The Organic Law 2/2006 of May 3, Education, provides in Article 39.6 that the Government, after consultation with the Autonomous Communities, will establish the corresponding studies vocational qualifications, as well as the basics of curriculum each of them.

The Organic Law 5/2002 of 19 June, on Qualifications and Vocational Training, established in Article 10.1 that the Central Government, in accordance with Article 149.1.30.ª and 7th of the Constitution and after consulting the General Council of vocational training, determine the degrees and professional certificates, which constitute vocational training offers referring to the National Catalogue of professional qualifications.

Law 2/2011 of 4 March, on Sustainable Economy, and the Organic Law 4/2011 of 11 March supplementing the Sustainable Economy Law amending the Organic Laws 5/2002 amending on Qualifications and Vocational Training, and 2/2006 of Education, have introduced an ambitious set of legislative changes necessary to encourage and accelerate the development of a more innovative, capable of renewing the traditional productive sectors more competitive economy and make their way to new applicants employment activities, stable and quality.

Royal Decree 1147/2011, of 29 July, establishing the general organization of vocational training and education system defined in Article 9 the structure of vocational qualifications, based on the National Catalogue of Professional Qualifications the guidelines set by the European Union and other aspects of social interest.

Moreover, this royal decree in particular Article 7 professional profile of such securities, including general competence, professional, personal and social skills, qualifications and, where appropriate, the competency units Catalog national vocational qualifications included in the titles, so that each title will incorporate at least a full professional qualification in order to ensure that vocational training diplomas respond effectively to the needs demanded by the productive system and values personal and social conditions that allow exercise democratic citizenship.

This regulatory framework is necessary now to the Government, after consultation with the Autonomous Communities, set each of the titles that will form the catalog of titles of vocational training of the education system, their minimum teachings and those other aspects of the organization academic, without prejudice to the powers attributed to the educational authorities in this matter, constitute the basic aspects of the curriculum to ensure a common training and guarantee the validity of certificates, in compliance with the provisions of Article 6.2 of the Organic Law 2 / 2006, dated May 3, Education.

For this purpose, it must be determined for each security ID number, your professional profile, professional environment, prospective title in the sector or sectors, the teachings of the training cycle, the correspondence of the professional modules with the competency units for accreditation, validation or exemption, and the basic parameters of formative context (spaces and minimal equipment, qualifications and specialties of teachers and their equivalents for teaching purposes), after consultation with the Autonomous Communities, as provided for in Article 95 of Organic Law 2/2006 of 3 May, of Education.

Also, each title shall be determined access to other studies and, where appropriate, modalities and school materials to facilitate admission if competitive basis, validations, exemptions and equivalents and, where appropriate, information on the necessary requirements for professional practice, under current legislation.

In order to facilitate the recognition of credits among senior technical titles and programs leading to degrees and vice versa, in higher vocational training equivalence of each professional module ECTS credits will be established, such as defined in the Royal Decree 1125/2003, of September 5, establishing the European credit system and the grading system in official university degrees and valid throughout the national territory is established.


So, this Royal Decree, as provided for in Royal Decree 1147/2011, of 29 July, establishes and regulates in above-mentioned aspects and basic elements, the title vocational education system Technical superior Transportation and Logistics.

It has resorted to a regulatory standard for establishing state basis in accordance with the Constitutional Court, which admits that "exceptionally" the foundation may be established by regulations in certain cases, as in this case, when "indispensable complement to ensure the lowest common denominator established in the basic legal norms "(as, among others, in the SSTC 25/1983, 32/1983 and 48/1988).

In the process of preparing this Royal Decree have been consulted and the Autonomous Communities have issued report by the General Council of Vocational Training, the State Board of Education and the Ministry of Territorial Policy and Public Administration.

DECREE:
CHAPTER
I
General provisions


Article 1. Purpose.

1. This Royal Decree is intended to establish the title of Technician in Transport and Logistics, with official and valid throughout the national territory and its corresponding minimum teaching.

2. The provisions of this royal decree replaces the regulation title of Technician in Transport Management, contained in Royal Decree 1654/1994, of 22 July.
CHAPTER II


ID title, professional profile, professional environment and prospective title in the sector or sectors

Article 2. Identification.

