The State Aviation Safety Agency is the competent body for the award of titles that enable civil aviation and civil aviation activities to be carried out and controlled by civil society. compliance with the requirements and obligations in each applicable case.

In accordance with Articles 9 (1) (a) and 28.2.c) of the Statute of the State Aviation Safety Agency, approved by Royal Decree 184/2008 of 8 February 2008, the Director of Airport Safety and Air Navigation exercises the the Agency's powers related to the issue, renewal, suspension, maintenance and revocation of the licences, ratings and endorsements of air traffic controllers.

Reasons for speed and agility in management, as well as the dispersal of controllers to the service of AENA in different control centers, make it necessary and convenient that, once the State Agency of Aviation Safety the air traffic controller license, be AENA who notes the renewal of the drive annotation on the licenses. In this way, the fulfillment and delivery times are shortened to the driver of your updated license.

In order to prevent the conduct of proceedings during which the controller will not physically dispose of his license, suppose an interruption in his work, AENA is authorized to issue a replacement of the license of the temporary duration.

The State Aviation Safety Agency must approve the procedures that AENA establishes for the exercise of this faculty, including the means of control that are provided to ensure that the replacement guards do not issue without previously verifying that the required requirements are met.

Therefore, pursuant to Article 13 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and of the additional provision of Law 6/1997, April 14, Organization and Functioning of the General Administration of the State, resolute:

First. Delegating to the business public entity AENA the ability to renew the unit log in the air traffic controllers ' licenses to its service.

Second. AENA has to establish a procedure for the exercise of the attribution delegated to the first paragraph.

Once the procedure has been prepared, it must be submitted for approval by the State Aviation Safety Agency.

In that procedure, AENA will point out the persons in charge of performing the renewals of the air traffic controller license.

Third. For the processing of annotations in the licenses, AENA may provide the data subject with a safeguard of the application in processing, which will allow the controller who has requested an annotation in his license or the renewal of an annotation to continue to perform his duties even if he is not in physical possession of his licence. The stub shall not be longer than 1 month.

The unit responsible for issuing the safeguard shall carry out a preliminary verification of the regularity of the documentation submitted before it is issued. In case of any lack or defect in the submitted documentation, you will not need to deliver the stub. The procedure referred to in the second subparagraph shall describe how such verification is to be carried out.

AENA shall keep an updated database that takes into account the safeguards referred to in this paragraph, as well as their dates of issue and validity.

Fourth. The State Aviation Safety Agency has the management and control of the delegated power, and may at any time revoke the delegation made or conduct its exercise.

The delegated acts are imputable to the delegating body, to whom the decisions taken by AENA in exercise of this delegation may be used.

Fifth. This resolution shall take effect from the day following that of its publication in the Official Gazette of the State.
