The development, evolution and diversity of leisure activities is a fact that is evident in all modern societies, constituting an economic area of increasing importance. This implies the need for specific attention by the administration towards these activities and a regulation commensurate with its economic and social dimension and impact.

Moreover, the progressive extension of new communication technologies to all social areas has an undeniable impact on the world of leisure, where an important group of users shows preference for develop your options through remote connections.

This set of economic, technological and social circumstances makes traditional game modes more structured according to the new technological context and adapted to the current characteristics of the demand in the gaming industry.

The approval of Law 13/2011, of 27 May, of regulation of the game, has come to establish the regulatory framework for the access to the exploitation and development of state-wide gaming activities, allowing the opening of the market to a plurality of operators.

This market opening materializes through the titles that enable gambling operators for the exploitation, on the one hand, of the modalities of the game collected in the Law through the general licenses, and on the other, of each of the regulated gaming classes, through the singular licenses.

With this Order, compliance with the requirements of prior regulation has been fulfilled which, for the granting of singular licenses, establishes Article 11 of Law 13/2011, of 27 May, of regulation of the game, approving the Basic regulation of the offer of poker game, being this one of the most novel and demanded games in our country and which, from such granting of singular licenses, may be offered in competition regime.

This new regulation represents a novelty in the regulatory framework of the gaming sector, since the offer of the game of poker was only regulated at the regional level for its offer in the in-person channel. This basic regulation, developed by the National Gaming Commission, will be complemented by the private rules of private character that the different operators will have to elaborate and propose together with their application for a singular license and that finally govern the development of the game and the operator's relations with the participants.

In short, the bases of a regulation aimed mainly at the protection of the participants and of the public interests that converge in the activities of the game, in particular the protection of the children and dependents, the prevention of gambling and compliance with the provisions of Law 10/2010 of 28 April on the prevention of money laundering and the financing of terrorism.

Article 5 of Law 13/2011, of 27 May, of regulation of the game, attributes to the Minister of Economy and Finance the competence to establish, by Ministerial Order, the basic regulation for the development of each game.

In its virtue, I have:

Article 1. Approval of the Basic Regulation of the game of poker.

The basic regulation of the state-wide game of poker is approved, which is listed as Annex I of this Order. The provisions of this Order shall be without prejudice to the powers of the Autonomous Communities in matters of planning and regulation of the games and bets developed, in person, in public establishments. dedicated to recreational activities.

Article 2. Limits of the amounts of guarantees linked to the singular license for the exploitation of the game of poker.

The limits corresponding to the amount of guarantees linked to the singular license for the exploitation of the game of poker, listed as Annex II of this Order, are approved.

Article 3. Economic limits for participation in the game of poker.

The relationship of economic limits for participation in the game of poker listed as Annex III of this Order is approved.

Article 4. Variants of the game of poker.

The relationship of poker game variants that may be marketed by the game operators and listed as Annex IV of this Order is approved.

Final disposition first. Authorization to the National Gaming Commission.

1. The National Gaming Commission is hereby authorised to make any provisions necessary for the development and implementation of this Order and in particular for the modification of the amounts set out in Annex III and for the amendment and inclusion of new classes or variants of the game in the list in Annex IV.

2. The National Gaming Commission is authorized to adopt as many provisions as are necessary for the development and implementation of the provisions of the Basic Regulation of the game of poker.

3. The National Gaming Commission is authorized to establish the procedure governing the granting of singular licenses and the authorization of occasional gambling activities, in accordance with the provisions of this Order. Ministerial and in the regulations of the development of Law 13/2011, of May 27, of regulation of the game.

In this procedure, the requirements to be required of the operators and the supporting documentation to be submitted shall be laid down.

Final disposition second. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

CHAPTER I

General provisions

Article 1. Object and scope of application.

purpose of this Regulation is to lay down the basic rules to be followed by operators for the development and exploitation of the game of poker, as well as in the drafting and drafting of the rules. Special rules, without prejudice to the powers that correspond to the Autonomous Communities in matters of planning and regulation of the games and bets developed, in person, in public establishments engaged in activities recreational.

Article 2. Definitions.

For the purposes of this Basic Regulation, the terms used in this Regulation shall have the meaning set out in this Article.

