PREAMBLE

I. Justification

The National Library of Spain (BNE) keeps the memory of the Spanish State; it preserves knowledge and disseminates knowledge. It is an institution open to the service of citizens who, over time, has been able to adapt permanently to a future of innovation and to the scientific, technological and cultural changes of society. It is also the information and documentary reference center on Spanish-language written culture at the national and international levels.

The National Library of Spain has guaranteed for more than 300 years the conservation of the different cultures of Spain and its transmission to future generations. Its history during this long period of time has been parallel to Spain's own history and its collections reflect the evolution of literary creation, thinking, art, music and Spanish science.

The National Library of Spain must today, and in the future, continue to fulfill its specific mission in a context of technological change and permanent innovation, adapting to an environment in which radical changes have taken place in Spain. the way to create, edit, disseminate and access culture, which has generated new forms of storage, conservation and transmission of knowledge in a world where content is prevalent and not supports.

At the present time, the National Library of Spain develops its mission in a changing environment that requires the definition of a new library model. In a context in which culture is generated in different types of media and in which the contents have a high degree of obsolescence, the National Library of Spain must guarantee the conservation, preservation and transmission of information and knowledge through a model with more agile functional and organic structures. On the other hand, there has been a significant change in both internal working procedures and user services. The adaptation to information and knowledge technologies requires new approaches to the public service, with higher levels of demand, that guarantee accessibility to its collections and services not only in an in-person way, but also through the development of technological innovation projects that facilitate greater accessibility and use of their collections from anywhere in the world.

Your consideration as the first Spanish library institution makes it a reference centre and advice for the development of library policies aimed at generating improvement projects in the field. Spanish. It is also necessary to strengthen its role as a centre for the creation of professional standards and the coordinator of cooperation projects which involve the implementation of common information access instruments and provide effective services for other Spanish institutions.

The important task of the National Library of Spain as a center of support for scientific and technical research, recognized in Law 14/2011 of 14 June of Science, should also be promoted. Technology and Research, favoring the creation and dissemination of knowledge about Spanish culture and science and encouraging the reuse of information that it generates as a strategic value for development.

To this must be added the role that in a globalized world the National Library of Spain must fulfill as an international reference center for access to information and knowledge in Spanish, especially in relation to those countries with which a common history and language are shared.

On the other hand, the National Library of Spain, as a public institution, must adopt the necessary evaluation mechanisms that will facilitate the maximum efficiency in its management, in such a way that the processes are improved internal as the service it provides to the citizenry.

The Spanish National Library should also continue to promote its policy of openness and outreach to the citizenry, promoting the achievement of its aims and the dissemination of its collections through the development of a cultural programming aimed at different audiences, which results in more training and better access to culture. It is also necessary to work on actions that support and encourage research on the collections that are preserved in such a way as to generate greater knowledge and dissemination about the Spanish culture.

II. From the Royal Public Library to the National Library of Spain

It was created in 1711 by Felipe V as Real Public Library. Since then it has remained faithful to its basic principle of gathering, cataloging, preserving, disseminating and transmitting the Spanish bibliographic and documentary heritage.

The National Library of Spain opened its doors to the public on March 1, 1712. It was the will of its founder, Philip V, first king of the Bourbon dynasty, aware of the role of the books and convinced of the need of culture as a means of advancement and improvement of societies, to make available to the Spanish own collections of his library to which the royal collection from the Austrians joined. For more than 300 years, libraries of nobles, scholars and bibliophiles have been added to this foundational core, collections from the write-downs, copies through the legal deposit or purchase or donation, giving place of an exceptional set of great patrimonial value that, from the first moment, became the center of the Spanish cultural production.

In 1716, by means of a royal privilege, the obligation was decreed for the printers to deposit in the Library a copy of all that was printed in Spain. This privilege is the antecedent of the current Law 23/2011, of July 29, of Legal Deposit, by which the editors of the cultural production, in any kind of support, must deposit a certain number of copies in the Library National of Spain, making it the place where the memory of the Spanish culture is preserved.

In 1761, the Foundation of the Real Printing Press linked the work of the Library to the most outstanding printers, bookmakers and engravers of the time.

