Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the Official Journal of the State or corresponding official journal. Furthermore, the first provision of that rule directs the public administrations responsible for files to approve the provision of the creation of the same or to adapt the existing provision to the provisions of the law itself.

With Order ARM/2657/2009 of 17 September, which regulates the files of personal data of the Autonomous Body of the National Parks, the same was carried out in accordance with the Organic Law 15/1999, of 13 of In December, in the terms of Article 20 (2) and Article 54 of Royal Decree 1720/2007 of 21 December of 21 December, the implementing regulation of the Organic Law 15/1999 of 13 December 1999 on the protection of data from the personal character. This order was subsequently amended by Order ARM/2742/2010 of 7 October, which created three new files and modified the file called "Patrimonial Liability Files".

The dynamics of the National Park Autonomous Agency makes it necessary to create new files to meet the needs of the administrative unit of the Isla de La Graciosa Center, in which the functions of administration and management of the state's property estates, assigned to the Autonomous Agency National Parks, and the assets of the agency itself, located in the Autonomous Community of the Canary Islands.

The rule is intended to comply with the legal mandate of Article 20 of the Organic Law 15/1999 of 13 December, and to ensure that they are given the exercise of their legitimate rights.

The Spanish Data Protection Agency, the State Legal Service and the Ministry of Agriculture's Ministry of Electronic Administration have issued a report on the production of this report. Environment.

In its virtue, I have:

Article 1. Ownership of the files.

The files contained in the annex to this order are owned by the Autonomous Body.

Article 2. Legal framework.

The files listed in the Annex shall be governed by the general provisions and instructions detailed for each of them and shall be subject, in any case, to the laws and regulations of higher rank than they are applicable to them.

Article 3. Deleting files.

The approval of this order does not imply the deletion of any data files of lack of personal data, so the application of the provisions of article 20.3 of the Organic Law 15/1999 of 13 December, of Protection of Personal Data.

Article 4. Amendment of Order ARM/2657/2009 of 17 September.

The Annex to Order ARM/2657/2009 of 17 September is amended by adding the five files listed in the Annex to this order.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the Official Gazette of the State.

ANNEX

1. File: Auxiliary Register of the Isla de La Graciosa Center.

a) Finality of the file and intended uses of the file: Management of the auxiliary register of entry and exit of documents from the Centro Isla de La Graciosa.

(b) Persons or collectives for which data are intended to be obtained by personal data or which are required to supply such data: natural persons, representatives of legal persons, professionals, public servants and authorities who are directed or received communications from the Isla de La Graciosa Center.

(c) Procedure for the collection of personal data: of the person concerned or his legal representative by means of paper, magnetic or telematic support.

d) Basic file structure and description of the personal data types included in it.

Automated treatment system.

Identifying character data: name, last name, address, location, and entity.

Data related to the document presented: document class, extract of its contents, observations and digitized copy of the document.

(e) Recessions of personal data of a personal nature and, where appropriate, transfers of data that are provided to third countries: To other administrative bodies as provided for in Articles 38 of Law 30/1992, of 26 November, of Legal Regime of Public Administrations and Common Administrative Procedure.

f) Authority of the Administration responsible for the file: Centro Isla de La Graciosa dependent on the Autonomous Agency.

2. File: Fixed box.

a) Finality of the file and intended uses of the file: Accounting control of payments made by the Centro Isla de La Graciosa and the Fincas Cumbres del Realejo Bajo, Iserse and Graneritos.

The uses that are foreseen are the derivatives of the management and control of payments made to suppliers, compensation for reasons of service, etc. of the Centro Isla de La Graciosa and of the Fincas Cumbres del Realejo Bajo, Iserse and Granites.

(b) Persons or collectives on which they are intended to obtain personal data or which are obliged to supply them: natural and legal persons, professionals and staff of the Centro Isla de La Graciosa and the Fincas Summits of the Lower Realejo, Iserse and Graneritos to which payments are to be made.

c) Procedure for the collection of personal data: of the person concerned by means of paper, magnetic or telematic support.

d) Basic file structure and description of the personal data types included in it.

