Article 20.1 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of files of Public Administrations may be made only by means of general provision published in the Official Journal of the State or the official journal concerned.

This same requirement was already imposed in article 18 of the Organic Law 5/1992, of October 29, of Regulation of the Automated Treatment of Personal Data, which was repealed by the aforementioned Organic Law 15/1999. In accordance with the provisions of Article 18, the Order of the Ministry of Public Works of 4 October 1999 was approved in order to update the relationship of automated files of personal data of the Ministry of Public Works.

After the order that has just been mentioned, several orders were approved in which modifications were made to the relationship of files of the Department, among them Order FOM/2606/2010, of September 9, by the the relationship of personal files of the Port Authority of Motril has been updated. By means of the order now approved, the list of files of the Ministry of Public Works is updated again, in order to create a new file and to modify one of the currently existing ones, of which the Harbour Authority of Motril.

It is to be noted that this order has been informed, during its processing, by the Spanish Data Protection Agency.

In its virtue, I have:

First. Creating files.

In Annex I of this order, the new creation file called the Input and Output Registry, corresponding to the Port Authority of Motril, is related to the set of data files of character Staff of the Ministry of Public Works.

In Annex I, the responsible organ and service or unit to which the rights of access, rectification and cancellation can be exercised; the name of the file; the purpose of uses; the persons or groups of the which is intended to obtain personal data or which are required to supply it; the procedure for collecting the data; the basic structure of the file; the intended disposals of such data, where appropriate; and the files.

The security measures set out in the relevant paragraph are those that are applicable in accordance with the provisions of Royal Decree 1720/2007 of 21 December 2007 on the implementation of the Regulation on the development of the Organic Law 15/1999, of December 13, of Protection of Personal Data.

Second. Modifying files.

Annex II to this order contains the modification of the file of the Port Authority of Motril as set out in the Annex to Order FOM/2606/2010 of 9 September 2010 updating the list of personal data of the Ministry of Public Works (Port Authority of Motril), called Infractions, incorporating in the basic structure data relating to administrative offences.

Third. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
