Law 3/2013, of 4 June, of the creation of the National Commission of the Markets and the Competition has established a new distribution of competences between that agency and different Ministries, among them the Ministry of Promotion, attributing to this last new function.

Law No 3/2013 of 4 June provides for a transitional situation until the Ministries with devolved powers assume the effective exercise of the same.

This transitional situation consists in the National Commission of the Markets and the Competition continuing to exercise the functions transferred to the Ministries until they have the necessary means for the exercise of their new competencies, modify their budgets to adapt them to the new competition structure and subsequently modify their actual structure decrees.

In this regard, the fourth paragraph of the fourth paragraph of Law No 3/2013 of 4 June, gives the Government the power to approve the necessary changes in the real decrees for the development of the basic organic structure. of the Ministries concerned, including the Ministry of Public Works.

Also, pursuant to the provisions of the transitional provision sixth, paragraph 3, of Royal Decree 657/2013 of 30 August 2013, which approves the Organic Statute of the National Commission on Markets and Competition, establishes that the date of the commencement of the effective exercise of the functions transferred by these Ministries will be determined by order of the Minister of the Presidency, on the proposal of the affected ministerial departments and the Ministries of Economy and Competitiveness and Finance and Public Administrations.

Therefore, given that the National Commission of the Markets and the Competition initiated its operation on 7 October 2013 and in order to comply with the provisions of the fourth paragraph of Article 4 (1) of the Treaty, Law 3/2013 of 4 June, and in order to enable the Ministry of Public Works to assume and manage the new powers conferred on it by this provision, it is necessary to amend Royal Decree 452/2012 of 5 March, for which the Ministry of Public Works the basic organic structure of the Ministry of Development and amending Royal Decree 1887/2011, of December 30, by the establishment of the basic organic structure of the ministerial departments.

In its virtue, at the initiative of the Minister of Public Works, at the proposal of the Minister of Finance and Public Administrations and after deliberation of the Council of Ministers at its meeting on February 27, 2015,

DISPONGO:

Single item. Amendment of Royal Decree 452/2012 of 5 March, for which the basic organic structure of the Ministry of Development is developed and amended by Royal Decree 1887/2011 of 30 December 2011 establishing the basic organic structure of the ministerial departments.

Real Decreto 452/2012, of 5 March, for which the basic organic structure of the Ministry of Development is developed and the Royal Decree 1887/2011 is amended, of 30 December, for which the organic structure is established The basic principle of the ministerial departments is amended as follows:

One. Article 11 (7) is worded as follows:

"7. Under the Ministry of Public Works, under the Secretariat:

a) The Public Works Council.

(b) The Commission for the investigation of accidents and incidents of civil aviation.

(c) The Commission for the investigation of rail accidents.

(d) The Standing Committee for the Investigation of Maritime Accidents and Incidents. "

Two. Article 12 (1) (n) is read as follows:

the definition of the policies for the development of the universal postal service; the drawing up of the general provisions on postal matters; the monitoring and reporting of Community policies; and development cooperation in the postal sector; participation in national and international postal organisations, without prejudice to those of the National Commission on Markets and Competition; resolution of disputes; complaints and complaints from users in the field of the universal postal service; powers of inspection and sanction in the field of competition; the system of authorizations, collection of postal charges and the management of the General Register of postal services companies; information to users of the conditions of the provision of postal operators; the management of the Postal Superior Council, the Philatelic Commission of the State and the Council of the Civil Order of the Postal Merit and the Philatelic Medal of Merit, and the proposal for the establishment of minimum services of a mandatory nature to ensure the provision of the universal postal service. "

Final disposition. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
