By Royal Decree 257/2012 of 27 January, the basic organic structure of the Ministry of Education, Culture and Sport was developed, the higher and managerial bodies were determined up to the organic level of Subdirección. The competencies of each of these bodies were defined and defined.

In order to ensure an adequate provision of services of the organs of the Department was ordered its management with the different delegations in the decision-makers of the management bodies by Order ECD/465/2012, of 2 of March, delegation of powers of the Ministry of Education, Culture and Sport.

It is now, however, and in view of the experience gained in its implementation, to amend the heading dedicated to the delegation of powers in respect of compensation for service reasons, in order to improve the functioning of the management bodies integrated in the Directorate-General for Fine Arts and Cultural Property and Archives and Libraries.

On the other hand, and in order to duly attend to requests for information arising from the entry into force of Law 19/2013, of 9 December, of transparency, access to information and good governance, it is approved, with this Order, the delegation of the Under-Secretary to other management bodies of certain resolutions provided for in this Law.

In accordance with the provisions of Articles 13 and concordant of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and in accordance with the provisions of the Additional provision of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, and Article 20 of Law 50/1997 of 27 November of the Government, available:

First.

1. A point (i) is added to point 5 of the third subparagraph of heading IV 'Delegation of powers to compensation for service reasons', which is worded as follows:

" i) In the Deputy Directors-General directly dependent on the Directorate General of Fine Arts and Cultural and Archives and Libraries, with respect to the staff of each unit and the non-dependent persons of the Ministry to participate in programs or activities of any kind of these units. "

2. A point (h) is added to point 6 of the third paragraph of heading IV 'Delegation of powers to compensation for service reasons', which is worded as follows:

"(h) The Deputy Directors-General directly dependent on the General Directorate of Fine Arts and Cultural Property and Archives and Libraries, with respect to the personnel who depend on each of them."

3. Point 4 of the first paragraph of point VIII of the heading VIII 'Delegation of powers in other matters' shall be amended as follows:

" 4. The delegation by the Under-Secretary of the following powers is hereby approved in the heads of the following management bodies:

(a) In the Technical Secretary General, the impetus and coordination of the Ministry's relations with the courts.

b) In the Deputy Directors-General directly dependent on the Secretariat, in the field of their respective powers, the resolution of requests for access to information under Law 19/2013, 9 of December, transparency, access to information and good governance. "

Second. Entry into force.

This order shall enter into force on the day of its publication in the "Official State Gazette".