1. Poker game. Card or card game in which several players face each other in order to obtain any of the combinations of cards which, according to the value attributed by the particular rules of the game and in relation to the combinations obtained by the other participants who would not have withdrawn from the hand, allow him to win the fund of the game or the part of the game that could correspond to him. In the general dynamic of the game there are successively rounds of cast of cards of the English deck, excluding the wild cards, with rounds of making of bets by the participants.

The game of poker may be marketed in the variants listed in Annex IV to this Order.

2. English deck. Deck of cards in which the cards are evenly distributed in four groups or sticks of thirteen cards each and which are identified respectively by different icons. The sticks of the English deck are those of hearts and diamonds, both in red, and those of trees and pics, both in black. However, in order to facilitate identification on telematic supports, the differentiated allocation of colour is allowed for each of the sticks that make up the deck.

3. Hand. Set of card-sharing and betting-making rounds that make up a game.

4. Pot or bottom of the game. Prize at stake. In cash mode, the game fund is constituted by the amount of bets placed by the participants in each hand, and in the tournament mode proceeds from the registration rights, once deducted, in both cases, the commission that perceives the operator for the use of your room. Eventually the gambling fund may be constituted by economic amounts not equivalent to the set of bets placed, or even in kind.

5. Poker cash. Poker mode in which the participant may enter or leave the game when he or she wishes, being able to make effective the gains obtained in each one of the hands in which he has participated until the moment his withdrawal from the game.

6. Poker tournament. Poker mode in which the participant is willing to participate in successive tables, competing until they face, if he does not abandon the game previously, to his opponent or final opponents. You will be able to participate in the tournament after paying the corresponding right of registration and participation. The game fund will be delivered to the winner or split between a preset number of finalists.

7. Game variants. In the practice of the game of poker there are multiple variations which, while respecting the essential features of the game, differ fundamentally with respect to the dynamics of making bets, to the specific characteristics of the distribution of letters and the value assigned to the letters or combinations formed by them.

8. Cast button. It is understood by a cast button to the figure covering the function of the distribution of cards in the game and whose position is shifted, from right to left, from one participant to another, at the end of each hand.

9. Small initial bet. Pre-mandatory bet on the card-sharing by the participant to the left of the one who occupies the button position.

10. Big initial bet. Pre-mandatory bet on the card-sharing by the participant placed two positions to the left of the cast button, the amount of which usually doubles the small initial bet and operates as the minimum bet amount on the hand.

11. Ante. Pre-mandatory bet on the distribution of cards used in some poker variants and which consists of the participants ' contribution of a minimum bet amount to the game fund or pot.

12. Game session. Game dynamics that start with the participant's connection to play one or more poker hands, and concludes when the user abandons the game app.

13. Cancelled game or tournament. Departure or tournament in which those technical or other circumstances are present, which may provide for the particular rules of the game published by the operator on its website, which do not allow for the correct and complete conclusion of the event based on preset bases.

14. Commission of the operator. The economic amount that it obtains in terms of the use of the room, this being a percentage of the game fund in cash mode, and a pre-set amount per player in the tournament mode.

15. Right to participate in tournaments. Economic amount that the participant pays to access a tournament and is broken down into the concepts of contribution to the room and contribution to the game fund.

CHAPTER II

Enabling titles

Article 3. Required enabling titles.

Operators interested in the development and exploitation of the game of poker must have a general license for the modality of other games, as defined in Article 3 (f) of Law 13/2011 of 27 May of Regulation of the game, granted by the National Gaming Commission, and request and obtain the singular license for the marketing of the game of poker, both granted by the National Gaming Commission in accordance with the procedure established to the effect in the regulations of the development of Law 13/2011, of May 27, of regulation of the game.

Article 4. Validity and extension of the singular license.

1. The special licence for the development and operation of the game of poker shall be extended for a period of five years, subject to the request of the person concerned, for successive periods of the same duration, until the expiry of the general licence in which the ampara.

2. The application for the extension of a special license shall be addressed to the National Gaming Commission during the last year of its validity, and at least four months in advance of the date of its completion, and must prove:

a) Compliance with requirements and conditions considered for obtaining the corresponding singular license.