During the eighteenth century its collections were increased and its internal organization was stabilized, which allowed it in the second half of the nineteenth century to evolve to become a National Library, to consolidate its mission as an institution responsible for the conservation and dissemination of the Spanish bibliographic and documentary heritage, and increase its public library character in the service of the citizenry. Also during the nineteenth century and as a result of the successive depreciation, entered into the National Library funds from convents, cathedrals, lobbyists and military orders, which meant an important increase of its collections, both for the high number of volumes and for the value of their assets. Private collections of scholars and bibliophiles of great heritage value were also acquired at this time. The growth of its collections in a moment of stability and its consideration as a public library and institution fundamental to the Spanish culture gave rise to a time of splendor and the consolidation of the National Library as fundamental institution for the history of Spain.

In 1985, by means of Royal Decree 565/1985, of April 24, the National Library of the National Library, the Hispanic Bibliographic Institute and the Center of the Documentary and Bibliographic Treasury are integrated.

Throughout its long life, the National Library of Spain has gone through several periods and has changed its name according to changes in its dependence and its consideration. Between 1712 and 1836 it was Royal Library to pass in 1836 to be called the National Library and in 2009, after the approval of its new Statute, National Library of Spain.

The National Library of Spain, which currently has two offices, the building of Paseo Recoletos, opened to the public in 1896, and its second headquarters of Alcalá de Henares, inaugurated in 1993, is the institution where it is preserved, broadcasts and transmits the Spanish written, graphic and audiovisual culture and reference centre for international Hispanism. Its collections-of incalculable heritage value-include manuscripts, incunables, old prints, prints, drawings, photographs, sound and audiovisual recordings, scores, maps, press, magazines, posters and other materials. This fund continues to be increased through the legal deposit, purchase, donation or exchange.

III. Legal history. Administrative developments

The first formal organization of the Library took place through the Royal Decree on the foundation on January 2, 1716, which also served to approve the so-called first Constitutions. These, in twenty articles, already declared the public character of the Library, open to "all kinds of teachers" or "to all scholars", and established the competencies and duties of the various "officers". That same year, by Royal Decree of October 15, it was regulated the obligation to deposit in the Library a binding copy of everything that was printed in the Kingdom.

In 1750 the deadline of eight days was established for the Royal Library to exercise the right of tanteo on the copies put up for sale, which allowed the acquisition, through auctions, of heritage copies value for Spanish culture.

In 1761 Carlos III approved new Constitutions that modified those of 1716, for which new rules of operation were established, and which emphasized the character of public institution in the service of users, and was founded the Real Printing Press.

In 1836 the Royal Public Library became dependent on the Ministry of Government and changed its name to the National Library, consolidating its mission as an institution responsible for the conservation and dissemination of the Spanish bibliographic and documentary heritage.

The Organic Decree of 1856 and the Rules of Operation of 1857, which replaced the old Constitutions of 1761, reinforced it in its vocation as a public library and in its role as a Spanish bibliographic center.

In 1896 a new Royal Decree regulated the obligation to deliver all printed works to the National Library and in 1930 its Board of Trustees was created.

In 1932 it was established that the address of the National Library was to be performed by a member of the Optional Body.

In 1957, a new Organic Decree and a Library Regulation was approved that attempted to modernize its structure. In the same year the Regulatory Regulation of the Legal Deposit was approved.

By means of Royal Decree 848/1986, of April 25, the functions are determined and the basic structure of the Library is approved, then developed by Ministerial Order approved the same year.

Law 31/1990, of December 27, of the General Budget of the State for 1991, transformed the National Library into the Autonomous Body and by Royal Decree 1581/1991, of 31 October, its regulatory statute was approved. Recently, through Royal Decree 1638/2009 of October 30, the new Statute was approved, for which the Agency adopted its current name, National Library of Spain.

On July 29, 2011, the Law of Legal Deposit, which included electronic documents and websites, was approved, thus adapting the Spanish National Library's conservative and transmitting mission to the new ones. knowledge supports.

