By the Order of 21 July 1994, which regulates the files with personal data managed by the Ministry of Health and Consumer Affairs, compliance with the provisions of the second of the Organic Law 5/1992, of October 29, regulating the processing of personal data.

Article 20.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, provides that the creation, modification or deletion of the files of public administrations can only be done by means of general provision published in the Official Journal of the State or the official journal concerned.

Consequently, to comply with the provisions of that article and in order to complete the relationship of files with personal data managed by the Ministry of Health, Social Services and Equality and their (a) the Order of 21 July 1994, which regulates the files with personal data managed by the Ministry of Health, Social Services and Equality, and incorporated in Annex 3-Ficheros with personal data on Social Policy-the files for the Council State of the Elderly and the State Reference Center for Personal Autonomy and Technical Assistance (CEAPAT).

In the processing of this order, the Spanish Data Protection Agency has issued a mandatory report.

In its virtue, I have:

Article 1. Creating files.

The content of Annex number 3 "Ficheros with personal data on social policy" of the Order of 21 July 1994, with the creation of fourteen new files called "Data of the members of the Council", is extended State of the Elderly "," Communications and institutional relations agenda "," e-newsletters "," Library users "," Economic and budgetary management file "," Personal and payroll management file "," Users of the Center of State Reference for Personal Autonomy and Technical Aid "," Guided Tours "," Courses and days "," Record of entry and exit of documentation "," Control of Access "," Suggestions and complaints "," Camera of video surveillance "and" Social networks " whose data are listed in Annexes I and II of this order.

Article 2. Management and organization.

The head of the body responsible for these files will, under the top management of the Minister of Health, Social Services and Equality, adopt the necessary management and organizational measures, ensuring, in any case, the confidentiality, security and integrity of the data, as well as the drivers to make effective the guarantees, obligations and rights recognized in the Organic Law 15/1999, of 13 December, of Protection of Personal Data, in the Real Decree 1720/2007 of 21 December 2007 approving the Regulation on the development of the This law provides security measures for automated and non-automated files containing personal data, and in other development standards.

Article 3. Data cession.

The data contained in these files may only be transferred in the cases expressly provided for by law.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

ANNEX I

State Council of Older People

Nature of the Council: The State Council of the Elderly is a Chartered Body of a consultative nature of the General Administration of the State, attached to the Ministry of Health, Social Services and Equality, through the Secretary of State for Social Services and Equality. It is regulated by Royal Decree 117/2005 of 4 February, which regulates the State Council of Older Persons.

a) Identification of the file, indicating its name, as well as the description of its intended purpose and uses:

File Identification: "Data of the Members of the State Council of Older Persons".

The purpose of the file is to use it as a source of information in order to provide data of the counselors who are an integral part of this advisory body under the General Administration of the State, through the Ministry of Health, Social Services and Equality.

The uses that will be made of the file, as a base of information, are the derivatives of the query that can be made by any person who accesses the Web page of the Imserso and is introduced in the section or tab of the State Council Senior citizens to know who are the components of the State Council of Older Persons.

The purpose of the file is the management and maintenance of an agenda containing personal data of representatives of private entities, Public Bodies, natural persons, and NGOs with which the Reference Center State of Personal Autonomy and Technical Aid maintains some kind of institutional, contractual or collaborative relationship.

The uses of the file are concretized in the referral of communications to the holders of the personal data.

Origin: Data is provided directly by the person concerned, or legal representative. In addition, personal data is obtained from sources accessible to the public.