(b) The uninterrupted exploitation of the licence during at least three fifths of its validity.

c) Payment of the tax on gambling activities and fees for the management of the game.

For the purposes of the accrual, settlement and payment of the fee for the administrative management of the game set out in Article 49.5.d) of Law 13/2011, of May 27, of regulation of the game, the extension of the singular license equating to the new license.

3. In accordance with the conditions referred to in the preceding number, the National Gaming Commission shall grant the requested extension and agree to its registration in the General Register of Game Licenses unless it is motivated to estimate that there are reasons for safeguarding the public interest, the protection of minors or the prevention of gambling addiction phenomena which justify the imposition of the requested extension.

Article 5. Guarantees linked to the singular license.

1. The National Gaming Commission may establish the obligation to provide an additional guarantee related to the granting of the singular license for the development and exploitation of the game of poker.

The National Gaming Commission, if applicable and by resolution, will determine the amount of the guarantee linked to the singular license for the development and exploitation of the poker game to be satisfied by the operators in the the framework set out in Annex II to this Order.

2. The guarantee linked to the singular license for the development and exploitation of the game of poker is affected to the fulfilment of the general obligations of the operator and, in particular, to the specific obligations of credit of the obtained profits by the participants, as well as to the fulfilment of any other obligation which, in relation to the corresponding singular license, has been imposed on the operator by the National Commission of the Game, respecting in his case the provisions of the article 77 of the Law 58/2003, of 17 December, General Tax in the framework of Article 14 of the Law  13/2011, May 27, regulation of the game and its development regulations.

3. The additional guarantees referred to in this Article shall be constituted in the forms and under the conditions laid down in the Law 13/2011, of 27 May, of regulation of the game.

CHAPTER III

Relationships between the operator and the participants

Article 6. Particular rules of the game of poker.

1. The development and exploitation of the game of poker will be governed by this Basic Regulation, by the provisions that in the development of the same dictate the National Commission of the Game, according to the terms of the singular license granted and by the rules details of each set drawn up and published by the operator.

2. The development and exploitation of the game of poker requires the prior publication of particular rules, which have a private nature and are elaborated by the gaming operator, without prejudice to the supervisory powers that, to the effect, the game has the National Gaming Commission.

In the particular rules the rules of the game of poker will be established in detail for each variant developed and operated by the operator, the structure of making and maximum amounts of the same, and the procedures and principles to govern the relations between operators and participants.

3. The particular rules of the game of poker must be published by the operator on its website and, by means of techniques appropriate to the means employed, must be accessible to the participants permanently, easily and free of charge.

4. The operator shall notify the National Gaming Commission of the date of publication of the particular rules, as well as any changes they make to them.

Article 7. Claims of the participants.

1. The operator must have a system of attention and resolution of complaints and complaints from the participants or any person who could be affected by the operator's performance and establish in the particular rules of the game procedures and means to enable participants to submit complaints, in particular the address or addresses to which they are to be addressed, the time limits for the submission of complaints and those applicable for the defence of the same by the operator.

The complaints and complaints system of care and resolution must be easily accessible to interested parties and will have at least an electronic access through the operator's website that will record the date and time of receipt of complaints submitted by this route.

The attention to the participant must be at least in Spanish.

2. The time limit for the submission of claims to the operator shall not be less than three months from the date on which the corresponding poker game was held or the event was made.

The operator shall issue a communication addressed to the claimant, in which he shall acknowledge receipt of his complaint and in which he shall state the identity of the operator and the time limit in which he shall be informed of the decision taken.

The operator shall resolve the participant's claim within one month from the date on which it was received in the address (s) established for these purposes and shall communicate it to the claimant.

3. If the complaint is settled by the operator or, if applicable, one month after the complaint was filed without the person having communicated its decision, the participant may make a complaint to the National Gaming Commission that will resolve the complaint. within two months from the date on which the complaint was entered in its register, without prejudice, where appropriate, to the opening of the relevant sanctioning procedure if the operator had incurred any of the infringements. collected in Title VI of Law 13/2011, of May 27, of regulation of the game.

