5. Requirements for access to the theoretical knowledge examination

The requirements to be met by applicants for the examination of theoretical knowledge at the beginning of each cycle are those set out in the Guide and must be checked with prior character, and when necessary certificates by the Head of examinations of each ATO and/or Registered Training Centre.

6. Venues and dates for exams

6.1 Applicants will be able to access the exam as soon as they meet the requirements set out in the standard, and at the discretion of the ATO and/or the Registered Training Centre, taking into account the progression of the applicant, the time limits and terms referred to in the regulations.

6.2 Each year, an information note with the venues and dates corresponding to the next year's calls will be published on the AESA website during the month of November.

6.3 The time period required to carry out the examinations for which the pupil has been registered shall be understood for a session, which may in no case exceed 10 working days from the first examination, agreement with the electronic exam schedule. If you are not able to carry out the tests in the ten-day period, you will need to register again and take another session. The venues should be aware that the session will end on the last scheduled day at that venue, regardless of the selection of the first exam date.

7. Test development

7.1 Electronic theoretical examinations for the obtaining of the title and the pilot's license for air transport (ATPL), commercial pilot (CPL), instrument flight rating (IR) and (EIR), as well as the corresponding Professional pilot bridge examinations shall be presented only in the English language.

7.2 The tests will be developed as set out in the Guide. Prior to the commencement of the examination, applicants shall be identified only by the original and in force with which the ATO and/or the Registered Training Centre has registered them, as follows:

• National aspirants: DNI, NIE, passport or driver's license, all within their period of validity.

• Non-national aspirants: Passport, resident card, or NIE, in the latter case, if the NIE lacks photography, the passport will be required.

7.3 Non-submission to examination will result in the counting of the session and the loss of the corresponding fee, but will not be taken into account for the purposes of accounting in each cycle the number of attempts made for each subject.

7.4 The watchman or watchdogs appointed for each exam session will be responsible for the order and discipline within the exam room and will have the status of authority, being able to make the necessary decisions.

8. Test result

8.1 At the moment of finishing the test type test, the application will print 2 sheets, one in order to collect the signature of acceptance of the test and one with the result obtained. Once signed the first one will be handed the second to the aspirant.

8.2 If the test result is "fit", it will be permanently in character and will be automatically dumped in the IT application of the AESA Licensing Department, to complete the applicant's note case to the obtaining the corresponding licenses.

8.3 If the result of the test is "unfit" but the applicant has made observations that may affect the change of qualification, the result of the test will be provisional, and these tests will be reviewed by technical experts in the field. After the review of the examination is completed, the interim result will have the final result status, whether the note has varied or not.

9. Resources

Against this Resolution, which puts an end to the administrative route, it is possible to institute, on a potential basis, an appeal for replacement in the cases referred to in Article 1112.1 of Law 39/2015 of 1 October 2015. Joint Administrative Procedure of the Public Administrations, before the Director of the State Aviation Safety Agency, a body competent to resolve the matter within one month from the day following the notification of this act, in accordance with Articles 123 and 124 of the same Law.

2.1 Submission applications will be made by the Approved Training Organization (ATO) and/or Registered Training Center as set out in the Guide.

The former Centers registered before April 8, 2013, who have requested to be able to present applicants for Private Pilot exams, will be able to enroll in the presentation of electronic exams to applicants who as such have been discharged from the electronic examinations database. It is recalled, on the other hand, the deadline of 8 April 2018 for the conclusion of the training and tests provided for in Article 10a (3) of Commission Regulation (EU) 1178/2011 of 3 November 2011.

2.2 The form of printed form 791 of the fee corresponding to the twenty-eighth rate of Article 22 of Law 66/1997, of December 30, of Administrative Tax Measures and of the Social Order, must be completed, refers to the Resolution of 19 December 2008 by the Directorate of the State Aviation Safety Agency, which establishes the procedure and conditions for payment through the collection and management entities of the State. 2.3 The self-validation section of the application (model 791) will indicate the name of the school, qualification or qualification to which it aspires, as well as the subjects to which it is presented. The amount of the fee for the examination rights shall be entered in the box for which the fee is assigned, and the corresponding income shall be made in any of the Banks, Savings Banks, or Credit Unions that have recognized the status of collaborating entities in tax collection.

The payment of the fee may also be carried out by the system of telematic payment of fees in accordance with the provisions of Order HAC/729/2003 of March 28, establishing the assumptions and general conditions for the payment by telematics of the fees that constitute resources of the General Administration of the State and its Public Bodies, in the Resolution of 16 June 2005 of the Secretariat of the Ministry of Public Works, for which the the procedure for the submission of the reverse charge and the conditions for payment by means of telematic different fees for the Ministry of Public Works, and in the Resolution of 16 March 2006 of the Sub-Secretariat for Public Works, which extends the scope of the aforementioned Resolution of 16 June 2005. 3. Presentation of documentation

The shape and place for the presentation of the documentation required for the access to the electronic knowledge-based examination system will be presented as set out in the Guide.

4. Test Officer

4.1 The exam officer will be the person appointed by the ATO and/or Registered Training Centre to carry out all the activities related to the theoretical knowledge examinations of his/her students. This person will also be responsible for maintaining the contact required with EASA.