The title of Senior Technician in "Transport and Logistics" is identified by the following elements:

Name: Transport and Logistics.

Level: Higher Vocational Training.

Duration: 2,000 hours.
Trade and Marketing:
Professional Family.

Concerning the International Standard Classification of Education: CINE-5b.

Level Spanish Qualifications Framework for Higher Education: Level 1 Technician.

Article 3. Professional profile title.

The professional profile of Superior Técnico in Transport and Logistics is determined by its general competence, their professional, personal and social, and relationship skills and qualifications, if any, competence units of the National Catalogue of Qualifications professionals included in the title.

Article 4. General Competition.

The general competence of this title is to organize, manage and control the operations of freight and passengers on national and international level, and in planning and managing the logistics activities of a company, according to current regulations and the objectives set by the management of the company, within the framework of the quality, safety and environmental respect.

Article 5. professional, personal and social skills.

The professional, personal and social skills of this title are as listed below:

A) Apply national and international regulations in force in the management of transport companies of goods and passengers, adapting to frequent to meet the requirements of professional, economic and good repute in the sector capacity required regulatory changes.

B) Make the necessary arrangements for the establishment and implementation of a transport and logistics of goods and / or passengers conforming to the characteristics and obligations under the selected legal form.

C) Obtain the necessary financial resources making efforts to grant credits, loans, guarantees and grants available for application in the development of the activity.

D) To organize the departments of an enterprise transport and logistics of goods and / or passengers by determining human and material resources necessary to meet the objectives set by the management of the company resources.

E) Develop and manage transportation plans, production plans, operations plans and warehouse flows and daily traffic by assigning human and material resources and outsourcing with companies, if necessary, to optimize the level service established with the client.

M) Organize storage of goods in conditions that guarantee their integrity and optimal use of resources and space available, in accordance with established procedures.

N) Conduct and control the procurement of materials and goods in production plans and distribution, ensuring the quantity, quality, place and time to meet the goals set by the organization and / or customers.

O) Perform administrative operations management import and export and introduction and freight forwarding.

O) Adapting to new work situations, keeping updated scientific, technical and technological knowledge concerning their professional environment, managing their existing resources training and learning throughout life and using information technologies and communication.

CHAPTER III


Teachings of the training cycle and basic parameters of context

Article 9. General objectives.

The general objectives of this training cycle are as follows:

A) Identify the requirements by national and international authorities in professional, economic and good repute capacity, adapting to frequent regulatory changes in the sector to apply national and international regulations in force in the management of transport companies and logistics of goods and / or passengers.

B) Identify and evaluate the different legal forms, incorporation procedures, competent bodies, tax obligations and subsidies, current regulations applying civil, commercial, tax and labor on the transport of goods and passengers for the necessary steps for the establishment and implementation of a transport and logistics of goods and / or passengers.

C) Review and evaluate the sources and financial products available, such as credits, loans and other financial instruments and possible subsidies and select the most suitable for the company, analyzing accounting information and assessing the costs, risks, requirements and guarantees required by financial institutions to obtain the necessary financial resources to finance the investments required for the development of the activity.

Z) Identify and propose professional actions necessary to respond to the universal accessibility and 'design for all'.

Aa) Identify and apply quality standards in the work and activities carried out in the learning process, to assess the culture of evaluation and quality and be able to monitor and improve quality management procedures.

Ab) use procedures related to entrepreneurship, business and professional culture initiative, to perform basic management of a small business or take a job.

C) Recognize their rights and duties as an active agent in society, taking into account the legal framework regulating social and labor conditions, to participate as democratic citizens.

Article 10. Professional modules.

1. The professional modules of this training cycle:

A) remain developed in Annex I of this royal decree, fulfilling the provisions of Article 10 of Royal Decree 1147/2011, of 29 July.

2. The educational Administrations shall establish appropriate curricula, respecting the provisions of this Royal Decree and in accordance with Article 8 of Royal Decree 1147/2011, of 29 July, the general organization of vocational training set education system.

Article 11. Spaces and equipment.

1. The space required for the development of the teachings of this training cycle are set out in Annex II of this Royal Decree.

2. The spaces have the necessary and sufficient area to develop teaching activities arising from the learning outcomes of each professional modules taught in each of the spaces. In addition, they must meet the following conditions:

A) The surface shall be established depending on the number of persons occupying the training area and should allow the development of teaching and learning activities with ergonomics and mobility required within it.