IV. Content of the Act

With this Law, according to the provisions of article 63.1 of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, without altering the character of the autonomous body of the Institution, specific peculiarities are established regarding its organization and its economic resources, in order both to achieve the stability that the National Library of Spain needs for the fulfillment of its purposes, as well as more efficient management of your resources.

Chapter I regulates the name, nature, legal status, autonomy and purpose and functions of the National Library of Spain. The institution shall maintain its nature as an autonomous body and its own legal personality with management autonomy in accordance with the provisions of this Law and the other applicable rules.

The general purpose is also to gather, describe and guarantee the protection, enrichment, conservation and transmission in the exercise of its functions, the bibliographic and documentary heritage, both the produced in Spain as the one generated by the Spanish culture "," to guarantee the access and dissemination of its collections in order to promote its use, as a means of cultural, social and economic enrichment ", as well as" promote and develop Library policies in relation to the bibliographic and documentary heritage ".

In Chapter II, the organization of the National Library of Spain is regulated, and establishes that it will be the governing bodies of the Presidency, the Royal Board and the Directorate.

The Presidency of the National Library of Spain corresponds to the holder of the Ministry of Education, Culture and Sport, which corresponds to "the high management of the Agency", " the approval of the multi-annual strategic plan, the annual plan of objectives, the annual report of activities and the preliminary draft budget of the Agency "," the control of the effectiveness of the management of the Agency "and" to raise to the Council of Ministers proposal for the appointment of the person to occupy the Address of the National Library of Spain, after consulting the Royal Patronato consideration shall submit the criteria to be taken into account for the appointment. At the head of the Agency there will be a person in charge of the Directorate with a category of Director General, who will be appointed and separated by Royal Decree agreed upon in the Council of Ministers. Its designation will address the principles of merit, capacity and suitability.

It is up to the Spanish National Library Directorate to direct the management of the Agency, adopting the measures that lead to the fulfillment of the aims and objectives indicated by the Royal Board of Trustees, to show its representation In the absence of the person holding the Presidency, the recruitment on behalf of the Agency, the provision of expenditure, the management of payments and the accountability to the Court of Auditors, through the general intervention of the Administration of the State, in the terms laid down in Law 47/2003, of 26 November, General Budget, as well as those other functions assigned to it by the Staff Regulations.

It is expected that the Statute of the National Library of Spain will regulate the composition and functioning of a Scientific Committee, with consultative functions. It is also established that the Staff Regulations shall constitute and regulate the Governing Board.

Chapter III regulates the staff regime of the National Library of Spain. Such personnel, in accordance with the provisions of Article 47.1 of Law 6/1997, of April 14, of the Organization and the Functioning of the General Administration of the State, shall be an official or labor personnel, in the same established terms for the General Administration of the State.

In Chapter IV, the patrimonial regime is regulated, recognizing that the National Library of Spain will have its own patrimony and that it will also be able to have, in the capacity of goods assigned, assets of the State's patrimony.

The management and administration of these assets will be exercised in accordance with the provisions of Law 33/2003 of 3 November of the Heritage of Public Administrations and, in respect of goods of cultural interest, submit to the regime established by Law 16/1985 of 25 June of the Spanish Historical Heritage.

Chapter V regulates the employment arrangements, economic resources, income from own activities and the disposal of spaces, participation in companies and foundations, the budgetary regime, the accounting system and economic-financial control.

In the regulation of the contracting regime, a general referral is made to the recast text of the Law on Public Sector Contracts, approved by the Royal Legislative Decree 3/2011 of 14 November.

Among the economic resources it is anticipated that the Royal Patronato " will carry out an active job of attracting own resources, especially the derivatives of the contributions free of charge from private and private entities and of the revenue received as a result of the sponsorship of installations. '

It is established that the National Library of Spain may participate in societies or foundations that have common purposes with the Library.

Economic and financial control will be set out in Law 47/2003 of November 26, General Budget, and other rules that will be applicable.

In the first provision, it is established that, in order to contribute to the dissemination of the multilingual heritage of the Spanish State, the use of the various official languages of the State will be promoted. The second provision provides that facilities and services provided shall be accessible to persons with disabilities. The appointment of the new members of the Royal Patronate is regulated in the single transitional provision.

