enforcement and security police may carry out photography or similar registration from the aircraft in accordance with section 6 of the Act (2016:319) on the protection of geographic information.



Questions about permission to such registration shall be adjudicated by the armed forces.



paragraph 5 of the decision on authorisation to photography or similar registration from the aircraft shall specify who may conduct the shoot or the registration, the period referred to, the geographical area covered, and for what purpose the shoot or the registration may be made.



Dissemination



section 6 of the armed forces, the national land survey of Sweden and the Swedish Maritime Administration must disseminate compilations of spatial information in accordance with section 9 of the Act (2016:319) on the protection of geographic information.



Questions about permission to dissemination of compilations of geographic information will be reviewed by the



1. Maritime Authority in the case of information referred to in section 9, first paragraph 1 the same law, and



2. the national land survey of Sweden in the field of information as referred to in section 9, first subparagraph 2 of the Act.



section 7 of the defence forces shall provide the maritime administration, and the national land survey of Sweden with the information they need in order to assess whether the spread is likely to cause injury to national defence. The defence forces shall consult with the security police before the data is submitted.



If the Swedish civil contingencies Agency has information that may be relevant for the assessment, the Agency shall also provide such information to the maritime administration and the national land survey of Sweden.



section 8 Provisions on the obligation of the County Administrative Board to inform the military about the decision on the object of protection under the second or third subparagraph of paragraph 7 Protection Act (2010:305), see protection Regulation (2010:523).



section 9 with international commitments in paragraph 10 2 Act (2016:319) on the protection of geographic information referred to 1. the Treaty of observationsflygningar of 24 March 1992 (SUN 2002:61),



2. the Vienna document on confidence-and security-building measures, and



3. the document on global information delivery on 28 november 1994.



Monitoring



section 10 of the Finnish defence forces and the Finnish maritime administration shall provide the coast guard with the information that the coast guard needs to fulfil its tasks in relation to hydrographic survey pursuant to section 1 of the Act (1982:395) if the Coast Guard's participation in police surveillance.



Appropriations



section 11 of the armed forces, the Swedish Maritime Administration and the national land survey may provide for the enforcement of the law (2016:319) on the protection of geographical information regarding the application process with the respective authority.



section 12 of the defence forces may provide for exceptions from the requirement for a licence pursuant to paragraph 3 of the sjömätnings Act (2016:319) on the protection of geographic information.



The Swedish Maritime Administration and the national land survey of Sweden shall, each within its area of responsibility, provide for exemption from licensing pursuant to paragraph 9 of the same law for the compilation of geographical information concerning certain geographical areas or that are designed so that they are not likely to cause injury to the total defense if they spread. The regulations shall specify how compilations in such cases should be designed.



The Swedish Maritime Administration and the national land survey of Sweden shall consult the armed forces before regulations are announced. Sweden should also consult with the security police.



paragraph 13 of the maritime authority and the national land survey of Sweden may, upon compliance with the third paragraph of section 9 of the Act (2016:319) on the protection of geographic information, perform the actions in a compilation of spatial information needed in order to be able to announce a State.
