Introductory provisions



The law's content and purpose



paragraph 1 of this law provides for study-start support, which is a government financial aid.



The purpose of the Act is to increase recruitment for studies among people with a high training needs, to enhance their ability to establish themselves in the labour market.



Study start support may be provided to the extent that the availability of funds.



Recruitment for studies



section 2 of the Study-start support is a tool that municipalities can choose to use in the context of its responsibilities under Chapter 20. 10 and 17 of the Education Act (2010:800) to recruit people to the studies.



A municipality's recruitment efforts under this law shall be carried out in co-operation with the employment service. The municipality shall, in close cooperation with arbetsförmedlingen adopt guidelines for the recruitment process, after having sought the views of the insurance fund and local representatives of the social partners and public education.



The price base amount



section 3 Of the price base amount specified in this law and in the regulations issued in connection with the Act, the price base amount in accordance with Chapter 2. 6 and 7 of the social code.



Target group



Training needs



section 4 Study start assistance may be provided to those who have short training and a great need for education on basic or secondary level to be able to establish themselves in the labour market. Additional terms and conditions for a student to be considered to belong to the target group for support is available in 5 and 10 sections.



Age



paragraph 5 of the Study-start support may be provided from the calendar year in which the student reaches the age of 25 years and until the calendar year in which the student reaches the age of 56 years.



Job seekers



section 6 of the Study-start support may only be provided to the person who is registered as a jobseeker with the public employment service.



The Government or the authority that the Government can, with the support of Chapter 8. section 7 of the Constitution notify additional regulations on which job seekers support may be provided.



Recruitment requirements



section 7 of the Study-start support shall not be provided to the who within the last three years prior to the start of the period of study launch aid has a financial aid in accordance with the study support Act (1999:1395).



Paid annual amounts and recover financial aid



section 8 a student who last three years prior to study inception has a financial aid in accordance with the study support Act (1999:1395) can be granted study start aid only if the student has



1. paid fixed annual amounts pursuant to Chapter 4. section 7 of the study support Act, which is to be paid prior to the calendar year study start aid is intended, and



2. paid back as much of the recovered the aid referred to in Chapter 5. study support act to not more than one calendar half year recovered the aid still to pay.



If there are serious reasons, may study launch aid despite the provisions of the first subparagraph.



Citizenship



9 § Study launch aid can be given to students who are Swedish citizens. The foreign citizen who is entitled to financial aid in accordance with the provisions of Chapter 1. 4-6 §§ study support Act (1999:1395) or the regulations issued in connection with those provisions shall be equated with Swedish citizens also when it comes to study-start support.

Study launch aid can be given to students who are not Swedish citizens, if they fulfil the conditions for obtaining student aid referred to in Chapter 3. paragraph 4 of the second to fourth paragraphs study support Act (1999:1395) or the regulations issued in connection to those provisions.

Study launch aid can be given to students who are not Swedish citizens, if they fulfil the conditions for obtaining student aid referred to in Chapter 3. paragraph 4 of the second to fourth paragraphs, or 4 a of study support Act (1999:1395) or the regulations issued in connection to those provisions. Law (2017:581).



Other prerequisites for study-start support



Training aid may be given for



section 11 of the Government, with the support of Chapter 8. section 7 of the Constitution provide for the educational institutions for which a training study-start support may be provided.



Scope of studies



12 § Study-start support may be provided for each week that the students pursuing studies at least half-time. The studies, however, have to last for a continuous period of at least three weeks.



Study launch aid may be given only such part of the study period covered by the syllabus or equivalent applicable to education.



13 § Study launch aid is determined in relation to the scope of the studies. For students not pursuing full-time studies provided study-start support with 1. fully 75 percent of support in studies of at least 75% but less than 100 per cent of full time, or



2.50% of full support in studies of at least 50% but less than 75% of full time.



Study launch aid without consideration of study results



section 14 To the who for the first time applying for study-start support, aid be provided without prior examination of the student's previous academic performance.



Study start support with consideration of study results



15 § in cases other than those referred to in section 14 shall examine the results of the previously granted study launch aid. Study launch aid can be given to a student who pursued his studies at a normal pace.



Study launch aid can be given even if the student does not have pursued their studies in a normal pace in the case study results from periods of study launch aid that is older than ten years, or if there are special reasons for it.



The Government or the authority that the Government can, with the support of Chapter 8. section 7 of the Constitution provide for what that should be considered as studies at a normal pace.



Time trial start support is provided for



section 16 of the Study-start support may be provided for a maximum of 50 weeks of full-time study.