B) shall cover the space need of furniture, equipment and auxiliary tools.

D) Respect the regulations on the prevention of occupational hazards, health and safety regulations in the workplace and how many other rules apply.

3. The established training spaces may be occupied by different groups who attend the same or other vocational training, or educational stages.

4. The various training areas identified are not necessarily differentiated by enclosures.

5. The equipment included in each space must be necessary and sufficient to ensure students the acquisition of learning outcomes and quality of teaching. In addition, they must meet the following conditions:

A) The equipment (computers, machinery, etc.) have the necessary installation for proper operation, comply with safety standards and risk prevention and few others are applicable.

B) The amount and characteristics of the equipment must be based on the number of people enrolled and allow the acquisition of learning outcomes, taking into account the evaluation criteria and the contents included in each of the professional modules it is given in the aforementioned areas.

6. The competent authorities shall ensure that the spaces and equipment are adequate in quantity and characteristics for the development of teaching and learning processes derived from the learning outcomes of the relevant modules and guarantee the quality of these teachings.

Article 12. Teachers.

1. Teaching professional modules that make up the teachings of this training cycle corresponds to the faculty of the Body of Professors of Secondary Education Corps Secondary School Teachers and the Corps of Technical Teachers of Vocational Training, as appropriate, of the specialties established in Annex III a) of this royal decree.

2. The qualifications required for access to the aforementioned educational bodies are, in general, established in Article 13 of Royal Decree 276/2007, of 23 February, Regulation of income, access and acquisition of new specialties is approved in the teaching bodies referred to in Organic law 2/2006 of 3 May, of Education, and the transitional regime is regulated income that provision refers transient seventeenth of the quoted law a. 3. CHAPTER IV


Access and linkage to other studies, and correspondence modules with professional competence units

Article 13. Preferences for access to this training cycle in relation to the modalities and school subjects studied.

Article 14. Access and linkage to other studies.

1. The title of Senior Technician in Transport and Logistics allows direct access to pursue other higher-level training cycle, under the conditions established for admission.

2. The title of Senior Technician in Transport and Logistics allows direct access to the educations leading to university degrees in the admission conditions to be established.

3. The Government, after hearing the Council of Universities, regulate, in specific standard, recognition of credits between higher technical vocational training and university education Degree. To facilitate the validation regime, this royal decree has been allocated 120 ECTS credits among all professional modules of the training cycle.

Article 15. Validations and exemptions.

1. Validations between professional modules of vocational training qualifications established under the Organic Law 1/1990 of 3 October on the General Organisation of the Educational System, modules and professional title established in this royal decree are those listed in Annex IV.

2. Those who have passed the professional module of Training and Guidance or professional module Enterprise and entrepreneurship in any of the corresponding to the titles established under the Organic Law 2/2006 of May 3, Education, vocational training will validated these modules in any other training cycle established under the same law.

3. Those who have obtained accreditation of all units of competence included in the title, by the procedure laid down in Royal Decree 1224/2009, of July 17, recognition of professional skills acquired through work experience, may validate the professional module training and guidance provided:

- Demonstrating, at least one year of work experience.

- Be in possession of accreditation of training established for the performance of the functions of basic level of preventive activity, issued in accordance with the provisions of Royal Decree 39/1997 of 17 January, by which Regulation of the Prevention Services is approved.

4. According to the provisions of Article 39 of Royal Decree 1147/2011, of July 29, it may be determined the total or partial exemption from professional training module in workplaces by his correspondence with work experience, whenever you credit a experience related to this training cycle under the terms provided in that article.

Article 16. Correspondence of professional modules with units of competence for accreditation, validation or exemption.

1. Correspondence units competition with professional modules that make up the teachings of the title of Upper Technician in Transport and Logistics for validation or exemption is determined in Annex VA) of this royal decree.

2. The correspondence of the professional modules that form the teachings of the title of Upper Technician in Transport and Logistics with units of competence for accreditation, is given in Annex VB) of this royal decree.

First additional provision. Reference title in the European framework.

Once the national qualifications framework, according to the European recommendations, the corresponding level of this degree in the national framework and its equivalent in Europe will be determined.