CHAPTER I

General provisions

Article 1. Name and nature.

The National Library of Spain is an autonomous body of those provided for in Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, attached to the Ministry of Education, Culture and Sport and part of the Spanish Library System, as established by Law 10/2007, of June 22, of reading, of books and libraries.

The Spanish National Library is the repository of the Spanish bibliographic and documentary heritage that is produced in any kind of medium or medium. Its mission is to gather, catalog, preserve, increase, manage, disseminate and transmit, in compliance with its aims, the Spanish bibliographic and documentary heritage and on Spain published abroad, as a source of knowledge for all the Spanish and international society, guaranteeing their integrity and facilitating access to all citizens and future generations.

Article 2. Legal regime and autonomy.

1. The National Library of Spain has its own distinct public legal personality, its own assets and treasury, as well as its management autonomy, and will adjust its actions to the provisions of this Law; Law 16/1985, of 25 June, of the Historical Spanish; in Law 10/2007, of June 22, of the reading, of the book and of the libraries; in Law 33/2003, of 3 November, of Patrimony of the Public Administrations; in Law 6/1997, of April 14, of Organization and Operation of the General Administration of the State; in Law 47/2003 of 26 November, General Budget; In Law 23/2011, of July 29, of legal deposit; in the Royal Legislative Decree 3/2011, of 14 November, for which the recast text of the Law of Public Sector Contracts and other provisions applicable to the agencies is approved standalone.

2. According to the provisions of article 63.1 of Law 6/1997, of April 14, of the Organization and the Functioning of the General Administration of the State, the National Library of Spain, for the fulfillment of its aims and the development of its functions, will be governed in its performance, in addition, by the specialties provided for in this Law.

Article 3. Purposes and functions.

The following are essential purposes of the National Library of Spain:

1. To gather, describe and guarantee the protection, enrichment, conservation and transmission, in the exercise of its functions, of the bibliographic and documentary heritage, both the produced in the Spanish State and the generated one on its different cultures. To achieve this end, you develop the following functions:

a) Act as a depositary and conservation center for the Spanish cultural production on any medium, including electronic documents and websites, in the terms established by the law on the legal deposit and exercise high inspection and monitoring of compliance.

b) Cataloging and describing physical and digital collections in such a way as to ensure access to and recovery of all information on the bibliographic and documentary heritage.

c) Develop the bibliography of the Spanish State in a way that serves as an updated reference tool for the bibliographic control of the editorial production and the creation of catalogues of its libraries.

d) Increase their collections, especially those of greater value and significance for the bibliographic and documentary heritage.

e) Ensure the preservation and preservation of your collections through the realization of the necessary preservation plans and the appropriate security measures.

f) Collect, preserve and preserve digital content on Spanish cultures and ensure their conservation and accessibility for economic, cultural, research or information purposes.

2. To ensure the access and dissemination of their collections in order to promote their use as a means of cultural, social and economic enrichment. To achieve this end, you develop the following functions:

a) Encourage scientific research and knowledge about the different cultures of the Spanish State, providing quality services to researchers.

b) Develop an active policy of digitisation of its collections to ensure its preservation and to encourage the creation of the digital library of the Spanish State's bibliographic and documentary heritage.

c) Develop a programming of exhibitions and cultural activities that meet the objective of spreading the value of their collections and bringing the institution closer to the citizenry.

d) Promote and support research programs aimed at generating knowledge about their collections, establishing dialogue spaces with research centers and researchers from around the world.

3. Promote and develop library policies in relation to the bibliographic and documentary heritage of the Spanish State. To achieve this end, you develop the following functions:

(a) Exercise of the reference centre in the field of technical library regulations, by means of its preparation and updating, in order to promote cooperation projects.

b) Participate actively in forums, federations, foundations, colleges, associations and other professional organizations, as well as in programs and projects, both nationally and internationally, primarily those of European and Ibero-American scope.

c) Encourage and collaborate in training programs related to the library profession and documentation sciences.

d) To promote and collaborate in the creation of bibliographic catalogues and collective databases, as well as in the unification of libraries and digital repositories, in such a way that it contributes to improving access to the heritage bibliographic and documentary.