Studies on a part-time basis will receive study-start support is provided for a maximum of 1. 67 weeks in studies of at least 75% but less than 100 per cent of full time, or



2.100 weeks in the case of studies of at least 50% but less than 75% of full time.



Calculation of study start support



Study start aid



section 17 Study-start support may be provided in an amount for each week is equal to



1.4.75% of the price base amount for full-time study,



2.3.56% of the price base amount for studies of at least 75% but less than 100 per cent of full time, and



3.2.38% of the price base amount for studies of at least 50% but less than 75% of full time.



This applies only subject to paragraphs 19 to 23.




The additional contribution



section 18 in addition to the amount of compensation arising from section 17 may study launch aid provided in the form of additional contributions to the students who have custody of children. Such grants may be submitted up to and including the calendar half-year the child turns 18. For each child, up to a maximum of an additional contribution equivalent studiebidraget at full-time education under Chapter 3. section 12 of the study support Act (1999:1395).



When calculating the amount of the supplementary premium referred to in the first subparagraph and in the allocation of the additional contribution if both parents are studying, the regulations issued in connection with Chapter 3. 13 b of the study support Act also apply when it comes to study-start "aid in the form of premium supplements.



Income assessment



section 19 of the Study-start support may be provided with the full amount only if the student's income in a calendar half year does not exceed a certain amount (amount).



20 § in studies about 20 weeks during a six-month to free amount equivalent to



1.160% of the price base amount for full-time study,



2.200% of the price base amount for studies of at least 75% but less than 100 per cent of full time, and



3.240% of the price base amount for studies of at least 50% but less than 75% of full time.



In other cases, the free amount of share of the price base amount be increased or decreased for each week that the study period is shorter or longer than 20 weeks with 1. 8 percentage points for studies on a full-time basis, 2. 6 percentage points in the case of studies of at least 75% but less than 100 per cent of full time, and



3.4 percentage points for studies of at least 50% but less than 75% of full time.



section 21 Of the student's income is higher than the estimated free amount under section 20, the amount that may be provided under section 17 of the first subparagraph shall be reduced by 52 per cent of the excess income.



section 22 As the student's income during a six-month according to § 19 is considered as relating to the half of the student's surplus in service trade income and capital, beaten by decision if the final tax for a calendar year.



The Government or the authority that the Government can, with the support of Chapter 8. section 7 of the Constitution provide for how the income to be calculated for students who are not taxed for their main income in Sweden.



A decision on the start of study support must be based on the statement of estimated income that the students provide in the application for study-start support.



section 23 of the Study-start support shall not be granted, if the amount per week equal to or lower than 0.25% of the price base amount.



Study start support during illness and holidays



section 24 of the Government, with the support of Chapter 8. section 7 of the Constitution provide that aid may be submitted for study start time when the student is ill.



The Government or the authority that the Government can, with the support of Chapter 8. section 7 of the Constitution provide for that study-start support also may be made by leave



1. for the temporary care of children,



2. for families, or



3. in connection with a child under the age of 18 have died.



The Government, with the support of Chapter 8. section 7 of the Constitution provide for that study-start assistance in case of illness or such leave provided for in the second subparagraph may be included in the number of weeks of study start at most may be submitted for support under section 16.



Coordination with other benefits section 25/expires U: 2018-01-01/

If a person who has the study start support then granted funding under Chapter 3. study support Act (1999:1395), study-start support is not provided or received for the period for which it is submitted. In addition, the study start aid not be provided or received for the duration of the study referred to in Chapter 3. 25 § 1 – 7 of the first paragraph and the second and fourth paragraphs study support act must not be left.



For the supplementary premium, it is provided pursuant to section 18 of this Act and the additional allowance may be provided for the same child, and for the same time period, according to the study support act should the contributions be coordinated so that a maximum of an additional contribution provided under both acts for the same time period.



section 25/entry into force: 2018-01-01/

If a person who has the study start support then granted funding under Chapter 3. study support Act (1999:1395), study-start support is not provided or received for the period for which it is submitted. In addition, the study start aid not be provided or received for the duration of the study referred to in Chapter 3. 25 section 1-6 and the second and fourth paragraphs study support act must not be left.

Recruitment work, filing, decision and payment



Recruitment process and application



paragraph 26 of a municipality which chooses to use study-start aid shall, in accordance with the guidelines for the recruitment process which the municipality has adopted pursuant to article 2 of the second paragraph, calling on people in the municipality, the municipality thinks can be assumed to belong to the target group of the aid and that the municipality considers are priority, to apply for aid. Such an application, the applicant shall submit to the municipality.



