The Royal Decree 1879 / 1996, of 2 August, which regulates the composition of the National Commission on safety and health at work, established the National Commission, as a College advisor to Governments in the formulation of policies of prevention and organ of institutional participation in the field of safety and health at work It is made up of representatives from the General Administration of the State, the administrations of the autonomous communities and representatives of the most representative trade unions and business organizations.

The scope of the General Administration of the State established seventeen members representing different then existing ministries.

Then the successive restructurings of the ministerial departments carried out in 2000, 2004, 2008, 2009 and 2010 forced to amend the Royal Decree 1879 / 1996, of 2 August, in order to adapt the distribution of the number of members of the General Administration of the State to the new ministerial structures. It took effect by the Royal Decrees 309/2001, of March 23, 1595 / 2004, of July 2, 1470 / 2008 of 5 September, 1429 / 2009, of 11 September and 1714 / 2010, of 17 December.

Currently, the Royal Decree 1823 / 2011, of 21 December, which is restructuring the ministerial departments, and the Royal Decree 1887 / 2011, of 30 December, which establishes the basic organizational structure of the ministerial departments, have established a new organization of the departments of the General Administration of the State. Due to these changes in the structure, powers and designations of the various ministerial departments, it is necessary to adapt to this new situation the representation of the scope of the General Administration of the State, which is part of the National Commission on safety and health at work, provided for in article 2 of the Royal Decree 1879 / 1996, of 2 August.

By virtue, on the proposal of the Minister of employment and Social Security, with the prior approval of the Minister of finance and public administration, and prior deliberation of the Council of Ministers at its meeting of June 1, 2012, available: single article. Modification of the Royal Decree 1879 / 1996, of 2 August, which regulates the composition of the National Commission on safety and health at work.

The Royal Decree 1879 / 1996, of 2 August, which regulates the composition of the National Commission on safety and health at work, is to be re-worded as follows: one. Paragraph a) of article 2(1) is worded as follows: «to) the Presidency will be held by the holder of the Secretary of State for employment.»

Two. Paragraph b) of article 2(1) is drawn up in the following terms: «b) four Vice-Presidencies, one by each of the groups that compose it, being the holder of the Undersecretary of health, social services and equality within the scope of the General Administration of the State.»

3. Paragraph c) article 2(1) is worded in the following terms: «c) seventeen members in the field of the General Administration of the State, with the rank of director general or equivalent, representing: 1. Ministry of finance and public administration, two vocal.»

2. Ministry of the Interior, two vowels.

3. Ministry of public works, a vowel.

4. Ministry of education, culture and sport, a vowel.

The references to in the Royal Decree 1879 / 1996, of 2 August, which regulates the composition of the National Commission on safety and health at work, are made to the Ministry of labour and immigration, according to the sole additional provision of the Royal Decree 1429 / 2009, of 11 September, are to be understood made to the Ministry of employment and Social Security.

This Royal Decree shall enter into force the day following its publication in the "Official Gazette".