CHAPTER II

Organization and operation of the National Library of Spain

Article 4. Governing and consultative bodies of the National Library of Spain.

1. The governing bodies of the National Library of Spain are as follows:

a) The Presidency.

b) The Royal Patronate.

c) The Address.

2. The advisory bodies are the Governing Board and the Scientific Committee. The Statute of the National Library of Spain shall regulate the composition and operation thereof.

Article 5. The Presidency of the National Library of Spain.

1. The Presidency of the National Library of Spain corresponds to the holder of the Ministry of Education, Culture and Sport.

2. Corresponds to the Presidency:

a) The Agency's senior management.

(b) The approval of the multiannual strategic plan, the annual plan of objectives, the annual activity report and the preliminary draft budget of the Agency.

c) The effectiveness of the Agency's management.

(d) Elevate the proposed Council of Ministers for the appointment of the person in charge of the Directorate of the National Library of Spain, after consulting the Royal Board of Directors whose consideration will be given to the criteria to be taken into account for the appointment.

Article 6. The Royal Board of the National Library of Spain. Composition.

1. The Royal Patronato is the collegiate governing body of the National Library of Spain.

2. The Presidency of honour of the Royal Patronate corresponds to SS.MM. the Kings of Spain.

3. The Royal Board of Trustees is composed of a minimum of seventeen members and a maximum of thirty, eleven of whom will have the status of natos under the Statute, three of them representatives of the libraries of the autonomous communities, rotatably appointed by the Sectoral Culture Conference.

4. The other members shall be appointed and shall be appointed and separated by the person holding the Ministry of Education, Culture and Sport among persons of recognised prestige or competence in the field of culture, scientific research and the economy or have distinguished themselves by their collaboration or support to the National Library of Spain, taking into account the principle of the balanced presence of women and men. The appointed vowels shall have their term of office for three years, which may be renewed for periods of equal duration. 5. The plenary session of the Royal Board of Directors will elect, among the vowels by appointment, those holding the Presidency and the Vice-Presidency, who will be appointed by the head of the Ministry of Education, Culture and Sport for a period of five years. Furthermore, the plenary session, on a proposal from the Directorate, will appoint the head of the Secretariat, who will be an official of the National Library of Spain and will not hold the status as a member of the Board of Trustees.

6. The Board of Trustees shall have a Standing Committee whose composition shall be as set out in the Staff Regulations.

Article 7. Operation of the Royal Board of the National Library of Spain.

The Royal Board acts in plenary and in the Permanent Commission. The plenary session shall be composed of all its members.

The Board of Trustees shall meet at least twice a year in ordinary session and as many as necessary in an extraordinary session upon convocation of the Presidency.

Article 8. Functions of the Royal Patronate.

1. The Presidency of the Royal Board will hold the institutional representation of the National Library of Spain and will convene and chair the Royal Board in plenary and in the Permanent Commission.

2. The Royal Board of Trustees will establish, within the framework of this Law and the Statute, the principles of organization and management of the National Library of Spain, determine the guidelines of its performance and ensure its compliance with the terms that set the Staff Regulations.

3. The Permanent Commission will promote and supervise the strategy and the lines of action of the National Library of Spain established by the Plenary of the Royal Board, in the terms determined by the Statute.

Article 9. The Directorate of the National Library of Spain. Appointment and duties.

1. The person in charge of the Directorate, who will have a category of director general, will be appointed and separated by royal decree agreed upon in the Council of Ministers, on the proposal of whoever holds the Ministry of Education, Culture and Sport, taking care of criteria of professional competence and experience in relation to the aims and objectives of the National Library of Spain.

For these purposes, a system of preselection will be used to guarantee the publicity and concurrency, and to ensure the participation of the Royal Patronato, with the advice of professionals from the library and documentary field. Its designation will address the principles of merit, capacity and suitability.

2. It is the responsibility of the Directorate of the National Library of Spain to direct the management of the Agency by adopting the measures that lead to compliance with the guidelines of action outlined by the Royal Board of Directors, to show their official representation in the absence of the person holding the Presidency, the recruitment on behalf of the Agency, the provision of expenditure, the management of payments and the accountability to the Court of Auditors, through the General Intervention of the Administration of the State, in the terms laid down in Law 47/2003, of 26 November, General Budget, as well as those other functions conferred by the Staff Regulations.