The municipality's trial



section 27 of the municipality, to the examination of an application under section 26 of the assessment if the applicant belongs to the target group of study launch aid provided for in paragraph 4, first sentence, and paragraph 5. If the municipality at its trial judges that the applicant does not comply with these terms, or if an application received by the municipality without the individual being asked to apply in accordance with section 26 of the municipality shall reject the application.



If the local authority when examining the first paragraph determines that the applicant meets the conditions, the municipality shall submit its decision together with the applicant's application to the CSN.



Central Student Grants Committee's review



section 28 If a municipality has decided that an applicant meets the conditions laid down in paragraph 4, first sentence, and paragraph 5, CSN examine other opportunities to study launch aid can be granted in accordance with this Act and the regulations issued in connection with the Act.



Payment of study start support



section 29 of the CSN may pay study launch aid only if it is established that the student conducts the studies that aid has been granted.



Study launch aid is forfeited, if the student does not within one month from the start of the period of study launch aid has demonstrated that he or she


conducts studies. Corroborated this latter, the study start aid yet is paid, if there are special reasons.



Study launch aid is forfeited if the student dies before classes start the aid has been paid.



Appeal



section 30 in respect of an appeal of a municipality's decision pursuant to section 27 provides in Chapter 10. Local Government Act (1991:900) of legality.



Central Student Grants Committee's decision in the cases of study launch aid may be appealed to the Board of appeal for student aid. Central Student Grants Committee's decision should take effect immediately unless CSN determines otherwise. If a decision is appealed, the Appeal Board may decide that it shall not be applicable until further notice.



The Board of Appeal's decision on an appeal which may not be appealed.



Obligation to provide data



Obligation for public authorities



section 31 of the Government or the authority, the Government can decide on the basis of Chapter 8. section 7 of the Constitution provide that other government departments will be required to leave the CSN or the Board of appeal for student aid the information relevant for the purposes of this Act and the regulations that have been issued in connection with the Act.



Obligation for educational institutions



32 § Government or authority that the Government may provide for an obligation of educational institution to CSN shall provide the information relevant for the purposes of this Act and the regulations that have been issued in connection with the Act.



The Government may provide for an obligation of educational institution to the Board of appeal for student aid shall provide the information relevant for the purposes of this Act and the regulations that have been issued in connection with the Act.



Obligation to provide for the student



33 § a student who has been granted study launch aid going to CSN to notify such a change in their circumstances that are relevant for the right to study-start assistance or aid.



The Government or the authority that the Government can, with the support of Chapter 8. section 7 of the Constitution provide for a student's obligation to the CSN shall provide the information relevant for the purposes of this Act and the regulations that have been issued in connection with the Act.



Repayment, interest and fees



34 § Study launch aid paid improperly or with excessive amounts are to be recovered. The provisions on recovery, interest, taxes and depreciation in Chapter 5. 1, 2 and 4-6 §§ study support Act (1999:1395), the provision for repayment of financial aid not used in Chapter 6. paragraph 2 of the same law and regulations issued in connection to those provisions shall also apply when it comes to study-start support.



Follow-up and evaluation



35 § CSN should monitor and evaluate the municipality's recruitment efforts in accordance with this Act.



A municipality which chooses to use study-start aid must document its recruitment efforts in accordance with this Act and provide information on the recruitment process for CSN needed for follow-up and evaluation.



The Government or the authority that the Government can, with the support of Chapter 8. section 7 of the Constitution provide for the dossiers to be made and the information to be provided in accordance with the second subparagraph.



Other provisions



Special rules about study start support



section 36 the following provisions concerning financial aid for students in the study support Act (1999:1395) should also be applied when it comes to study-start support:



– Chapter 5. 6 a section if the obligation to provide a statement of the address,



– Chapter 6. section 1 of the application of the law (1969:93) on the limitation of social support in the labour dispute;



– Chapter 6. section 3 of that claim on the student financial aid cannot be transferred and cannot be recovered,



– Chapter 6. 3 a § to CSN in certain circumstances may decide that aid shall be withheld or be left with a lower amount until a final decision on entitlement to aid has been taken,



– Chapter 6. § 5 If the rounding of amounts, and



– Chapter 6. section 12 if the limitation period of a claim relating to the recovery of the aid.



Fees for administrative costs



37 § Government may provide for that CSN may charge fees for their administrative costs associated with recovery of study launch aid.



Additional regulations



38 § Government or authority that the Government can, with the support of Chapter 8. section 7 of the Constitution notify additional regulations on the application of this law.
