By the Order of 21 July 1994, which regulates the files with personal data managed by the Ministry of Health and Consumer Affairs, compliance with the provisions of the second of the Organic Law 5/1992, of October 29, regulating the processing of personal data.

Article 20.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, provides that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the Official Journal of the State or Official Journal.

Since its publication, the Order of 21 July 1994 has been the subject of numerous modifications and updates, and it is now necessary to proceed to a new amendment in order to create a new file with character data. personnel; this file will allow to manage the users of the ARGOS system, and this in the framework of the different activities carried out by the Directorate General of Public Health, Quality and Innovation in relation to the laboratory analysis, part of the physical checks applied to foodstuffs from imports of third countries.

According to all of the above, it is necessary, through this order, and after the Spanish Data Protection Agency report, to create a new personal data file managed by the Ministry of Health, Social Services and Equality.

In its virtue, I have:

Article 1. Creating a file.

The contents of Annex 2 "Administrative Character Ficheros" of the Order of 21 July 1994 are extended, with the creation of a new automated file, called Argos, whose data are listed in the Annex of this order.

Article 2. Management and organization.

The head of the body responsible for these files will, under the top management of the Minister of Health, Social Services and Equality, adopt the necessary management and organizational measures, ensuring in any case the confidentiality, security and integrity of the data, as well as the drivers to make effective the guarantees, obligations and rights recognized in the Organic Law 15/1999, of December 13, and in its standards of development, and in the Royal Decree 1720/2007 of 21 December 2007 on the adoption of the Regulation on the security of the automated and non-automated files containing personal data.

Article 3. Data cession.

The data contained in these files may only be transferred in the cases expressly provided for by law.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".

ANNEX

Filename: ARGOS

● Finality of the file: obtaining data from the laboratory analysis derived from the physical controls applied to the food products from third countries imported in the framework of the activities conducted by the General Foreign Health Subdirectorate.

● Persons or collectives on whom data of a personal nature are intended or required to be supplied: users of ARGOS designated by the laboratories covered by one of the user profiles of the application.

● Personal data collection procedure: Directly from the data subject.

● Data transfer of personal data and/or data transfers that are provided to third parties: No disposals are foreseen.