Second additional provision. Offer distance of this Title.

The professional modules that form the teachings of this training course will be offered at a distance, provided that ensures that students can achieve learning outcomes thereof, in accordance with the provisions of the Royal Decree. To this end, education authorities, within their respective powers, adopt the measures they deem necessary and dictate the precise instructions.


Third additional provision. Links with equivalent qualifications and professional training.

1. The title of Senior Technician in Transport Management, established by Royal Decree 1654/1994, of July 22, will have the same professional and academic purposes that the title of Senior Technician in Transport and Logistics established in the Royal Decree.

2. The formation established in this royal decree in the professional module enables training and guidance to carry out professional responsibilities equivalent to those requiring basic level activities in prevention of occupational hazards, established by Royal Decree 39/1997 of 17 January, Regulation of Prevention Services is approved, provided you have at least 45 teaching hours.

3. The formation established in this royal decree, guarantees the level of knowledge required for the exercise of the profession of road transport operator laid down in Regulation (EC) No 1071/2009 of the European Parliament and of the Council of 21 October 2009, laying down common rules concerning the conditions to be fulfilled for the exercise of the profession of road transport and amending Directive 96/26 / EC, repealing Council established.

Fourth additional provision. Regulating the exercise of the profession.

1. The title established in the Royal Decree is not a regulation of the exercise of a regulated profession.

2. Also equivalencies academic qualifications set out in paragraph 1 of the third additional provision of this Royal Decree shall be without prejudice to compliance with the provisions which allow for the exercise of regulated professions.

Fifth additional provision. Equivalences for teaching purposes in the selective admission procedures in the Technical Teachers Corps Vocational Training.

The title of Senior Technician or Technical Specialist equivalent to those required for access to the body of Technical Teachers of vocational training when the entitled has exercised as interim professor in public centers in the territory of the convener Administration stated in the teaching specialty intending to access and for a minimum period of two years before August 31, 2007.

Sixth additional provision. Universal accessibility in the teachings of this title.

1. The education authorities, within their respective powers, included in the curriculum of this training cycle the necessary elements to ensure that people who cursen develop the skills included in the curriculum in "design for all".

2. Also, these authorities take the measures they deem necessary for these students to access and take this training cycle under the conditions set in the tenth final provision of Law 51/2003 of 2 December, of equal opportunities, non-discrimination and universal accessibility for people with disabilities.

Single transitional provision. Applicability of other regulations.

1. Until not apply the provisions of this royal decree, under the provisions of their second and third final provisions, shall apply the provisions of Royal Decree 1654/1994, of 22 July, the title is set Higher Technician in Transport Management and its corresponding minimum teaching.

2. It also is applicable until the rule governing for the field of management of the Ministry of Education, for the title of Senior Technician in Transport and Logistics curriculum, shall apply the provisions of Royal Decree 1669/1994, of 22 July, establishing the curriculum of higher grade training cycle for the title of Senior Technician in Transport Management is established.

Single derogatory provision. Repeal of rules.

1. Is repealed Royal Decree 1654/1994, of 22 July, the Superior Técnico set out in Transport Management and its corresponding minimum teaching and any other provisions of equal or lower rank opposing the provisions of this Royal Decree .

2. Royal Decree 1669/1994, of 22 July, the curriculum of the training cycle of higher level corresponding to the title of Technician in Transport Management is established hereby repealed.

First final provision. competential title.


The royal decree has the character of this basic rule, under the powers conferred upon the State Article 149.1.1 and 30th of the Constitution. Exempted from the transitional provision basic standard single point 2.

Second final provision. Implementation of the new curriculum.

The education authorities will implement the new curriculum for this training in the school year 2012-2013.

Final disposition third. Entry into force.

The Royal Decree shall enter into force on the day following its publication in the "Official Gazette" day.

Professional Module: Administrative management of transport and logistics.

Equivalence in ECTS: 12.

Code: 0621.

Learning outcomes and assessment criteria.

1. Select the documentation of transport depending on the type of operation, enforcing regulations and legislation in force in the sector.
Evaluation criteria
:

A) it has been interpreted the regulations governing transportation in its various forms.

C) they have been chosen, depending on the needs of the company, the vehicles and their components (chassis, engine, transmission, brake systems, etc.).
