Organic Law 15/1999 of 13 December on the Protection of Personal Data and its Implementing Regulation, approved by Royal Decree 1720/2007 of 21 December, sets out a set of measures to ensure and to protect, as regards the processing of personal data, public freedoms and the fundamental rights of natural persons and, in particular, the right to their personal and family honour and privacy.

Article 20 of Organic Law 15/1999, of December 13, states that the creation, modification or deletion of the files of the Public Administrations may be made only by means of a general provision published in the "Official State Gazette" or in the official journal concerned.

Article 53.1 of the Implementing Regulation of the Organic Law 15/1999 of 13 December, approved by Royal Decree 1720/2007 of 21 December, further states that, where the provision relates to the bodies of the The General Administration of the State or the entities or bodies linked to or dependent on it shall take the form of a ministerial order or a resolution of the holder of the entity or body concerned. Article 54 of that regulation lays down the extremes to be contained in that provision or agreement by determining the minimum content of this rule.

In this way, the files of personal data managed by the Ministry of Agriculture, Food and Environment are related in the Order ARM/1683/2011, of June 2, which regulates the files with data of the Ministry of the Environment, and the Rural and Marine Environment.

The Ministry of Agriculture, Food and Environment, through the Directorate General of Fisheries Management, has expanded the application of information technology to integrate all the information generated on the management of aid co-financed with European funds.

The development of the aforementioned platform entails the need to expand the file with the same type of personal data, the responsibility of which corresponds to the Directorate General of Fisheries Management, which implies the amendment of Annex I to Order ARM/1683/2011 of 2 June 2011.

This order is issued pursuant to Article 20 of Organic Law 15/1999 of 13 December, and complies with the provisions of Article 54 of the Implementing Regulation of Organic Law 15/1999 of 13 December.

In its virtue, prior to the report of the Spanish Data Protection Agency and the Ministry of Agriculture, Food and Environment's Ministerial Committee on Electronic Administration, I have:

Single item. Amendment of Order ARM/1683/2011 of 2 June, which regulates the files with personal data managed by the Ministry of the Environment, and the Rural and Marine Environment.

In accordance with Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, the file entitled "European Fisheries Fund" under the heading "European Fisheries Fund" is amended. Fisheries Management, in the section General Secretariat of the Sea, current General Secretariat for Fisheries, of Annex I of Order ARM/1683/2011, of 2 June, with the following specifications:

" a) Identification of the file, indicating its name, as well as the description of its intended purpose and uses.

a.1) Identification of the file: European fund for the fisheries sector.

a.2) Finality of the file and intended uses: Application made for the purpose of integrating all the information generated regarding the management of aid to the fisheries sector co-financed with the European fund in the administrations managing such a Fund, knowing the degree of execution achieved and addressing the information requirements set out in the national law on this matter and assisting in decision-making.

(b) Origin of data, indicating the collective of persons on whom it is intended to obtain data of a personal nature or which are required to supply it, the procedure for collecting the data, and its provenance.

b.1) Collective: Applicants and beneficiaries of aid from the European Fisheries Fund.

b.2) Provenance: Public administrations; the interested party or its legal representative.

c) Basic file structure and the treatment system used in your organization.

c.1) Structure: Identifying data: DNI or NIF; name and last name; address.

c.2) Treatment system: Automated.

d) Communications of the data provided, indicating where appropriate, the recipients or categories of recipients and applicable legislation: Ministry of Finance and Public Administrations, IGAE, European Commission, Article 21.1 of Law 15/1999, of Data Protection and of the Community rules governing the fund.

(e) International transfers to third countries, indicating, where appropriate, the countries of destination of the data: There are no international data transfers foreseen.

f) Bodies of the administrations responsible for the file: General Secretariat for Fisheries.

g) Services or units to which the rights of access, rectification, cancellation and opposition may be exercised. Dirección General de Soración Pesquera, c/Velázquez 144, 28006, Madrid.

h) Basic, medium or high level of security that is required in accordance with the provisions of Title VIII of the RLOPD: Basic. "

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
