Organic Law 15/1999, of 13 December, of Protection of Personal Data, and its subsequent development by Royal Decree 1720/2007 of 21 December, for which the regulation of the development of the Organic Law is adopted 15/1999, of 13 December, sets out a series of measures to ensure and protect, with regard to the processing of personal data, public freedoms and the fundamental rights of natural persons, and in particular of their honour personal and family intimacy.

Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the Official Gazette of the State or in the Official Journal concerned.

Article 53.1 of Royal Decree 1720/2007 of 21 December, approving the Regulation on the development of the Organic Law 15/1999 of 13 December, also states that, where the provision relates to the organs of the General Administration of the State or entities or bodies linked to or dependent on it shall take the form of a ministerial order or a resolution of the holder of the relevant entity or body.

The Ministry of the Presidency manages the register of decorations in which the decorations specified in the Council of Ministers Agreement of 12 July 1973 are included in the Order of 22 November 1988. ("Official State Gazette" of 23) and the decorations of the Royal Order of Civil Recognition to the Victims of Terrorism. The transfer of time and the appearance of new needs as well as the volume of management of these last decorations advises to modify the existing file and create an independent automated file for the Royal Order of Civil Recognition to the Victims of Terrorism.

On the other hand, the Ministry of the Presidency manages, in the field of its human resources, various actions related to the training and social action of its employees and with the prevention of risks. work of your staff. These actions have acquired sufficient autonomy, due to the increased complexity and the volume of management to which they give rise, in order to create the corresponding independent automated files.

Finally, the aforementioned Department has a Library that aims to provide documentary assistance to the Ministry's services as well as the classification, cataloging and custody of bibliographic funds, documentaries and archivistics. For the control of the flow of loans and consultations, the proper location of the funds and the provision of medium and long-term forecasts, it is necessary to use a personal data file.

Consequently, this Order has the object, on the one hand, of the creation of the files "Training", "Social Action", "Prevention of Occupational Risks", " Decorations of the Royal Order of Civil Recognition to the Victims of the Terrorism "and" Library Users ". On the other hand, the modification of the file "Decorations", created by Order of 23 September 2001 ("Official State Gazette" of 5 December).

In its virtue, in use of the powers conferred by article 12 of Law 6/1997, of April 14, of the organization and functioning of the General Administration of the State, and in order to comply with the legal mandate, for ensure maximum transparency in the automated processing of personal data, thus ensuring that citizens are entitled to the legitimate exercise of their rights, available:

Article 1. Creating files.

The files "Training", "Social Action", "Prevention of Occupational Risks", "Condecorations of the Royal Order of Civil Recognition to Victims of Terrorism" and "Users Library" are created, which is included in Annex I of this Order, to which the elements contained in Article 20 of the Organic Law 15/1999, of 13 December, of Protection of Personal Data have been incorporated.

Item 2. Modification of a file.

The file "Decorations", created by Order of 23 September 2001 ("Official State Gazette" of December 5), is amended, in the sense given in Annex II of this Order, to which the Article 20 of the Organic Law 15/1999, of 13 December, of Protection of Personal Data.

Article 3. Responsible persons.

The persons responsible for the file shall take the necessary management and organizational measures to ensure the confidentiality, security and integrity of the data, as well as the conduct of the data. guarantees, obligations and rights recognised in the applicable rules.

Article 4. Registration of files.

In compliance with Article 55 of Royal Decree 1720/2007 of 21 December, approving the Regulation on the Development of Organic Law 15/1999 of 13 December on the Protection of Personal Data, the files will be notified for registration in the General Register of Data Protection within thirty days of the publication of this Order in the "Official State Gazette".

Single repeal provision.

All provisions of equal or lower rank are repealed as set forth in this Order.

Single end disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

ANNEX I

Human Resources, Services, and Infrastructure Directorate General

Training

1. Purpose of the file and intended uses for the file: Management and control of requests and assistance to training courses of the Ministry of the Presidency.
