section 1 of this regulation is notified pursuant



– 47 § electrical safety Act (2016:732) in the case of 3-20, 23 and 24 sections and 33 § 1, 2, 4 to 9, 11 and 12, – Chapter 8. section 11 of the Constitution concerning 33 § 3 and 10, and



– Chapter 8. section 7 of the Constitution in respect of the other provisions.



section 2 of the terms of this regulation have the same meaning as in the electrical safety Act (2016:732).



Notifications in respect of electrical installations



section 3 of The who intends to build a power plant for a voltage not exceeding 1 000 volts between phase conductors shall notify that fact to the holder of such an already existing power plant referred to in paragraph 11 of the electrical safety Act (2016:732), unless it is clear that there is no such advocacy connection referred to in that paragraph.



4 § The intending to take a contact line for train, tram, Metro or trolleybus operation in use shall notify this to the electrical safety authority.

Operating permits for electrical installations

Safety requirements for electrical equipment

17 § Technical measures must be taken to protect against hazards caused by electrical equipment so that



1. persons and domestic animals are adequately protected against danger of physical injury or other harm which might be caused by direct or indirect contact with live parts,



2. it can't occur temperatures, arcs or radiation which can cause hazard,



3. persons, domestic animals and property are adequately protected against risks of non-electrical nature but that experience can be caused by electrical equipment, and



4. the isolation of electrical equipment is adapted to the conditions of overload.



section 18 of the Technical measures shall be taken for the protection against risks caused by external influences on the electrical equipment so that the equipment



1. comply with the who at the mechanical impact can reasonably be expected of the equipment in question if that persons, domestic animals and property are not endangered, 2. in the environment where it can be anticipated that the equipment will be used to resist non-mechanical effects to such an extent that persons, domestic animals and property are not endangered, and



3. shall not endanger persons, domestic animals and property in danger during such overload conditions or set which can be foreseen.



Presumption of conformity with the safety requirements



19 § unless otherwise shown, an electrical equipment shall be deemed to comply with the safety requirements of this regulation when the equipment is carried out in accordance with a harmonised standard as defined in article 2(1)(c) of European Parliament and Council regulation


(EU) No. 1025/2012 of 25 October 2012 on European standardisation, amending Council Directive 89/686/EEC and 93/15/EEC and European Parliament and Council Directive 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC, repealing Council decision 87/95/EEC and European Parliament and Council decision 1673/2006/EC , or, when such standard is missing, according to any other technical specification as specified in the regulations as Electrical Safety Authority has announced and is applicable to the equipment.



Market access for electrical equipment



section 20 of an electrical equipment may be placed on the market or put into service only if 1. the equipment complies with the safety requirements under this regulation or regulations issued pursuant to that regulation, and



2. the procedure for the assessment and validation of compliance National Electrical Safety Board has announced regulations on with the support of 33 § 5 have been complied with.



Provisions concerning electrical equipment in administrative action



section 21 in respect of special protection and safety aspects, there are also provisions concerning electrical equipment in



– Act (1992:1512) on electromagnetic compatibility,



– Act (1993:584) on medical devices, and



– Act (2011:579) on the safety of toys.



section 22 in respect of electrical equipment which is intended for consumers or likely to be used by consumers, there are also provisions in the product safety Act (2004:451).



Application for authorisation



section 23 of the applicant for authorisation as electrical contractor shall pay an application fee to the supervisory authority.



section 24 of the terms of the application fee will be 10-14 § § fee Regulation (1992:191) and fee class 3 shall apply.



Notifications regarding electrical installation work on other people's sites



section 25 of an electrical installation company notification pursuant to section 25 of the electrical safety Act (2016:732) shall include information on the 1. the types of electrical installation works that question, 2. electrical installation company's business name, registration number and shape,



3. electrical installation the company's postal address,



4. electrical installation company contact person,



5. electrical installation company's Web address, if the electrical installation company has a website,



6. addresses of electrical installation all the company's establishments in Sweden, and



7. the name and social security number in the case of an authorized electrical installer in accordance with section 23 of the electrical safety act.



Register



section 26 of the National Electrical Safety Board shall keep records of authorised installers according to section 20 of the electrical safety Act (2016:732).

The register shall contain the particulars of every authorized elinstallatörs name, personal identity number and residential address. If elinstallatören does not have a social security number, the registry instead contain the elinstallatörens date of birth.



section 27 of the National Electrical Safety Board shall keep records of the electrical installation company that has made a notification according to paragraph 25 of the electrical safety Act (2016:732). The register shall contain the information that the notification shall include, according to article 25 of this regulation.



paragraph 28 of the decision prohibiting the continued operations, warning and restriction or revocation of the authorisation shall be recorded in the register.



section 29 of the registers shall be arranged so that it makes it easier for anyone who wants to hire an electrical installation company to get access to information about the company that carries out which kind of works under controlled conditions such as electrical safety Act regulations if the self-inspection program and authorization.



The register of electrical installation company should appropriately be kept available at the electrical safety authority's website.

Information on the social security number, date of birth and residential address shall not be available on the website.



section 30 of the Electrical safety authority is responsible for the processing of personal data in the registry.



section 31 of the provisions of the data protection Act (1998:204) for the rectification and indemnity shall apply to the processing of personal data pursuant to this regulation.



Obligation to notify changes



32 § an electrical installation company as the subject of a notification under section 25 of the electrical safety Act (2016:732) to notify any change of the information provided under paragraph 25 of 1, 4 and 7 of this Regulation shall be included in the notification.