4. The period of expiry of the earnings obtained shall be interrupted from the date of receipt of the complaint, until the date on which the complaint has communicated its decision to the claimant or, where appropriate, to the notification of the decision of the National Gaming Commission.

Article 8. Reporting obligations to participants.

Game operators must provide complete and up-to-date information to participants, at least, in relation to the following:

(a) Information about the operator of the game and, in particular, on the possession and validity of the enabling titles granted by the National Gaming Commission, trade name, social name, registered office and, if applicable, the address of the representative in Spain.

b) Information about the claims care system that the operator has in place. The information shall contain at least: postal and electronic address to which the complaints may be addressed, time limits for the submission of the complaints, and, where appropriate, standard models, and time limits for the communication of the decision. The operator must also be informed of the operator's obligation to issue a reply for each complaint received. The operator shall be obliged to communicate to the claimants the identity of the staff with whom they interact.

c) Information about the particular rules of the games offered, with specific detail for each variant developed, channels and forms of participation available, bet levels and game fund offered. This information must be truthful and readily available before the start of the game session and at any time during the game.

d) Information about the development of bets on the game, with an express indication of the amount per participant, as well as the amount of the game fund or pot. The operator shall provide the participants with information in real time on the evolution of the amounts of the plays and bets placed.

e) Particular information to each participant about the winnings obtained in the game, the amount of bets placed, and the balance of the game account. Such information shall be provided to the participants at the end of each gaming session by the same means used by the latter for participation in the game.

f) Information to the participant on responsible gaming policies developed by the operator.

The information relating to the game, its name and form of presentation must be offered in such a way as to avoid the similarities with any other games or to induce confusion the participant with respect to the nature of the game.

The information that the operator offers to the participant must be provided at least in Spanish.

Article 9. Promotion of the games.

1. In the terms set out in article 7 of Law 13/2011, of May 27, of regulation of the game, the performance by an operator of gambling advertising, sponsorship or promotion of gambling activities, as well as the advertising or promotion of the same, can be performed according to these criteria:

a) That advertising is easily identifiable by its recipients.

b) To ensure that advertising activity is socially responsible, paying due attention to the protection of minors and other particularly vulnerable groups. Thus, in the case of minors, it should be avoided that advertising is aimed at them, or that it is particularly attractive for children and young minors, or that they have a significant role in the particular promotional activity.

c) In the event of its broadcast by audiovisual media, it must also respect the applicable provisions on commercial and self-promotion communications contained in Law 7/2010 of 31 March, General of the Audiovisual Communication, and in particular the provisions of Article 7 on the rights of the child. Special attention shall also be paid to the timing of the advertising of the gambling activity and the age rating of the programme together with which the programme is issued or inserted shall be taken into account.

2. In addition, the operator may carry out promotional activities for the offer of the games which it places on the market and offer bonuses for the registration or participation of the player provided such practices:

a) Do not be contrary to the provisions of this Basic Regulation or the regulatory regulation of the game.

b) Do not contravene the provisions of Law 34/2002, of July 11, of Services of the Information Society and of Electronic Commerce and Law 7/2010, of 31 March, General of Audiovisual Communication.

c) Do not alter the dynamics of the game.

d) Do not induce participant confusion regarding the nature of the game.

3. It is up to the operator to publish on its gaming platform the conditions of application and periods of validity of any promotional initiative that it develops, as well as the terms of it.

4. The National Gaming Commission may limit the maximum amount of promotional initiatives and bonuses to participants developed by the operator, in accordance with the terms of Article 7 of Law 13/2011 of 27 May of Regulation of the game, and in the regulations for which the aforementioned article is regulated.

5. Gaming operators will be able to offer free gaming applications on their platforms, as provided for in the regulatory regulatory framework for the development of Law 13/2011, of May 27, to regulate the game.

Article 10. Channels and means of participation.

1. Participation in the game of poker, in accordance with the provisions of article 1 of Law 13/2011, of 27 May, of regulation of the game, will be carried out through electronic, automatic, telematic and interactive channels, in which the In-person means, if they exist, they will have an accessory character.

