Law 11/2007, of 22 June, of electronic access of citizens to Public Services, created the concept of "electronic headquarters", justified by "the need to clearly define the" headquarters " electronic administrative with the establishing relationships, promoting a regime of identification, authentication, minimum content, legal protection, accessibility, availability and responsibility. "

Article 10.1 of the same Law defines the electronic headquarters as " that electronic address available to citizens through telecommunications networks whose ownership, management and administration corresponds to a Public administration, body or administrative entity in the exercise of its powers. ' Paragraph 3 of the same Article states that "each Public Administration shall determine the conditions and instruments for the creation of electronic venues".

On the other hand, Royal Decree 1671/2009 of 6 November 2009, for which the Law 11/2007, of 22 June, of electronic access of citizens to public services is partially developed, in addition to regulating this figure in its Articles 3 to 9 specifically determine in Article 3.2 that "the electronic venues shall be created by Order of the corresponding Minister or Resolution of the holder of the Public Body, which shall be published in the Official Gazette of the State", determining the minimum content of this approval rule. This brings to the citizens guarantees of full certainty and security that only partially reached the virtual offices that have so far been channeling the electronic relations with the citizens.

Thus, with the implementation of the headquarters is intended, on the one hand, to reduce to the maximum the dispersion of the services offered by the Harbour Authority of the Bay of Algeciras, in order to facilitate the access to the same and, by another, to create a space in which the Administration and the administration are related in the framework of the administrative management with the necessary guarantees, thus differentiating the concept of the communication portal from the electronic headquarters.

This Resolution has been informed by the Ministry of Public Administration's Ministerial Committee of Electronic Administration in compliance with the provisions of Order FOM/716/2009 of March 4, which regulates the composition and operation of the Commission.

According to the powers conferred by the Royal Legislative Decree 2/2011 of 5 September, approving the recast of the Law of Ports of the State and the Merchant Navy, the creation and regulation of the headquarters The entity was agreed by the Board of Directors of the Port Authority. According to the said Royal Legislative Decree, the president of the Harbour Authority has the task to represent permanently the Harbour Authority and its Board of Directors.

In your resolute virtue:

Article 1. Object and scope of application.

1. The purpose of this Resolution is to create the electronic headquarters of the Port Authority of the Bay of Algeciras (hereinafter referred to as "Headquarters"), in order to comply with the provisions of Article 3 of Royal Decree 1671/2009, 6 of November.

2. The scope of this Resolution extends exclusively to the administrative units belonging to the Port Authority of the Bay of Algeciras.

Article 2. Features of the Electronic Headquarters.

1. All actions, procedures and services that require the authentication of citizens or the Public Administration in their relations with these by electronic means, as well as those with respect to those who decide to be included in the seat for reasons of efficiency and quality in the provision of services to citizens.

2. The electronic reference address of the site shall be https://sede.autoridad portuariadelabahiadealgeciras.gob.es.

3. The ownership of the electronic headquarters will correspond to the Port Authority of the Bay of Algeciras and to the Department of Information Systems the technological management of the Electronic Headquarters.

4. They shall be responsible for the management, the contents and the services made available to the citizens at the headquarters, the owners of the administrative units of the Port Authority of Algeciras, and, where appropriate, of the Agencies that incorporate the headquarters, in accordance with the regulations of the organization and operation of the Harbour Authority and the legislation in force. The management of the common contents of the headquarters and the coordination with the administrative units of the Harbour Authority and the agencies that share the headquarters will correspond to the General Direction of the Harbour Authority.

5. The Headquarters shall include at least the content related to Article 3 of this Resolution.

6. They will be channels of access to the services available at the headquarters:

(a) For electronic access, through the Internet, with the characteristics defined in this article.

b) For in-person care, the offices of the Port Authority of the Bay of Algeciras located on the Avenue of Hispanidad No. 2, according to the competences defined in the regulatory norms of the Port Authority, without prejudice to access through the records referred to in Article 38 of Law 30/1992 of 26 November 1992, of the Legal Regime of Public Administrations and of the Common Administrative Procedure.

c) For telephone attention, information services, on phone 956 585 400.