Article 10. The Scientific Committee.

The Statute of the National Library of Spain will regulate the composition and functioning of a Scientific Committee responsible for advising on the participation of national and international research programs and projects that study the collections of the National Library of Spain, as well as in all those aspects related to the generation of contents aimed at providing a better knowledge about the collections and to develop development projects and technological innovation.

CHAPTER III

Staff Regime

Article 11. Staff of the National Library of Spain.

1. In accordance with the provisions of Article 47.1 of Law 6/1997 of April 14, the staff at the service of the National Library of Spain will have the consideration of public employees subject to Law 7/2007, of October 12, of the Statute Public Employee Basic, and other matching rules.

2. The staff at the service of the National Library of Spain will be subject to the system of incompatibilities established in general for the staff at the service of the public administrations.

CHAPTER IV

Patrimonial regime

Article 12. Estate regime.

1. The National Library of Spain shall have, for the fulfilment of its purposes, a patrimony of its own, other than that of the General Administration of the State, consisting of the set of assets and rights of which it is a holder.

2. They shall also be assigned to the Agency for the fulfilment of their purposes the assets of the State's assets as agreed by the body concerned.

3. The management and administration of the property and rights, as well as those of the State's assets which are assigned to it for the purpose of its purposes, shall be exercised in accordance with the provisions of the Staff Regulations, subject in any case to the established for public bodies in Law 33/2003 of 3 November of the Heritage of Public Administrations.

4. Those goods of cultural interest which form part of the patrimony of the National Library of Spain or are attached to it, whether movable or immovable, shall be subject to the special protection and protection regime laid down in Law 16/1985 of 25 June, of the Spanish Historical Heritage.

CHAPTER V

Hiring, budgetary, and economic-financial regime

Article 13. Recruitment scheme.

The recruitment regime of the Spanish National Library will be governed by the provisions of the law on public sector contracts.

Article 14. Economic resources.

1. The economic resources of the National Library of Spain may come from the following sources:

a) The assets and values that constitute your heritage.

(b) The products and income of such assets.

(c) The specific consignations assigned to them in the General Budget of the State.

(d) Current transfers or capital transfers from public administrations or entities.

(e) ordinary and extraordinary revenue, whether governed by public or private law, which, in accordance with the provisions governing the national library of Spain, is authorised to receive, and in particular those from the the sale of publications in any medium or medium and other types of objects, the holding of courses, seminars, cooperation agreements and the activities of the Agency, such as the interlibrary loan, the reproduction of documents, the bibliographic searches delegated, the selective dissemination of the information, or any other activity or service related to the functions of the Agency.

f) Grants, voluntary contributions, donations, inheritances, legacies, and other contributions from private and private entities.

g) Revenue received from natural or legal persons as a result of patronage, sponsorship of activities or facilities.

h) Any other resource that might be attributed to you.

2. The resources specified in the preceding paragraph, with the exception of those referred to in paragraphs (c) and (d), shall constitute the Agency's own resources.

3. The Royal Board of the National Library of Spain will carry out an active work of attracting own resources, especially the derivatives of the contributions free of charge from private and private entities and of the income received as consequence of the sponsorship of installations.

Article 15. Revenue from own activities and assignment of spaces.

1. The income of the National Library of Spain derived from the activities of the Library will have the nature of public fees or prices, in accordance with the provisions of Law 8/1989, of April 13, of Public Fees and Prices.

The establishment or modification of the amount of public prices will be done by the National Library of Spain, after authorization from the Ministry of Education, Culture and Sport.

2. Revenue from the use or disposal of spaces of buildings, owned or owned, which are classified as demanial, have the nature of the fee and are governed by Chapter VI of Title I of Law 25/1998 of 13 July 1998, Amendment of the Legal Regime of State and Local Rates and Reorder of the Public Character's Benefits. The determination of the amount or its modification shall be made through ministerial order.

3. The management and collection of prices and fees will be carried out by the National Library of Spain, which will enter them in their patrimony.