The participation may also be carried out through physical terminals accessories which the operators may install, prior to the appropriate authorization issued to the effect by the Autonomous Community in reason of the territory in the the purpose of the installation of the terminals, in accordance with the relevant state and regional rules on gambling and gambling. These physical accessories must have been previously approved by the National Gaming Commission and their installation can only be performed in those physical locations where the corresponding organ of each Autonomous Community has authorized the game of poker.

2. Participation in the game of poker may be performed using any mechanism, installation, equipment or system that allows to produce, store or transmit documents, data and information, including any open communication networks or restricted as television, Internet, fixed and mobile telephony or any other, or interactive communication, whether in real time or deferred.

CHAPTER IV

Developing the game of poker

Article 11. Goal of the game of poker.

The dynamics of the poker game successively alternate rounds in which participants place their bets with rounds in which they are dealt cards. The aim of the participant is to obtain a combination of cards which, according to the values preset by the particular rules of the game, and depending on the game variant chosen, allows him to obtain the game or pot, or the part of the same as applicable.

According to the version of the game in which you participate, the player who obtains the most valuable combination, the one who obtains the combination of the lowest value, or both, with respect to the combinations of the rest of the participants of the hand.

Participants will at all times adhere to the bases established by the operator for the development of the game in their particular rules.

Article 12. Limits to participation in the game of poker.

1. Without prejudice to compliance with the economic limits set out in Annex III attached to this Order, the operator may define in the particular rules of the game the development of bets, which shall always be made in euro, compliance with any of the following:

a) Poker without limit: There is no maximum bet and the player will be able to bet any amount that he has at the table before starting his hand, provided that the economic limitation framework established in the Annex III, attached to this Order, and the particular rules of the game published by the operator.

b) Poquer with limit: Under this bet structure, and in some betting rounds determined according to the chosen game variant, players will not be able to raise their bet by more than the amount equal to double the bet large initial.

c) Poquer limited to the pot: The participants ' maximum bet is limited by the amount of the jackpot at stake.

2. The National Gaming Commission may establish obligations whereby operators are required to establish mechanisms to ensure the temporary limitation of participation in the game.

Article 13. Participation in the game. Suspension, cancellation, postponement and interruption of games and tournaments.

1. Participation in the game shall be carried out by means, or means, established by the operator in its particular rules of the game from among those referred to in Article 10 (2) of this Basic Regulation.

2. Operators shall issue a communication at the end of each gaming session, which shall be provided to each participant by the same means by which he played in the session, with the summary of the amounts wagered and the prizes obtained.

3. Operators shall establish in the particular rules of the game a forecast for the assumptions of suspension, cancellation, postponement and interruption and the scheduled departures or tournaments, with an express indication of the cases in which they will proceed, respectively, the maintenance or cancellation of the amounts posted. In any event, the right to prizes obtained by the participants in a departure must be guaranteed prior to their eventual suspension, cancellation, postponement and interruption of the same.

4. The full amount corresponding to the bets or plays which, once formalized, are cancelled by the operator in application of their particular rules, will be returned or made available to the participants in the form that it establishes in these particular rules, without any additional costs or obligations for the participants. If, for participation in the game, the payment of any resale right is necessary, and the item is cancelled, the operator shall reimburse the participant for such an amount. An operator offering a particular award, whether economic or in kind, shall be obliged to pay the prize, irrespective of whether the rights of participation raised are, or not, the value of the prize offered.

Article 14. Game development, determination, and profit allocation obtained by the participants.

1. The game of poker will be developed in accordance with what is established in this Basic Regulation, in the provisions that in the development of the same dictate the National Commission of the Game and in the particular rules of the game published by the operator.

Poker game operators may include in their particular rules how many game variants they develop or intend to develop, among those listed in Annex IV to this Order.

2. The poker game will start at the time set in the particular rules of the game and whenever they participate, at least, two players at the corresponding table.

3. In the game dynamics, the betting and card-sharing rounds will take place according to the specific operative that articulates each supported game variant and will appear detailed in the particular rules of the game published by the operator in its web page. The participants in the game will choose to continue the game until the end or to withdraw from it, until the final stage of counting in which the value of the combinations obtained by those who have not left the game will be counted. hand, and the winner or winners will be determined who will get the bottom of the game or pot.

Article 15. Bottom of the game.

