The second article of Organic Law 4/2011, of 11 March, complementary to the Law of Sustainable Economy, includes an amendment to Article 25 of the Organic Law 2/2006, of 3 May, of Education, with a new organization of the fourth course of compulsory secondary education.

The effective implementation of this legal provision was made by Royal Decree 1146/2011 of 29 July 2011 amending Royal Decree 1631/2006 of 29 December 2006 laying down minimum teaching corresponding to the compulsory secondary education, as well as the Royal Decrees 1834/2008 of 8 November, and 860/2010 of 2 July, affected by these amendments. The additional provision of this Royal Decree provides for the mandatory implementation of the new teachings from the 2012/2013 course, although the educational administrations are recognized as capable of anticipating their implementation for the project. current course 2011/2012.

According to the Government Program stated in the recent Debate of Investidura, the Ministry of Education, Culture and Sport intends to undertake a review of all secondary education, based on a process of reflection and (i) a detailed discussion on which all sectors of the educational community and educational administrations should be actively involved. Any reform of this educational stage should be based on the shared conclusions drawn from this debate, as the only way to provide the Spanish education system with the necessary regulatory stability that it needs to offer results to society.

In this context, the implementation from the next course 2012-2013 of the news that Royal Decree 1146/2011, of July 29, introduces in the Secondary Education Mandatory, in anticipation of the announced debate, could contribute to creating an inadvisable situation of legal uncertainty and academic instability, which must be avoided. Therefore, it is considered appropriate to defer to subsequent courses the application of those aspects of Royal Decree 1146/2011, of July 29, the implementation of which was not mandatory in this course 2011-2012.

In the process of drawing up this royal decree, the Autonomous Communities have been consulted and the School Council of the State and the Ministry of Finance and Public Administrations have issued a report.

In its virtue, on the proposal of the Minister of Education, Culture and Sport, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting on June 1, 2012,

DISPONGO:

Single item. Amendment of Royal Decree 1146/2011 of 29 July.

Paragraph 2 of the additional provision of Royal Decree 1146/2011 of 29 July 2011 amending Royal Decree 1631/2006 of 29 December 2006 laying down the minimum teaching requirements is amended corresponding to the compulsory secondary education, as well as the Royal Decrees 1834/2008 of 8 November and 860/2010 of 2 July, affected by these amendments, which is worded as follows:

" The implementation of the other amendments incorporated in this Royal Decree is deferred until the academic year 2014-2015, without prejudice to the application of the modifications that, prior to the entry into force of the present royal decree, the educational administrations would have been able to anticipate the course 2011-2012. "

Final disposition first. Regulatory development.

The Minister of Education, Culture and Sport is enabled to dictate, in the field of his competences, how many provisions are necessary for the execution and development of what is established in this royal decree.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
