Royal Decree 1887/2011 of 30 December 2011 establishing the basic organic structure of the ministerial departments, as amended by Royal Decree 2/2012 of 5 January, under the authorisation granted to the President of the Government in Article 2.2.j) of Law 50/1997 of 27 November, of the Government, amended the basic organic structure of the Ministry of Foreign Affairs and Cooperation.

Subsequently, Royal Decree 342/2012, of 10 February, for which the basic organic structure of the Ministry of Foreign Affairs and Cooperation is developed, has established the structure of the higher organs and management of the project, up to the level of general or equivalent subdirección, taking into account the criteria for the containment of expenditure and the rationalization of structures and in order to achieve the objectives of rationality and improvement of efficiency in the competence and management areas of the department.

The need to reflect the current structure of the Department as regards the Secretariat of State International Cooperation and for Ibero-America and in order to improve and streamline the efficiency in the management that it develops, advise to make amendments to the current Order AEX/1001/2003 of 23 March, of delegation of competences in the field of personnel, procurement and budgetary management and public expenditure.

Accordingly, and in accordance with the provisions of Article 13 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure and the Additional Disposition The 13th of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, has:

First. Amendment of Order AEX/1001/2003 of 23 March 2003 on the delegation of powers to staff, procurement and budgetary management and public expenditure.

Order AEX/1001/2003 of 23 March 2003, with a delegation of powers to staff, procurement and budgetary management and public expenditure, is amended as follows:

One. The first subparagraph of paragraph 3 is amended as follows:

" In the framework of the jurisdiction in matters of procurement and budgetary and patrimonial management conferred on the holder of the Department by paragraphs 1, 2, 3 and 4 of Article 13 of Law 6/1997 of 14 April 1997, Organization and Operation of the General Administration of the State, delegating to the Secretaries of State of Foreign Affairs, for the European Union and for International Cooperation and for Ibero-America and the Secretary-General for Cooperation International for Development, for expenses less than 1,000,000.00 euros, and always with respect to their respective policy areas, the following: "

Two. The sixth, seventh, eighth, ninth, tenth and tenth of the first paragraphs of Order AEX/1001/2003, of 23 March 2003, become paragraphs seventh, eighth, ninth, tenth, eleventh and tenth, respectively.

Three. A new sixth paragraph is inserted with the following wording:

" Sixth.

Without prejudice to the provisions of the second and third paragraphs, with the prior approval provided for in the additional provision of Law 6/1997 of 14 April, the Secretary of State for International Cooperation and for Ibero-America delegates the exercise of the following powers conferred on it by the legal order:

1. In the Secretary-General for International Cooperation for Development, in his field of action, the following powers:

(a) The procurement powers that correspond to the Secretary of State and are not attributed to the Board of Contracting of the department.

(b) the approval of the expenditure files, the authorisation of their commitment, the recognition and the proposal for the payment of the economic obligations, the approval of the accounts supporting the obligations satisfied, carried out by the system of 'fixed cash advance' and 'payments to be justified', as well as the issuing and signing of the accounting documents relating to them.

c) The conclusion of collaboration agreements with other public administrations, as well as the conclusion of agreements with public bodies and with natural or legal persons subject to private law.

2. In the Director of the Cabinet of the Secretary of State for International Cooperation and for Ibero-America, with the exception of those delegated in paragraph 1, the following powers:

(a) The procurement powers that correspond to the Secretary of State and are not attributed to the Board of Contracting of the department.

(b) the approval of the expenditure files, the authorisation of their commitment, the recognition and the proposal for the payment of the economic obligations, the approval of the accounts supporting the obligations satisfied, carried out by the system of 'fixed cash advance' and 'payments to be justified', as well as the issuing and signing of the accounting documents relating to them. '

Four. Point 3 of the ninth paragraph amends its wording, as follows:

" 3. In the Secretary General of International Cooperation for Development with respect to the staff assigned to the General Secretariat and the Director of the Cabinet of the Secretary of State for International Cooperation and for Latin America, with respect to the rest of staff seconded to that State Secretariat. '

Second. Applicability.

This Order will produce effects from the day following its publication in the "Official State Gazette".