1. The game or jackpot fund is intended for the payment of winnings earned by the participants in the game.

It will be necessary to authorize the National Gaming Commission so that the operator can offer prizes, whether economic or in kind, other than those set out in this article.

Article 16. Payment of the proceeds obtained by the participants.

1. They are creditors of the amount of the proceeds obtained by the participants who, in accordance with the particular rules of the game, would have been successful.

2. The operator shall ensure that the participants are charged with the proceeds and are obliged to pay the corresponding amounts which, as a general rule, shall be effective after the end of the item. In cases where the particular rules of the game were set for a longer period, the internal processing of the operator to carry out the payment may not exceed 24 hours counted from the end of the consignment in which they were generated the profits.

3. The operator shall make the payment of the proceeds in accordance with the terms and conditions set out in its particular rules of the game and, failing that, by the same means employed by the participant to pay the bets or the rights of the participation. Payment of winnings shall not entail additional cost or obligation for the winner.

The right to collect the winnings obtained by the participants will expire within the time limit set in the particular rules of the game, which will not be less than three months from the day following the end of the game in which originated those gains.

4. The National Gaming Commission shall establish the relevant additional procedures and obligations in relation to the payment of the proceeds of the game for the best protection of the participants and the public interest, as well as to prevent collusion between players.

ANNEX II

Limits of guarantees linked to the singular license for the exploitation of the game of poker

Unique.

The National Gaming Commission will, by resolution, determine the amount of the guarantee linked to the singular license for the development and exploitation of the poker game to be set between five and twelve percent of the net income of the operator imputable to the activity subject to a single licence in the year immediately preceding. For this purpose, the net income of the operator shall be understood as set out in Article 48.6 of Law 13/2011 of 27 May of regulation of the game. During the initial period of the individual licences, the lodging of a guarantee shall not be required. The initial period of the singular licenses shall be computed in accordance with the provisions of the Law 13/2011, of May 27, of regulation of the game, which is applicable.

ANNEX III

Economic limits for participation in the game of poker

First. Deposit limits.

The amount of deposits made in the game account will be adjusted to the limits, which in this respect, will be established by the National Gaming Commission, in accordance with the terms of Law 13/2011 of May 27, of regulation of the game, and in its regulatory framework for development.

Second. Maximum amounts of bets.

Operators will not be able to include in their offer bets for amounts higher than those set out below:

a) Bet levels per table.

In non-limited game versions, and limited to the jackpot, the operator will not be able to offer tables where the amount of the large initial bet is greater than 10 €.

b) Input to cash tables.

The maximum amount a player will be able to sit on at a cash table will be the result of multiplying the table's large initial bet by 100.

c) Participation rights in tournaments.

The maximum total amount for the payment of participation and registration fees in tournaments, may not exceed 250 €.

The National Gaming Commission may, in an express and extraordinary manner, authorize the exceeding of these limits in poker events related to promotional or advertising initiatives.

ANNEX IV

Poker Game Variants

In the framework of the basic and common dynamics of the game of poker, the National Gaming Commission admits the management and commercial exploitation of the following variants of which they point their most relevant particularities in terms of distribution of cards and making of bets for their generic identification:

First. Texas Hold'em.

In the variant the distribution of cards is articulated in two cards for individual use of each player, which remain hidden to the rest of the participants, and five letters of community use that are shown to all the participants. In-game betting starts with making the mandatory small and large bets.

Second. Omaha.

In the variant the distribution of cards is articulated in four cards for individual use of each player, which remain hidden to the rest of the participants, and five letters of community use that are shown to all the participants. In-game betting starts with making the mandatory small and large bets.

Third. Stud.

In the variant the distribution of cards is articulated in the successive delivery of cards for the individual use of each player, in which they alternate covered and discovered cards, until reaching 5 or 7 cards according to the version of the game chosen. The initial bets start with bets called "ante" which consist of a bet per participant and in which the betting round is initiated by the player who has the card discovered with a higher value, or more under, according to the version of the game defined in the particular rules of the game published by the operator.

Fourth. Draw.

In the variant the distribution of letters is articulated in the delivery of five cards for individual use of each participant that remain hidden for the rest. Card removal and replacement are allowed. In-game betting starts with making the mandatory small and large bets.