4. It shall be revenue from private law to the other person who receives the Spanish National Library for the provision of services or the performance of activities which, according to the law, are not of a tax nature, do not constitute public prices and not derive from the exercise of administrative powers.

Article 16. Participation in companies or foundations.

When it is essential for the achievement of the purposes assigned to it, the National Library of Spain may participate in societies, foundations or other non-profit entities whose object is in accordance with the objectives of the the National Library of Spain, in the terms established by the legislation in force and as determined in its Statute.

It will be up to the Council of Ministers, on the proposal of the Minister of Finance and Public Administrations and on the initiative of the person holding the Ministry of Education, Culture and Sport, to authorize the acts of acquisition of titles representative of the capital of commercial companies, either by subscription or purchase, in the event that the authorization of the Council of Ministers is not mandatory in accordance with the provisions of Law 33/2003, of 3 November, of the Public Administrations.

Article 17. Budgetary regime.

The National Library of Spain will annually prepare a preliminary draft budget and forward it to the Ministry of Education, Culture and Sport for further processing in accordance with the provisions of Law 47/2003, 26 of November, General Budget.

Once the budget has been approved, it will be made public on the website of the National Library of Spain, according to the principles of transparency and good governance.

Article 18. Accounting.

The Spanish National Library will be submitted to the General Public Accounting Plan, in accordance with the provisions of Law 47/2003 of 26 November, General Budget.

Article 19. Economic-financial regime.

1. The economic and financial management system for the financial management of the National Library of Spain will be established for the autonomous organizations in Law 47/2003 of 26 November, General Budget and other regulations that is applicable.

2. The exercise of the internal control of financial economic management, through the intervention function and the permanent financial control, will be carried out by the Delegate Intervention in the National Library of Spain.

Additional disposition first. Use of the different official languages of the State.

Taking into account the essence of the National Library of Spain as a cultural reference of international scope, and in order to contribute to the dissemination and normalization of the multilingual heritage of the Spanish State, it will be promoted in the materials published by this Agency, as well as in the information inherent in the work exhibited and the one offered to visitors, the use of the different official languages of the State. Special attention will be paid to the issue of co-official languages of materials in electronic format.

Additional provision second. Accessibility of people with disabilities.

According to the applicable sectoral legislation, the facilities and services provided by the National Library of Spain will be accessible to persons with disabilities, who will constitute a special social group. reference for the action of this Body.

Single transient arrangement. Duration of the Royal Patronate's vocal command.

1. Until the entry into force of the new Statute of the National Library of Spain they will continue as vowels of the Royal Patronato as indicated in Royal Decree 1638/2009, of October 30, for which the Statute of the National Library is approved from Spain.

2. Upon the entry into force of this Law, the renewal of designated members of the Royal Board will be carried out. Those whose terms of office were in force at the time of the entry into force of this Law may be re-elected.

The duration of your term of office, regardless of your date of choice, will be established in this Law.

Single repeal provision. Regulatory repeal.

Article 97 of Law 31/1990, of 27 December, of the General Budget of the State for the year 1991, as well as all the provisions of the same or lower rank which are contrary to the provisions of this Law, is repealed.

Final disposition first. Competence title.

This law is dictated by the provisions of article 149.1.28. of the Spanish Constitution, which attributes to the State exclusive competence in museums, libraries and state-owned archives.

Final disposition second. Maintenance of certain provisions.

Royal Decree 1638/2009 of 30 October, approving the Statute of the National Library of Spain, will remain in force, in so far as it does not oppose this Law, until the entry into force of the new Statute of the Library National of Spain.

Final disposition third. Approval of the Staff Regulations.

Following the entry into force of this Law, the Government will approve as soon as possible the new Statute of the National Library of Spain, adapting it to it.

Final disposition fourth. No increase in expenditure.

The implementation of the measures included in this Law shall not entail an increase in appropriations or remuneration, or other personnel costs.

Final disposition fifth. Entry into force.

This Law shall enter into force on the day following that of its publication in the "Official Gazette of the State".

Therefore,

I command all Spaniards, individuals and authorities, to keep and keep this law.