Appropriations



33 § national electrical safety Board may announce 1. regulations on nature, placement, testing, control, inspection, operation and maintenance of electrical power plants and electrical equipment intended to be connected to a power plant, and if work on or in connection with such facilities and equipment,



2. regulations on State duty in accordance with the electrical safety Act (2016:732) or this regulation and what an application for a permit shall include,



3. additional regulations on notifications in case of electrical installation work,



4. regulations on other notification requirements under the electrical safety act or this regulation and what a notification shall include,



5. regulations on safety requirements for electrical apparatus pursuant to §§ 16-18 electrical safety Act, 6. provisions on the obligations concerning information that should accompany the electrical equipment,



7. regulations on obligations that, in the case of electrical equipment take loss prevention and take measures when there is reason to assume that such equipment does not conform to the safety requirements,



8. regulations concerning the training and practical experience necessary to become certified as electricians, 9. regulations on the types of electrical installation work that authorisation may be given under section 20, second paragraph the electrical safety Act and the notification can be made under section 25 of the electrical safety Act,



10. regulations regarding what an application for authorisation as electrical contractor shall contain,



11. regulations on what a self-inspection program pursuant to section 24 of the electrical safety act should contain, and



12. regulations on the remuneration of the outlet sample according to § 39 electrical safety Act and on the obligation to pay the cost of the test.



34 section Before the Swedish National Electrical Safety Board Announces rules 33 § 1, the authority shall hear the Swedish Transport Agency, if the regulations apply



1. overhead lines of strong current within an area for public or private road,



2. overhead power lines for the strong current in the area of rail transport, or



3. overhead power lines for the strong current in the vicinity of airports.



When it comes to overhead lines of strong current or starkströmsledningar in water in areas of maritime traffic, the authority shall instead hear the maritime administration, and, in the case of overhead power lines in the vicinity of military airports, the armed forces.




35 § national electrical safety Board may provide for derogations from the



1. the requirements of paragraphs 16 to 27 electrical safety Act (2016:732) and 4, 5 and 7 of the first paragraph, section 11 and section 12 of this regulation that there are special reasons for, and



2. the requirements of paragraphs 14-20 this regulation are in accordance with the agreement on the European economic area and that there are particular reasons for.



36 § Transport Board may provide for 1. exemption from section 11, second subparagraph, and



2. the fees for the examination of an application for an exemption under section 11, second paragraph.



section 37 to prevent personal injury or property damage due to power or risk of obstruction to traffic, the armed forces provide for notification of the intention to begin wiring in an area held by the armed forces, the Swedish defence materiel administration or national defence radio establishment.



Dispensation



38 § national electrical safety Board may, in the particular case waive



1. the requirements of paragraphs 16 to 27 electrical safety Act (2016:732) and 4, 5, 7 and 8 of the first paragraph, section 11 and section 12 of this regulation, if there are special reasons, and



2. the requirements of paragraphs 14-20 this regulation, if it is consistent with the agreement on the European economic area and there are special reasons.



The Transport Board may, in the particular case waive paragraph 11.



Supervision



39 § National Electrical Safety Board is the supervisory authority under § 36 Electrical Safety Act (2016:732).



40 of the National Electrical Safety Board's market surveillance authority according to European Parliament and Council Regulation (EC) no 765/2008 of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93 in the case of electrical equipment covered by 1. European Parliament and Council directive 34/EU of the European Parliament of 26 February on the harmonisation of the laws of the Member States concerning equipment and protective systems intended for use in potentially explosive atmospheres, in the original wording, and



2. European Parliament and Council Directive 2004/35/EU of 26 February on the harmonisation of the laws of the Member States relating to the making available on the market of the electrical equipment, in the original wording.



The electrical safety authority to be at the market check perform the tasks arising from article 18(2), 20-22, 23(2), 24(2) and 24(4) of Regulation (EC) no 765/2008.



section 41 national electrical safety Board shall inform the European Commission and the other Member States of



1. electrical equipment that does not comply with the applicable requirements, if the Swedish National Electrical Safety Board considers that non-compliance is not only valid in Sweden, and notification shall inform whether the non-compliance, evaluation results, decisions made and any comments from the decisions made against,



2. the measures that the Swedish National Electrical Safety Board has taken in response to information that another Member State has submitted a corresponding way as in 1, and



3. electrical equipment which, although complying with the applicable requirements, are assessed to pose a risk, and notification shall provide all available details.



42 § national electrical safety Board should



1. when it is justified, for Sweden's objection to a decision that a market surveillance authority in another Member State has taken on electrical equipment, and promptly inform the European Commission, other Member States and the Government of the objection and the reasons for it, and



2. participate in consultation between the Commission and the other Member States



(a)) when the European Commission has assessed such decisions and objections referred to in 1 or resulting from objections from another Member State, or (b)) by reason of electrical equipment which, although complying with the applicable requirements, are assessed to pose a risk.



Responsibility



section 43 of the 49 § 4 the electrical safety Act (2016:732) provides for punishment in case of violation of 14, 15, 16, 17, 18 or 20 of this regulation, or in violation of regulations that have been issued with the support of 33 § 5, 6 or 7 of this regulation.



Appeal



section 44 in 22 a of the Administrative Procedure Act (1986:223) provides for appeal to the administrative court. Other decisions than decisions on operating licences in accordance with paragraphs 7 and 8, the decision on the obligation to make changes by starkströmsledningar according to paragraphs 9 and 10, the decision on compensation in accordance with regulations issued under section 12 and 33 decisions on waivers under section 38 shall not, however, be appealed.



Transitional provisions



2017:218



1. This Regulation shall enter into force on 1 July 2017.



2. The regulation repeals a) elinstallatörsförordningen (1990:806)



(b)) Regulation (1993:1068) on electrical equipment, and



c) power Regulation (2009:22).



3. with the support of the older regulations have received permission to electrical contractor for the purposes of this regulation, shall be deemed to be authorized under section 20 of the electrical safety Act (2016:732).
