Energy, gas and petroleum products, as well as CO2 emissions avoided with such savings, can be accounted for in the fulfilment of national targets, resulting in a reduced additional effort that has to be achieved in subsequent years and, in short, an improvement in the competitiveness, thus deepening the basic principles on which the respective sectoral laws on electricity and hydrocarbons are based, and on which the savings reported by the administrations are accounted for. According to the fourth additional provision of Royal Decree 1085/2015 of 4 December 2015 for the promotion of Biofuels, autonomous communities and local authorities have an obligation to report annually, before 31 December. December of each year, to the Ministry of Energy, Tourism and Digital Agenda, on energy savings and emissions of avoided carbon dioxide, derived from actions in the field of energy saving and efficiency promoted by the community local authority or entity and carried out in the field of its territory and its municipality respectively. Because the information concerning the year 2015 has not yet been sent to the Ministry of Energy, Tourism and Digital Agenda, exceptionally and only for this year, it is established in this order that such information can be received until on 31 March 2017.

Considering the above, resolve:

First. Object.

The purpose of this order is to determine the form, content and breakdown of the information submitted by the autonomous communities and local authorities to the Ministry of Energy, Tourism and Digital Agenda, on all those initiatives in the field of energy saving and energy efficiency corresponding to programmes or initiatives implemented under Directive 2012/27/EU, in compliance with the fourth additional provision of Royal Decree 1085/2015 of 4 December 2015, promotion of biofuels.

Second. Procedure for sending information.

1. In accordance with the fourth additional provision of Royal Decree 1085/2015 of 4 December 2015 on the promotion of Biofuels, the competent bodies for the energy efficiency of the autonomous communities and local authorities should send to the Ministry of Energy, Tourism and Digital Agenda, by 31 December each year, information on energy savings and avoided carbon dioxide emissions, resulting from actions in the field of savings and efficiency energy carried out in the previous year in the field of its territory and its municipality respectively. The information relating to the year 2015 shall be submitted by 31 March 2017.

2. The communications of the autonomous communities and local authorities to the Ministry of Energy, Tourism and Digital Agenda, relating to the procedure provided for in this order, shall be carried out by electronic means.

For the submission of information, access to the web application will be available in the "Electronic procedures and services" section of the electronic headquarters of the Ministry of Energy, Tourism and Digital Agenda, accessible through of the Ministry's website (www.minetad.gob.es).

You must complete the form whose template will be available in the aforementioned electronic headquarters. This web application ensures the interoperability and security of each Public Administration's systems and ensures the protection of personal data.

3. The administrative notifications that need to be made to the Autonomous Communities and local entities by the Ministry of Energy, Tourism and Digital Agenda, will be carried out by the same conduit through which the communications were received, in the terms provided for in Law 40/2015 of 1 October 2015, of the Public Sector Legal Regime.

Third. Form, content and breakdown of the information to be submitted.

1. The autonomous communities and local authorities shall transmit the information concerning their energy saving and energy efficiency programmes and initiatives of the previous year, with the breakdown set out in the tables set out in the Annex to this Regulation. order.

2. The information shall be provided through the procedure set out in the second paragraph of this order and shall ensure that the following guidelines are applied:

a) The calculation methods for determining energy savings will be ex ante (expected savings) or ex post (measured savings), with the possibility of determining savings on the basis of estimates engineering to replace the actual measurements (weighted savings), or on the basis of surveys or price elasticity studies, in the case of savings resulting from changes in the behaviour of consumers in the face of certain measures for communication, training and information, or even for tax purposes (savings observed). The calculation methods shall be used in accordance with the provisions of Directive 2012/27/EU of 25 October 2012 on energy efficiency (Annex V)

(b) The information will be provided for each of the lines of action of the programmes and initiatives in the field of energy saving and energy efficiency, which must be identified clearly and with precise references to the administrative provisions for which they are approved, while stating that they have been approved under the provisions of Directive 2012 /27/EU.

(c) They must include the precise references to the period of validity of the line and the investments mobilised, as well as, where appropriate, to the public budgets committed in each of the actions.

d) Savings should be provided on an annual basis, starting on 1 January 2014, with an express indication of the useful life of the actions that enable the savings to be made, so that the annual savings can be easily translate into accumulated savings that can be compared to the cumulative savings target set out in Article 7 of Directive 2012/27/EU and communicated by Spain to the European Commission in the National Efficiency Action Plan Energy 2014-2020.