Automated treatment system.

Identifying character data: Name, last name, or social reason, NIF, postal address, location, telephone, fax, email, bank, current account (20 digits).

e) Transactions of personal data of a personal nature and, where appropriate, transfers of data that are provided to third countries: To the State Administration of Tax Administration, pursuant to Law 40/1998, of the Tax on The Income of the Physical Persons.

To the General Intervention of the State Administration, pursuant to the General Budget Law (Royal Legislative Decree 1091/1988).

To the Court of Auditors pursuant to Law 7/1988, of 5 April, of the Functioning of the Court of Auditors and Law 30/2007, of October 30, of Public Sector Contracts.

To banks and savings banks for credit.

3. File: Authorizations.

a) Finality of the file and intended uses of it: Management, control and monitoring of administrative authorizations for the performance of activities and uses made in the Estate Estate of the State of La Graciosa (Lanzarote) and the Fincas Cumbres del Realejo Bajo, Iserse and Graneritos (Tenerife).

The uses that are foreseen are the derivatives of the applications and the granting of administrative authorizations, as well as their management, control and subsequent monitoring of the fulfilment of the established obligations, in the Fincas Heritage of the State of La Graciosa (Lanzarote) and the Fincas Cumbres del Realejo Bajo, Iserse and Graneritos (Tenerife).

(b) Persons or collectives in respect of which data are intended to be personal or which are required to supply such data: natural persons, legal persons or their representatives, public administrations, associations, organizations and institutions.

c) Procedure for the collection of personal data: of the person concerned by means of paper, magnetic or telematic support.

d) Basic file structure and description of the personal data types included in the file:

Partially automated treatment system.

Identification data: name, surname, social reason or representative, NIF, postal address, location, country, fixed telephone, mobile phone, fax, e-mail, type of activity, date of application, date of authorisation, validity, place of business and comments.

e) Personal and personal data transfers of a personal character and, where applicable, data transfers that are provided to third countries: They are not foreseen.

4. File: Videosurveillance in the Administrative Offices of the Isla de La Graciosa Center.

a) Finality of the file and its intended uses: Capture of images of people for security reasons, as provided for in Instruction 1/2006, of the Spanish Agency for Data Protection.

The intended uses are those derived from the safety of persons and the infrastructures and facilities of the Administrative Offices of the Centro Isla de La Graciosa.

(b) Persons or collectives on which they are intended to obtain personal data or which are obliged to supply them: Anyone who visits the Administrative Offices of the "Isla de La Graciosa" Center in Costa Teguise.

c) Procedure for the collection of personal data: by means of electronic devices for capturing images in motion through video cameras or webcam.

d) Basic file structure and description of the personal data types included in it.

Automated treatment system.

Images of identifiable physical persons.

e) Data transfers of a personal character of a personal nature and, where appropriate, transfers of data that are provided to third countries: At the disposal of the State Security Forces and Corps, under the Organic Law 2/1986 of March 13, of Forces and Security Corps, if necessary for the investigation of acts constituting a crime.

f) Authority of the Administration responsible for the file: Centro Isla de La Graciosa dependent on the Autonomous Agency.

a) Finality of the file and its intended uses: Management, control and monitoring of the students enrolled in the Training Courses organized by the Centro Isla de La Graciosa.

(b) Persons or collectives on which data are intended to be obtained by personal data or which are required to supply such data: Any natural person applying for registration in any of the organised training courses by the Isla de La Graciosa Center.

c) Procedure for the collection of personal data: Form of application for registration or participation in any edition of the course cited.

d) Basic file structure and description of the types of personal data included in the file: Name and surname, No. Identity card (ID, passport or residence card) Body or Company to which it represents, address, postal code, location, province, telephone, fax, e-mail; data of the body/company to which it represents: name, address, postal code, locality, province, telephone number, telefax number, email, employee/unemployed, level of studies.

e) Personal and personal data transfers of a personal character and, where applicable, data transfers that are provided to third countries: They are not foreseen.