7. The information and services included in the Headquarters will comply with the principles of accessibility and usability, established in Law 11/2007, of June 22, of electronic access of citizens to public services, in the terms dictated by the rules in force in this area at any time.

8. The contents published in the Headquarters will respond to the criteria of safety and interoperability arising from Law 11/2007, of June 22, of electronic access of citizens to public services, of Royal Decree 1671/2009, as well as of the Royal Decree 3/2010 of 8 January, which regulates the National Security Scheme and Royal Decree 4/2010 of 8 January, which regulates the National Interoperability Scheme.

9. The identification of the electronic seat shall be carried out by means of a recognised certificate of venue, consisting of the certificate of the server in accordance with the provisions of Royal Decree 1671/2009.

Article 3. Contents and services of the Electronic Headquarters.

1. The minimum contents are:

(a) Updated information on the electronic headquarters, including the identification of the seat and the identification of the body responsible for its management and administration.

b) Information necessary for the correct use of the Site including the map of the electronic headquarters, including the corresponding navigation map.

c) Electronic advice services to the user for proper use of the Site

d) Catalog of procedures and services available at the Headquarters.

e) System of verification of the certificate of the Headquarters and of the certificates of electronic seals used at the Headquarters.

f) Relation of electronic signature systems that are admitted or used at the Headquarters.

g) Resolution of the creation of the electronic headquarters of the Port Authority of the Bay of Algeciras.

h) Resolution of the creation of the Electronic Registry of the Port Authority of the Bay of Algeciras

i) Access to the contractor's profile and other services provided by the Public Sector Contracts Act.

j) Data protection and privacy policy of the port authority and liaison with the headquarters of the Spanish Data Protection Agency

k) Link to the Official State Gazette

l) Report on compliance with the conditions of confidentiality, integrity and availability of information and communications that are made through the electronic headquarters.

m) Accessibility information.

n) Official date and time, and days officially declared as non-business

or) Any information or service that the Port Authority considers to be of interest or need.

2. The services available to citizens are:

a) Letter of electronic services of electronic headquarters.

b) Link to general suggestions and complaints.

c) Access to the case processing status through the electronic record.

Article 4. Means for formulating suggestions and complaints.

1. The means available for the formulation of suggestions and complaints in relation to the content, management and services offered at the Headquarters set out in this Resolution shall be as follows:

(a) Form by person, written in the General Register or by registered post addressed to the Presidency of the Port Authority of the Bay of Algeciras, on the Avenue de la Hispanidad nº 2, in Algeciras, or in writing presented in the Electronic Registry of the Headquarters. In the case of a complaint, the procedure laid down in Article 15 of Royal Decree 951/2005 of 29 July 2005 establishing the general framework for the improvement of quality in the General Administration of the State shall be observed.

b) Presentation to Customer Service through existing channels:

-Fill in the web form available at the same Headquarters.

-Sending an email to the customer service e-mail address.

-By fax referred to the phone number enabled for this.

-By calling Customer Service.

2. It shall not be considered as means for the formulation of suggestions and complaints of electronic advice services to the user for the correct use of the site, without prejudice to their obligation, where they exist, to address the problems arising from the use of the citizens.

Single transient arrangement. Commissioning of the site.

The electronic seat that is created in this Resolution shall begin to operate at the time it determines its holder.

Final disposition first. Adaptation of certain characteristics of the site.

May be adapted by Resolution of the Presidency of the Port Authority of the Bay of Algeciras, published in the Official Gazette of the State:

(a) The electronic addresses listed in this Resolution, when they need to be modified for any reason.

b) The denomination of the centers, and responsible units, when derived from organizational reordering.

c) The relationship and characteristics of the access channels to the services available at the site.

(d) Any other characteristic which is not a mandatory entry as provided for in Article 3.2 of Royal Decree 1671/2009 of 6 November 2009, for which Law 11/2007 of 22 June 2007 is partially developed, electronic access of citizens to public services.

Final disposition second. Entry into force.

This Resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
